    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles.
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

DCRI have sent me a letter informing that this is a notice of potential court action and that documents are being prepared for the issue of proceedings. i have til sept 21st to pay full amount which i just cannot afford to do, or call them to discuss options.

 

PLEASE PLEASE HELP, I AM SCARED WITLESS, IVE NEVER SEEN ONE OF THESE BEFORE.

DCRI are 'debt clear recoveries and investigations limited'acting on behalf of MBNA.

 

sorry to sound dim here but to clarify if my cc was taken out before 2007 which it was, does this mean MBNA dont have a leg to stand on?

 

should i write to either of these people and if so whats the best template to use?

 

god, ive got so much to contend with right now and then this lands on my doormat......please someone tell me there is light at the end of the tunnel???

Next received a letter from Restons Solictors threatening court action. Also told them to bog off and oddly haven't heard from them either which, seems rather strange given others' experiences on here!!

what letter did you use to tell them this??? im not so sure this is gonna work with them as they have sent me several letters and this ones pretty serious, i just cant go to court!!!!

 

is it worth me calling MBNA or sending letter, if yes, what letter should i be sending?

I must admit that I am rather bemused as to why this account has been passed to yourselves, as it is in dispute with the **original creditor/DCA** and has been since DATE 2009.

Not only is this a breach of OFT collection guidelines, but also in breach of the Consumer Credit Act 1974 and Data Protection Act 1998

 

My last letter from **original creditor/DCA** was DATE and intimated that my complaint would be

resolved on **DATE**, this obviously hasn’t happened.

As **original creditor/DCA** are now in default of my Consumer Credit Act request, OFT Collection Guidelines, *Subject Access request and have also breached *s10 Data Protection Act request , I consider this account to be in SERIOUS DISPUTE.

 

As you are aware while my Consumer Credit Act request remains in default enforcement action is NOT permitted, under s127 this constitutes a complete defence at law.

 

Consequentially any legal action you pursue will be averred as both UNLAWFUL and VEXATIOUS.

 

Now I would respectfully suggest that this account is returned to the **original creditor/DCA** for resolution of these defaults and breaches, as **New DCA** cannot lawfully pursue any enforcement activities.

 

If **New DCA** chooses to ignore my dispute and attempt enforcement, I will initiate legal action and file reports with the appropriate authorities, including, but not limited to, Trading Standards, Office of Fair Trading, Information Commissioners Office, Financial Ombudsman Service and possible court action.

 

After taking advice, I am of the opinion that any continued pursuit is in violation of the Administration of Justice Act 1970 section 40 as well as breaching a number of the OFT Collection Guidelines

 

I hope that this will not be necessary and an acceptable solution can be accomplished.

No, not at all!! :-o

 

You need to check if your agreement or other document (usually application form) contains your signature and prescribed terms. In the case of the latter, it needs to be "within 4 corners" which means front and back of same page.

 

You need to scan your agreement up for comments.

No, don't call them, they'll only tie you up in knots.

great thank you guys. account in dispute going off to DCRI tomorrow recorded delivery!!! is something that everyone has had luck with?

 

so that i get all my facts right, should i still be sending the £1 payments to my debtors ie MBNA, CAP 1, etc......regardless what my status with them is?

whilst were on the subject, has been a fair while since ive heard from crap 1 and their bullyboys, should i still be paying them their token £1 payment or wait to hear....not sure if no news is good news as you just dont know when they might turn up again???!!!

 

I'm in a similar position with Egg in that I'm also paying a token £1.

 

It's up to you at the end of the day. There are only so many battles that you can fight at any one time. Perhaps it might be best to let sleeping dogs lie until such time as you are forced into taking action.

thanks welshman. all help is very much appreciated, it still scares the hell out of me tho as all this is new territory for me.

 

maybe, just maybe, cap i realise that their cca is actually worthless and are fighting a losing battle, would be interesting to hear other peoples stories/verdicts on things like this.

It's commonplace to stop paying once you have advised your creditor that the account is in dispute.

 

As you're already getting hassle from MBNA then I don't see that it will make any difference if you stop paying. (Although you may be grateful 6 years down the line!!)

 

If CAP 1 are leaving you alone then I would be inclined to keep paying them as I've stated above.
