Hi Faded-Rose, just popped in to give you some support.

Ell-enn is the best! (you too Jansus)

I can't give the sort of advise that they do, but if you want any moral support let me know. I've BTDT and it's a very difficult time leading up to the hearing, even knowing that the outcome should be favourable- it's hard to deal with.

Thank you so much for this. Ell-enn and Jansus have been superb. Really feel supported. Posted everything off now so out of our hands until next week. It feels that everything in between now and then will be affected but trying to stay positive. Will be pleased when the day comes and we have a decision.

 

How lovely of you to post this. A superb site and so lucky to find it.

Hi Ell-enn, Jansus and Nunnyrose

 

The Form N11M plus enc was delivered to the Court on the 2nd Dec and I have a printed off 'receipt'.

 

I have typed a brief note based upon corrections to the Witness Statement they have sent a copy of - hoping I can just give the Judge and them a copy to read rather than read it myself!

 

This time tomorrow it'll all be over.

 

A big thank you again for the assistance, advice and support shown. Really grateful.

Hi Faded Rose, stay positive - you will be OK.

 

If you haven't been to a court hearing before, here a few tips to help you:

 

You should arrive at the court in plenty of time (allow for finding parking etc). When you get there, ask the court usher if there are any free legal reps there (a lot of courts have them) - if so, approach them and ask for their advice, they can accompany you into the hearing and speak for you.

 

Sometimes the lender's legal rep will ask to speak to you, if at any time you feel intimidated or uneasy, just tell them that you would rather wait for the judge to decide.

 

The hearing will be held in a private room with just the judge, the lender's rep and yourself. It will be conducted around a table, like a meeting and the public are not allowed in. It is much more informal than you'd imagine.

 

As this is the lender's application, the judge will speak to them first and then you. Judges are usually very good at recognising when you are nervous and will guide you. When you speak to the judge you should address as Sir or Madam, explain that you are very nervous and ask if you may hand over your notes. If you have the benefit of the free legal rep then they will speak for you.

 

The whole process should take no more than 10 minutes and I'm sure you will feel very relieved when you leave the court knowing your home is safe.

Thank you Ell-enn that is so helpful - I know I can do it, have to. Hubby more nervous than I but he will be there. It will help to know that we have the thoughts of others.

With you all the way Faded Rose, not an easy day tomorrow but as Ell-enn says, stay calm and positive - I was so nervous I could hardly speak, but the judge did recognise this and did all he could to help us.

This time tomorrow you'll be sitting back with a big glass of wine,- I'll probably join you :)

Wasn't able to log on yesterday due to broadband probs (again!). The outcome of the Hearing was a suspended repo (as requested by the lender). So very happy with that. It was a strange experience - 2 mins and we were out. Judge wouldn't let us speak, nor give typed notes and the 'locallish' person representing the legal firm was quite unpleasant but over now.......

 

A really BIG thank you for everything. We will donate and I will keep being a cagger-not because I can offer any advice but hopefully I can give others the support I have had the benefit of.

Great news :)

It's not a nice experience, but as you say, it's over now.

I found the day after our hearing, not only were we more relaxed, but the whole house seemed to have relaxed if that makes sense. It was a very strange, but calming feeling. It took me a few days to shake off a fuzzy sort of feeling. I suppose it's a bit like the build up to christmas in reverse - you don't look forward to the big day, but the after effects are fantastic!
