  1. Hi All Quick question: If a default notice has been issued 6 months earlier and then the account returns to normal status can they use that as a default notice or do they have to issue a new one? really interested in this answer!
  2. Hi All Question for you! When a bank doesnt issue a default notice and registers a default wrongly and then admits it (what are they entitled to). Can they reinstate the account and then come after you for the full balance? Please help! Wheety
  3. Well Hi all Update on what has been going on! I have sent off 3 complaints in recent weeks in regards to the credit card! 1. Complaint about PPI (where application form didnt have PPI ticked) - WON ALL MONEY AND INTEREST REFUNDED!!!!!!!! 2. Complaint about account being closed without a default notice issued - Verbally confirmed by Blair Oliver and Scott that account balance has been reduced to zero and they wont be pursuing me for any money. Also APOLOGISED for their part in the situation but were only doing what HALIFAX told them.... Still waiting on Halifax writing to me to confirm situation! 3. Complained about default - Again waiting update! Overall, will never bank with the idiots again. Also in my experience you will find out so much more and then they cant cover up their mistakes (like saying they issued a default letter when they didnt) as you have a copy of the info by doing a SARS request as the first thing you do....... Need a bit of advice though where is it written / case law etc that if an account is unlawfully closed then the creditor is only entitled to the arrears and not the full balance? I know what halifax are going to argue that they have reinstated the account thus they are entitled to the whole amount!!! Mark Wheety
  4. Hi all Well 21 days late I receive a huge SARS response from EGG after all. Now a little help needed if you all dont mind!! Where would I find details that EGG have issued a default? They have not included a copy of it nor of any details of their debt collection agency they were using at the time. I have looked in the Contact Manager Screen but only 2 letters according to this have been issued and neither around the time that the account was alleged to go into default. Anyone got a default letter code or an idea where I could find such information? Really would like some good news if any one can give me some!!!

  6. Hi All Has anyone else got totally useless information from their SARS requests with Egg. I have 3 accounts with them and although SARS all account have recieved 1 reply for 1 account with only the computer copy of the agreement. I have got no computer notes, no info of letters they have sent, no personal details of my address etc nothing just my agreement and computer screen prints of frankly anyone agreement as its so generic, and nothing else and they say they have completed my SARS request? I am just wondering any ideas on how to teach the primary school children at EGG how to do their job? Also on a separate matter to confused the buggers I also CCA them and to my surprise got a DIFFERENT load of information for the same account. This time I got a computer generated crap basically with CITIBANK at the top claiming this is my agreement and my computer signature. Considering I took out all my accounts pre-takeover when the bank was owned by PRUDENTIAL and my agreement was with PRUDENTIAL what stunt are they trying to pull and where whould you all go from here????   8. Hi All Recently got my SARS request also - and have been busy speaking to the SARS team @ Halifax to get explanations on many things! In regards to Defaults, if they have issued one, you can find the letter code in the customer service section screen prints. If you look for code L9220 / L9221 Letter sent that is when they sent the default and then take it from there. I started another thread to get the common letter codes on there as to help identify what they have sent out. This part is what they are duty bound to send by Law thus if they have a record of sending a default it would be logged on this system. (this is what more often or not they would rely on for their defence!!) If the letter code is there see how long from issuing to any further entries. If that doesnt show the default was invalid, I would then take the time to send a follow up letter to the Halifax / Put in a complaint that all information wasnt provided. If the letter code is not there, then they never issued a default. If they then try and say they did they either are trying to backdate their mistake - (which then you dont have to accept as you have a copy of your SARS which does not show that entry) or they didnt disclose the default (which they should have ((accurate record keeping on the customer service system)) in which sense hit them by complaining to the Information Commissioner who would be interested as to why....   9. Hi TAC The forum bar at the top of the main page for the Halifax gives all the addresses and other useful info for different things. worth having a look. However, I was the same in the beginning, too busy wanting to get on so the address is: Halifax Card Services Pitreavie Business Park Dunfermline Fife KY99 4BS Even if they dont process it in Fife (ie Halifax produce their response from Leeds) its the quickest address I have found to get a response from them!   10. Not 100% sure how that would work (SB) because in this case you can defer this loan every year until your 60 - but the debt still exists until its write it off at that point. Just because you went off the radar for 6 years in this case could have been treated as a deferment rather than a "missing person" as such. Just a thought!

Hi All If it helps flights can be rescheduled in the sense you are found the next available flight within the company resources (not always airlines often pay for you to travel on another carrier) to take you to your destination. If the company has placed you in hotels, paid for meals this means they have not abandoned you (ie cancelled the flight) they have rescheduled it (but this delay will still find them possibly liable for further compensation). However, the airline has by this time had incredible expense to look after you , hotels etc and would have asked you if you want to travel the following day. If you refuse dthen it has been cancelled. If you have accepted and then taken the hotel etc you have been rescheduled. Most airlines will work overtime to get you to your destination (I have worked for an airline that used to be subbed in when other airlines went tech) and I know just how expensive the whole costs are for bringing in another plane. The AUC is there to rule generally on abuse of the system by airlines and to see if that the "ATC delay" was really that. However, I know most airlines will not anymore try to cover their tracks a delay for whatever reason is what it is, a delay for whatever reason..... The fine for misleading the situation is not worth the risk nowadays.

