    • Thank-you @BankFodder, your statement is a correct understanding of my position and I agree, it is actually really what I was looking for in starting this thread, as I too believed that the maximum I could claim for is that which I sold it for, even though this was substantially below market value at the time. And so, this sold value is what I shall be claiming for + the other expenses. @dx100uk I get your point, but this is just not what I want to expose myself to. Unfortunately I was one of the unlucky ones to have my details stolen in the Peoples Energy hack, and in 2020 I discovered that those details had been used to take out car insurance, and that the insured was then involved in a collision and my details were dragged through the mud. Despite Aviva cancelling the claim and treating as though it never were, even though I have the letters from them to say that they have removed this claim from the insurance database, I still get refused insurance and credit products to this day until I send across the letter from Aviva which explains that I was a victim of fraud. So you'll forgive me for not jumping up and uploading my data to a server utility for which I have no control over its retention policy, or where the server is located globally, its legal jurisdiction, or its security protocols.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Even though their last letter obviously doesn't warrant a response, I thought it would be discourteous to ignore it ....

 

Dear Sir/Madam,

 

Disputed Parking Invoice: 0226090916001

I acknowledge receipt of your letter dated October 16, 2009.

 

I note that despite repeated requests, you have been unable to provide any credible authority confirming the registered keeper of a vehicle being liable under your contract with Jempsons, and am therefore of the view that none exists.

 

As I have previously indicated, I do not drive the vehicle in question. It is a pool car used by different employees of our business. I am not currently aware of who was using the vehicle on September 16, 2009. While I have absolutely no obligation to provide you with details of the driver, I will endeavour to obtain these subject to being properly reimbursed for my time. I estimate this will take at least one hour, for which my charging rate is £95.

 

If you wish me to make further enquires please submit your remittance in the sum of £235, being £95 for my time together with the two attached unpaid invoices totalling £140, to the above address. Once your cheque has cleared I will use my best endeavour to obtain the driver’s information.

 

Until such time as I receive the payment outlined above, I will be unable to assist you further and remind you, whilst writing, that further frivolous demands will incur an administration charge in accordance with our existing agreement.

I'd be interested if anyone here knows on what basis a member of the public is not allowed to write to the director of a company at his home address, particularly when the company concerned is in the business of retrieving addresses from databases itself and then sending bogus invoices and threats!

Thanks - I was bit surprised how easily these parasites accepted the reality of the situation.

 

I guess you can make them back off if you make enough of a nuisance of yourself!

 

I think you clearly demonstrated to them that you are not a mug and would not be paying their parking charge. Once a PPC have realised this then there is little point in carrying on. All this gesture of good will business is just a euphamism for "we give up".

 

With regards to writing to their director I see it like this. You were failing to get a satisfactory response by writing to the company; therefore, you obtained the Director's address (easily accessible via Companies House) and wrote to him directly with your issues. This seems to be a perfectly reasonable thing to do.

 

In response to their "we will start legal proceedings" nonsense my reply would be - for what? lol :)

 

It has got me thinking though - perhaps we should have a photo hall of fame for all PPC king pins.

Why not? Like pigs at the trough.

 

Couple of them look like they were straight out of prison when the pictures were taken - which is where they probably belong.

 

It appears that pirates like this also "police" the mother and baby spaces at the supermarket, rather than the proper authorities, which is handy to know as they are always close to the entrance and a bit wider which avoids some oik banging their door into your car!

I'm helping a chap I know deal with this outfit. They ticketed him at a supermarket for parking in a disabled bay. He is in fact disabled but forgot to display his badge. He's embarked on the ignore route; however, I will be collecting some photo's on his behalf. The signage is very interesting to say the least. It talks about Civil Penalty Notices and says nothing about entering in to a contract to park. I think they are on very flimsy ground. That said, I have never heard of Town and City taking court action.

 

Motley bunch aren't they? I think there might be a touch of job overlapping going on with all those people. I like the fact that the MD was an investment banker - it seems only natural that he should move in to an industry like private parking :grin:

I know, I might post up a picture of the sign for us all to have a chuckle. You get a generous 3 hours to use the store - I don't know about the rest of you but I can't handle 30 mins in a store, let alone 3hrs. Interestingly, before ASDA introduced this company, their parking area was never more than half full, even on the very busiest days. There was simply no need to use them in the first place. Add to this, there were never any issues of abandoned cars either.

 

Perhaps they issue their Civil Penalty Notices under ther Planet Perky Private Parking Act :grin:.

I feel like calling the cops regarding the TPS posstops - there's a breach of the Administration of Justice Act there that could do with investigating.

 

Find out who the Inspector is at your local station and write to him explaing not just what has happened but also the implications of it and why it must be investigated. Have a look through your paperwork and see if you can find any breaches of the Fraud Act 2006 aswell.
