      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys,

 

This is the stroy so far, sent DPA access req, in Jun, got what I wanted, sent prelim in Jul, got sorry your upset letter, sent LBA 2 days ago, got an offer for £230.00 today! NO way, I want it all back not 18.5%, what a joke! :mad:

 

I have to send off a form to let them know that I accept as full and final settlement! Now what do I do, do I write a letter saying I accept it as part payment and will be pursuing the balance, or do I send this form and amend the part where it says full and final?

 

Stupid question I know, but want to get it right! :oops:

 

I feel quite elated after opening my post, if they were in the right, surly they wouldn't offer me anything!!! :confused:

If you haven't yet filed your claim at Court, write a letter stating that you are preapred to accept the sum as part repayment but that you will be pursuing the rest through the Court.

Then as soon as your LBA deadline runs out...get the court claim in!

just send them a letter mine went like this

 

Thank you for your letter dated 10 August 2006 offering a goodwill gesture payment of £546 I will accept this offer only as part payment and not as full and final settlement.

 

I am very disappointed that you have failed to respond positively to my letter of the 26 July 2006 LETTER BEFORE ACTION. I look forward to hearing from you within the next 5 days with regards to refunding all charges levied from my account these amount to £1022.

 

After that, there will be no further communication from me and I shall issue a claim at the expiry of this deadline.

I'm finding this all rather exciting! I know it sounds sad, and yes I do need to get out more lol!

Just to update...

 

Sent my Moneyclaim off this morning, wow I feel so empowered, this is so wierd.

 

Thanks to everyone for all your help through this, especially to Phoenix for your help yesterday with the spreadsheet, was having major problems!

 

So now I guess I sit tight and wait for the bank to put in a defence and then maybe back down at the last minute. That seems to be whats happening on the other threads I've read.

 

Anyhoooo, I've done the hard bit now. I'm finding this all quite exciting, think I might become a lawyer type now... was thinking of a career change LOL :lol:

 

Anyway, wish me luck, and good luck to everyone else!

Recvd notice that HX have acknowledged claim and intend to defend in full!

 

Now have 28 days to put in defense. SOoooo, shall sit here twiddling my thumbs some more.

 

Has anyone got this far and lost yet? Just curious... paranoid that I will be the one they make an example of if you know what I mean.

So far from what I've read NO ONE has been taken to court by halifax, and frankly if they're going to do it, I'll probably get it as I'm claiming more.

 

Normally (again from what I've read) once halifax state they're going to defend the money pops into your account - so keep checking.
