    • Might be worth passing story to RIP off Britain?
    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles.
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.
    • was at the time you ticked it  but now they've still not complied . if you read up, here , you'll see thats what everyone does,

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Collections performance stabilises in 2009 - 18/09/2009

dictionary_debt.jpg

Customer payments to debt collection agencies have stabilised in the last two quarters according to research by the Credit Services Association (CSA) and the Debt Buyers and Sellers Group (DBSG).

The trade associations’ collectability index provides an indication of debtor ability and willingness to pay by measuring the full settlements and payment plans agreed with the industry’s biggest collection companies. Both the index of instalments and the index of settlements stabilised in the first two quarters of 2009, following a continuous decline in 2008.

CSA executive director Kurt Obermaier said this could indicate that we are in a bottoming out period of consumer’s ability to pay. "However these are early indicators and no firm conclusion can be reached until quarters three and four 2009, perhaps even quarter one 2010," he said.

Worsening employment figures mean it is too early to say the lowest point for collections has been reached.

Oh really.

Most DCA's are in the red but these figures include pitiful revaluations of book value, ( 1st credit £5.5 mill - which must be less than 1% reduction!!!).

The accounts are also historic 2007 - 2008, 2008 - 2009 will be an absolute disaster.

I think there will be a fair number that don't survive.

Meanwhile, the proportion of settlements agreed has dropped. An average of 33 per cent of consumers were able or willing to fully settle their debts in the first two quarters in 2008 compared with an average of only 25 per cent for the same period of 2009.

Hopefully, we'll see a few DCAs going destitute.

Can't afford to subsidise your pools, cars, weekend p*ss-ups there, Mr Maynard/Mr K*****n/Mr MacKenzie/Mr Carter/Mr Bartle? (apply any workable MD name)

Shame - my heart bleeds for you. I might drop a penny in your tin if I pass you - oh no, that's spit!

Since when has a DCA ever considered anybodys [in]ability to pay? Every one that I've had the misfortune to deal with has acted as if I've just won the lottery  When I did once try to reason with one that I'm on disability benefits they didn't take a blind bit of notice

Ah! Although they scream/shout and threaten to boil your head in oil, if you can't pay they're stuffed.

The only sanction they have, (if they've bought it) is to take you to court or, advise the OL to sue if they are just agents. It is axiomatic that you are on a hiding to nothing suing someone who can't pay you.

Huff&Puff

Judges are of the view that it is not the purpose of state benefits to pay debt collectors. If you are paying any collector more than £1 per month, reduce the payments to that now.

That's around the order of payments that a judge would award.

The only payment that I'm making is £2 a month for a CCJ that Bryan Carter won, before I discovered CAG  But it's OK, he split his claim. I'll pay it off later this year (~£300), and he can go and get stuffed for the other ~£6500 :D

Everything else is Stat Barred apart from one totally unenforceble one where I just ignore Aktiv Kapital completely :)

Wised up to him then!