SARS is a Subject Access Request - basically its a copy of most (wont say all as there are some exclusions on what you get) of the personal data that they have on you including records of files, notes following conversations, system notes. The fee is £10 (usually pay by Postal Order) and they have to reply within 40 days by law (most do, if not its all plus points for you if you need to take it further) You can find letter templates on here! Whatever you do dont give up - I look at this way if you give up you, you are letting a useless twit get the better of you! Wheety
  13. This is totally unbelievable and should be made more public.... I cant see how the SLC can have had the right to sell on your student loan (basically government money). I would go down the route of SARS requesting the SLC and get all information they hold on you and then find out where the have the right to sell your agreement onto a commercial company. This is a government backed organisation selling your debt commercially. At the end of the day the idea of the loan was when you reach a threshold to pay it back through your tax code (new loans or not) and regardless of if you went off the radar then you should be repaying this through your tax code / employer not to a seedy debt collection agency (ie deductions before you get your wage slip) this practise has got to be damn right immoral..... Even it does turn out to be a credit agreement I bet it will not be enforceable. Get more info and post it up here! This has really got to me, will offer any support I can....
  14. Just out of interest - why are you paying your student loan to a debt company in the first place.... The student loan has never been a credit agreement and thus they have no right to sell it on....
  15. In trying to make sure that we are not mistreated by the Halifax or unknowingly told the wrong information here are a list of common letter codes held by the Halifax and sent out... To find your letter code look down the right hand side of the letter and it will be there. I have been told that this codes are changing (especially with the merger with Lloyds / TSB) but they are currently valid..... Letter Codes L9220 is for a default Letter (not the termination one) L9221 is also said to be for a default letter L5001 is for a you have missed more that 2 payments in the last 2 months ALL please help for making a full list of the most common ones please Also I will post a copy of the letter formats when I get them. Halifax from what I have seen by reading posts on here are trying to confuse people on the codes and thus lets make a list to stamp it out!!! Hope you think this is a good idea and please add more or scan documents up to give us all an idea of what the letter format is! Wheety
  16. If you are having a problem - send a copy of a utility bill with their next request. You do not have to provide a signature but by sending a copy of an up to date utility bill you are proving your identity by living at the address. Make it something like a Council Tax Bill and they will comply. wheety

That is total crap (not you what the bank was saying) - how can your credit terms and conditions not be governed by the Data Protection Act as it relates to your account and the "so-called" agreement between both parties. What a fob out - plus any credit agreement would have your personal data at the top thus would come under the Data Protection Act.... They make me madddddddddddddddddddddd.....
  18. Hi Silverfox Thanks for your response. I am more than prepared to go to court several times as well! What I have been told by Halifax is the way they know that things have been sent out by their card services department is their letters are coded and mostly computer generated. This account has not got any of the default code letters (L9200 or L9211) which are becoming the common codes they use. The reason I asked is it worth asking for my Credit Card Agreement as I got a copy of my Application Form which is a copy of an agreement for a card I was not issued. I applied for a gold card but got issued with a basic card based on different APR's etc. I have not a copy of any of the terms and conditions of my credit card and thus cant argue its enforcability. Is this worth pursuing?
  19. SARS request GE Capital - find out every bit of information they have. You might find that a copy of you telephone call is recorded in the notes and that the default is a clerical error and could be easily removed. Or that another clerical error means the agreement is not worth the paper it is written on. Getting the SARS request would be the first step, but be prepared to fight!
  20. Or just send a copy of a utility bill - you would only have access to this if you were the person you say were.
  21. Hi Pinny You have a great claim for mis-selling!!!!! Pre-ticked means they were deliberately trying to mislead potential customers into the products. I would get your claim in the system for the PPI in regards to the mis-selling asap - and explain you reserve the right to add to the compliant at at a later date and will give them time to respond. Get them to admit they have been stupid then tell them the amount of money you require to rectify the situation. Its seems to work with them because once they admit they are wrong they are trying to get away with paying you less but once they have admitted it or made you an offer they have admitted it!!! You will have enough time to work out how much to charge them but from reading other forums on here you interest rate will have to be around 8% as anymore for it likely to be successful. Look for some PPI calculators on this site they are quite a few! In regards to the credit card charges, treat it as a separate complaint. As said get Halifax working more and also as I found out people in the Halifax dont talk to each other or keep accurate notes so they are more likely to slip up! I am not an expert, and I know this will cost you more money initially sending stuff to the Halifax but I think it also gives the impression you are here for the long run! Let me know if I am talking rubbish or if you need anything else!
  22. Just been going through my SARS request and getting mad on all the things they havent done to a old complaint even though they requested they would!!! Just noticed I had a copy of my application form but not my agreement. Should I CCA them now - however in theory they shouldnt have this information!!! Or should I just argue the case without it..... Any ideas????
  23. Hi all The situation is: my father is out of work and cant not repay this debt due to a life crippling brain injury. Whilst I am going through the legal loop holes to sort this account I decided (with my fathers agreement) to write off to the Nationwide as him and add me to his account so i could sort out his affairs. This being a lot quicker that They wrote back with the following documents. Basically saying they dont have the signature on file thus if they dont have the signature do they then not have the CCA....... Me thinks so!!!
  24. Hi MMM So how are you getting on with the codes from the Halifax? I think I have an idea to start a thread with the likely codes you could get. I have had a new code of L5001 and no one at the Halifax yet knows what it means!!!! talk about crazy!!! I am thinking it is the new you have missed a payment letter but cant be sure. I know L9200 means a default and I have heard that recently that L9211 is also a default code but I think this is crap!!! Its sounds like the Halifax covering their tracks!!! Sorry to bypost your thread, just wondering what we could do to get the codes up for everyone to see as a collective effort! Cheers Wheety
