They took my name/ address/ a picture of me holding a signed banned letter. the only questions I've got are... will I be contacted by the police will this be recorded as police caution or criminal record?  I would really really appreciate if you could let me know how it went.  I am so so so ashamed of myself and am really making changes in my life I feel like I've lost myself for a period of my life but anyways it would be really great to hear back.     • I thought Delinquent ment "missing payments" its active so assumimg it can be seen ? also this is the only thing change on my credit file and that in its self being re added has dropped my credit score . the debt is SB and did drop off my credit file so how have or how can they re add it again ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If you believe they don't have your signature they will have nothing to compare it to so get someone else to sign for you, preferably someone who writes with the opposite hand to you and include a CCA request too to see whether they have an enforceable agreement in place. ;)

im not 100% sure on this but im sure it is illegal to force you to sign your signature.

when stopped by traffic police and given a 7 day wonder, they can ask you to sign to say they have given you it. but you can refuse to sign it. they cant take no further action to force you to sign it.

 

surely if the law cant force you to sign it, a Bank, Credit Card, DCA has no chance of forcing this issue.

 

i might be wrong just something i picked up in my life. i have refused to sign a 7 day wonder nothing was done to me.

Yes a copy of a utility bill which proves address,and a copy of something which proves name such as driving licence,passport etc-with your sig blocked out.

Just tell them that you consider these acceptable for the purpose of validation,and that you have no requirement to provide your sig.

If they still insist that you do-then ask them to provide you with proof that this IS a requirement,and on what legal grounds they demand it.

I would also remind them of their obligations under the banking codes,which require them to deal sympathetically and speedily with your request.

If they are in breach of the banking code-then this would equally trigger a breach under The Consumer Protection from Unfair Trading Regulations 2008.

most of the time they send out letters that are stamped copy signatures with no name (this has been my experience)I have many from Llloyds tsb and such and when i ask for them to sign i get nothing.If you have quoted i am sure the correct account number and address and name they can verify it,after all if you did this by email or phone how would you sign it.It as a way the banks and such stall,because while they are not acceptiong documentation you are still incurring charges.I have sent letters also without signing so find it strange.If you need further help why not contact Financial ombusdman service or see the CAB

The FOS will only deal once the bank/service provider has given a final response,or else have used the 8 weeks allowed.

I would also ask CAP 1 for a copy of their complaints procedure-they have a responsibility and duty to provide it.

this only works if they (the bank) follow rules.They continually flout these by asking for extra time over the 8 weeks.Normally as i have found they will put final response onto a letter within 8 weeks hoping that you will accept thier answer and go away.The best thing to do is wait the eight weeks but do copy in FOS and also talk with CAB.One thing you do not have to agree is the extra time they request.If they cannot dig out info within 8 weeks then they have a problem.I would also ask for all data that holds yourselves as the data subject from them.
