An interesting question, and one that I hope someone can shed light on.

 

I'm with HSBC, but when I initially opened my account 24 years ago it was with Midland (who, funnily enough, did tend to listen in those days...but still said no...)

 

Now, clearly my request for refund only goes back six years, and is against charges applied by HSBC. But, whilst I was no doubt informed of the merger between HSBC and Midland, at no time do I remember agreeing to a new set of Ts & Cs.

 

Whilst continuation of my account implies acceptance of the Ts & Cs, it does not necessarily confirm that acceptance.

 

I would like to hear feedback on this, as a similar situation also exists for building societies demutualising into banks...

you have the legal right to have the original contract and all amendments to it since sent to you. apply for them and then look and see if youre right or if you simply didnt remember.

Sorry GF - I just found your response. It is something I hadn't even thought about, and I think I will do just that. Do you believe that this would be covered by a DPA request - and do you think that they will still have it after 24 years...?

I think they have a legal duty to hold info for 7 years - you could well be out of luck.

In which case, the argument about '...you agreed when you signed...' cannot be proven or contested by either side. A good instance for allowing the judge to draw his/her own conclusions...
