I requested a CCA from Marks & Spencer Money for a credit card.

I received a forwarding letter, Printed out terms and conditions and the agreement below...

The account was opened in 2005

Is the Agreement Enforceable?

Thx

Can't really see the details on the documents, it's not very clear.

Is it a true copy of the original signed by you credit agreement? If not then the debt is not enforceable.

:!: Activ Kapital 2009 - £316 debt cancelled due to no credit agreement

:!: TNC Legal Collections (Swinton) - £61 written off due to complaint being upheld with the FOS

Well, for this to be enforcable, they would need to be able to produce a document where page 3 was the reverse of page 1. Page 2 just refers to direct debits. If pages i and 3 were one document, then in my opinion, a court would enforce this.

Did it come as one sheet?

Does the first sheet have your name and address on it.
