Unfortunately they are just that - 'guidelines' so can probably be used to illustrate an argument or point but it is doubtful whether they can be used to enforce a point. - In theory they can be used against a creditor when presenting a case to FOS.

 

I have not used the guidelines in court but have used them in a complaint to Lloyds TSB about unfair set off using an overdrawn account. I have had a reply from Lloyds complaint dept. in my favour and will post an update on the thread about this later. At the moment I am bogged down with another matter!!
