    • Thanks very much, would just be reassuring to know I still have options at that point, and can avert anything nasty if needs be?  No idea what nasty would look like for me in regard to this but I worry about being done for fraud because I applied for the loans when I was not a UK resident and promptly transferred the funds abroad upon receipt.  Neither was allowed under the terms of the loan offer. Would they look into that sort of thing?  (Am I putting myself at risk admitting that here and should I delete this message, seeing as my gmail address is associated with this). I feel so ashamed admitting this.  As I mentioned in my first message, I was horribly manipulated into doing all of this and then scammed.  I fully intended to repay the loans and did my best to do so for over 2 years before my income took a massive hit in Oct last year.
    • no need to do anything before a letter of claim, then you can come here and we will help you. Most of these debts are sold on for a few pence in the pound to DCA's, who will try and make you think that they have legal powers. Ask yourself the question why so cheap?
    • Thanks, good to know.  Is it best to engage with them once court proceedings begin?  I've noticed advice on the thread saying ignore everything until Letter of Claim or notice of proceedings - so that suggests there is something I could do before/when that happens that is important? Would like to know what those actions/options are for me to take at that stage, to factor into my decision now weighing up the risks etc.
    • 6 years from date of DN/Last Payment to take you to court.   Further 6 years to enforce the CCJ.
    • Well I have none, so I think me telling them would be a proactive preventive step to "help" them weigh up whether to proceed with court action.  Doubt they would do so if they knew it was a waste of time because I own nothing they can send bailiffs to or put a charging order on.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

natwest worked for me, my parachte account was set up when i had a debt managament plan and NW have been fine so far!!

I vote Natwest too.

 

I guess it's a personal thing - I like the people in my local branch and never had the kind of problems I've since had with Abbey.

I had a current account with them which was closed when I got divorced.

I wish I'd stayed with them instead of Abbey. But now got a parachute Step account with them.

I have nothing but praise for Smile, the gave me a debit and a credit card a freeo/d for £500 and I do it all online and pay stuff in in the tpost office, apart from the savings account which you have to use their co op cash machines for, but you can always just tranfer money from one account to another and then go to any link machine, oh and I dont have to see anyone, and their call centre is in the UK

Thanks for all your replies.

 

I opened an account with Nationwide yesterday with online facilities. The staff keeps trying to get financial information off me in order to sell me mortgage, insurance and unit trust investments which alarmed me a fair bit (but hey, what else is new?). I wonder how much information we disclose to the bank are really necessary and on a 'need to know' basis!!

 

They asked me why I want another bank account if I banked with CrAbbey for 20 years! On hearing that I want a separate account for all my DDs, SOs and cheque payments, she immediately said their charge is £30 each time if I get overdrawn without authorisation and what nots. Hah, what a presumptuous wretch.

 

Now I have to tread very carefully, don't want to jump from a frying pan into the fire :Cry:.

:p, I would like that too! Hate talking to people whose has trouble understanding my request and wouldn't admit it, nor get things right for love or money :rolleyes:!

I'd vote for Nationwide..... only really because they have brilliant online banking facilities, and the people in my branch are lovely. As good a reason as any for chosing a bank :-)

 

I heard about them not charging people drawing our own money abroad. That's why I went with them. Now we have to see...:oops:

The traditional banks have more advantages than the building society conversions as they seem to offer better facilities. When I was in a very good job I never had any problems with Abbey either. Only when I got ill and been off work, now work part time and has a relatively low income that they become evil. My impression is that they only want to have 'premium' customers. :Cry:

Ive gone with A&L too my nearest branch is 7miles away but if you need to put money in you can do this through the post office with cash or cheque and you can get cash out at most machines (as theyve given me a card and cheque book too !):)
