    • Hi, She said the machine actually tells you how much you have to pay and you pay on your card. I've actually emailed evology who make the machine to ask for an explanation as to how this can happen - in essence it is 1min over! With regards to the 8 mins one, she is adamant the the machine said no charge when she left - her ex-boyfriend was with her in the car and he confirmed this so god knows what is going on. Worth chancing the set aside? With regards to G24, not done anything yet - not sure I want to alert them to the other address - should I just write and confirm the Scottish address with no reference to anything else?     • Hi BankFodder, thanks for the reply. The firm was T B Plastering & Decorating in Callington, Cornwall.  They have a facebook page which I can't link. We have already sought the advice of a second plasterer. He has seen the work, conrfirmed its way out of any NHBC tolerance and well below the standard of any professional plasterer. We are currently awaiting his quote to remedy the awful quality work, but he has said it will definately involve ripping out and re-boarding two entire window reveals, moving two door frames outwards, possibly new fire-rated cement boards in the fireplace if I cant chip off the non-compliant rubbish which was put on there, and knocking off several blown corners and bodged internal corners. He also confirmed that the whole lot was plastered in one thick coat, rather than two thin skims as normal. This means that as it continues to dry, more cracks will appear as the outer face dries faster than the inner face. Indeed, cracks are still appearing one week on. When I confronted the original plasterer, I gave him several opportunities to get the work sorted, but he just stood there looking shocked saying "What do you want me to do?"  When I replied "I'm not a plasterer, what do you think you can you do?", he just repeated over and over "It's within tolerance, what do you want me to do?" It was clearly going nowhere, so at that point I invited him and his labourer to leave.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi can some one help me out i know someone who has had there goods taken off them by bayv today the person also had said to him if he had goods for over 3yr he would not of been able to taken them is this true ? also if they take goods back is the det owed quashed ?

tis person i know has been with bayv for a good few yrs now yesterday bayv came out for payment but he was sort so he told them he did not have the rest of the money to pay the person from bayv said he would be back today to take goods from him anyway today came and he came to take goods but this person from bayv said to him if the goods he had had been paying for had been over 3yrs he told him they could not take them cause they were 2 weeks under the 3yr they could take them away is this true what he has said to him also he told him that his det for these goods will be quashed and he will owe nothing is this true ?

it depends on quite a few things dont know where you stand on if you would still owe the debt i think it depends how far through the debt you are. hope this helps.

You might want to reconsider them as a company to buy from, ive got this off facebook, apparently a customer purchased a washer from them and this happened! (check the photo below)

It Was Found To Be Faulty

That Is Why It Burst Into Flames.

The Cost Of The Damage To The Kitchen Area Was A Massive £8,ooo.

After Living In Terrible Conditions For 6 Months No Gas No Kitchen Facilities With Young Children In The Home

B A Y V Operations Director I Found Very Helpfull Indeed She Actually Took The Bull By The Hornsstood No Nonsense And Got The Job Put Right.

She Visited The Site And Met With Us In An Attempt To Put This Matter Right.

Indeset The Machine Manufacturer Was Really No Help At All To Us .

They Employed A Loss Adjuster Who Showed Very Little If Any Sympathy Towards Our Situation,he Was Going To Drag It On But This Director From B A Y V Said Not A Chance It Will Be Sorted .

But I Must Add Indeed Without The Intervention Of The Director At B A Y V This Would Never Been Sorted Out.

My Overall Disapointment Here Was The Fact That The Loss Adjuster Was Really Intimidating Very Unhelpfull Indeed.

We Are Left To Replace Items And Redecorate Rooms Effected By Smoke Damage,cost Of Laundry Meals Ectwhilst In This Postion Was Never Ever Considered At All.

The Lengh Of Time We Had To Endure This And Suffering That Took Place By Our Family.we Was Never Offered A Penny Of Compensation From No Person At All.

We Was Told That Under The Agreement Our Only Redress Was Under The Supply Of Goods Act Implied Terms 1973.this Is The Legislation That Covers Such Agreements That B A Y V Issue .

On No Occasion Indeed Did We Get An Apology From Indeset Or B A Y V Regarding This Matter That Is Most Dissapointing Indeed.

Credit Is Given To The Director Who Did Her Best And Sorted Out The Kitchen.

When That Was Done They Just Vanished And No More Was Heard From Them.

Very Little Faith Indeed In Any Indeset Products There Customer Services Was Awfull Indeed.

Never In My Life Have Our Family Had To Suffer Through No Fault Of Our Own At The Hands Of Companys Like Indeset B A Y V Loss Adjusters Who Deep Down Apart From The Director Of B A Y V Never Really Gave A Toss What Had Happened.

Left Here Really Out Of Pocket And Very Disheartend In The Manner We Have Been Treated.

But With A Bit Of Luck Our Experience Might Benefit Others On Here How To Deal With This Crisis If Ever It Happens To Anyone Else.
