I am a private hire driver and collected a disabled elderly passenger from the local store. I stopped as close to her flat as i could to enable me to unload her shopping and help her up the stairs. I have sent them the printed job ticket for proof that i was working. Unfortunately the elderly customer lives right alongside the bus stop which in turn is at the end os a zig zag marked area. I pulled to the end of the bust stop which was as close as possible to her home and far enough to allow the buses to still stop safely. The bus drivers woudl be able to see my rear vehicle signage and know that i was a private hire vehicle. I was away from the vehicle for approx 2 minutes. The enforcement officer was just taking the pictures as i returned to the vehicle. He has also accused me of being aggressive and confrontational when it is more than my job is worth.. I have worked very hard to get my licence and would not risk losing my life for something so stupid. I wonder if someone could look at my scans and see if i have and chances of winning a further appeal. The rejected informal appeal letter states that i was abusive "towards them", there was only one enforcement officer and no more. I think they may be trying to fabricate between them for their own evidence.

Data Protection Act letter sent to Black Horse(21st june no response so far)

Data Protection Act letter sent to First National(no response either.)

DFS has succumbed to my request for a new suite as the last one was not fit for purpose

All letters sent recorded and signed for.

There is an argument you can present in your defence. It is based on regulation 18(1)(a) of Statutory Instrument 1996/2489

(1) Where an order relating to any road has been made, the order making authority shall take such steps as are necessary to secure

(a) before the order comes into force, the placing on or near the road of such traffic signs in such positions as the order making authority may consider requisite for securing that adequate information as to the effect of the order is made available to persons using the road

You can argue that if the traffic order requires a vehicle to be parked correctly within the bay markings then due to regulation 18(1)(a) of S.I 1996/2489 the council has a statutory duty to ensure that a traffic sign that adequately conveys this effect is placed on or near the road to make this information available to motorists. As neither the bay marking nor the traffic sign placed, adequately conveyed that you must park wholly within a bay marking, the council failed in their statutory duty and thus the PCN should be cancelled.

Can you get some bigger images? Load them onto a hosting website like Photobucket, then you can give us the web link here so we can look.

 

As I understand it, you parked in a bus stop. The question is, were there circumstances which might compel this? If there were yellow lines next to the bus stop for example, you could have parked there legally to help your passenger.

 

Personally I think the bit about being aggressive and so on is irrelevant to the case, but better images will help.
