      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A few more puzzling questions if you dont mind;

 

Over the phone he said that he will start the VT process and I specifically said that i want in writing the following:

 

1. all missed payment data to be rectified from my credit file

2. A summary of the instalments to be made upto 50%

3. no extra or optional costs to incur

 

They have agreed to this just waiting for the e-mail to have a hard copy of proof.

 

THE OTHER QUESTION IS THIS:

 

I have looked at the agreement they set me up on and the total i have to pay back is 13,018.60, however i pay £271.22 per month back, now look at this, my second part of the agreement that states early settlement figures are as follows:

 

after a quarter has elapsed £7,491.62

after half has elapsed £5,339.68

after three quarters have elapsed £2,776.89

 

How can this possibly be correct???? or am i reading this wrong??

Serious update:

 

Spoke to account manager this morning as i did not receive the e-mail from welcome as promised, conversation went like this:

 

Mr x - Morning i did not receive my e-mail yesterday

Mr y - yes i know sorry about that but someone from our legal department has spotted that you have posted notes on the consumer action website, i have no idea how they managed this. A letter is coming out to you by post this week as an e-mail would not be appropriate.

Mr x - Ok, thats better for as i will have a hard copy for my records

Mr y - So what do you want to do now??

Mr x - Wait until i receive that letter, stating, that i can hand the car back, just pay the rest of the instalments upto 50% of the value, and because of the nature of the situation for the missed payments info on my credit file to be removed, as they have agreed. Also no additional costs to be added for anything.

Mr y - yes Mr y as we discussed thats what will be in the letter, speak soon.

 

 

SO LADIES AND GENTLEMAN PRYING EYES ARE UPON US AS WE SPEAK, INSTEAD THEIR LEGAL DEPARTMENT IS WATCHING OUR FORUM AND TRYING TO INFORMATION INSTEAD OF SAVING WELCOME FROM DISASTER.

UPDATE:

 

Just received a phone call from welcome, the account manager stated have you received your letter, i said no, i stated are you sure you have my new address that i updated with you back in nov2008?????

 

Answer no: so all correspondence gone to old address

 

Looks like i will get it by wednesday this week, they then had the cheek to ask for payment, i stated not until i see whats on my letter, as we discussed!!!

 

MORE GOOD NEWS WELCOME HAVE REPLIED BY TO MY LOCAL TRADING STANDARDS, SHE IS INVESTIGATING AS WE SPEAK, SO I HAVE NOT TRADING STANDARDS AND FOS SERIOUSLY INVOLVED IN MY CASE.

 

PLEASE WELCOME DONT LET ME DOWN, OTHERWISE I WILL HAVE TO TAKE THIS ALL THE WAY.

update:

 

I have received the letter from welcome this morning, recorded delivery.

 

Its my termination letter that states up to 50% of the value of the car i'm still liable to pay minus monies already paid leaving me with a balance to finish paying.

 

However i still need written confirmation that my credit file wont be affected and also that there will be no more additional costs!!!!! I guess i will need to speak to the account manager again.

 

It is the result i was looking for, however not completely satisfied yet!!!!

 

any suggestions????

Looks good Rob if you can get in writing that your credit file will not be adversely affected and that there will be nothing further to pay then I think you have got it sorted.

 

And we all know they know about this forum and watch it closely - they figure out who everyone is - the funniest thing is when you write about stuff as a decoy and then they quote it back to you.

I just want rid of the car now as i have lost all faith in welcome finance and that the car was never worth its money by far, a lesson learned!!!

 

If anything goes wrong or they try and imply anymore costs then i will definitely go back to my case with FOS and pursue damages and also trading standards have involved themselves now so hitting from all angles.

 

The funny factor is they watch this forum with great interest it must be sad as a business that their training program to new starters will consist of 3 weeks training of observing the 'CONSUMER ACTION GROUP FORUM' in order to tackle the extensive complaints.

update:

 

spoke to countrywide lol and told them where i live and they laughed as they are based in devon and I'm up north, she said we dont cover those areas lol!!!!!!!!!!

 

She said they are a bunch of monkeys and causing their business some serious damage, she cant understand why they have not gone bankrupt yet???????????

 

Oh well welcome i guess you need to sort this out!!!

 

I also spoke to the account manager and stated that i have received my voluntary letter but no information on there about correcting my credit file, or that i wnt be liable for any additional costs.

 

COME ON WELCOME STOP PLAYING AROUND, IF YOU WANT YOUR PAYMENT PLEASE GET THIS SORTED THATS ALL I ASK OF YOU.

Well I Thought I Would Never Have To Reply To This Thread Again, However Welcome Are Back!!!!!!!!!!!

 

The Last Communication With These Was Back In Nov 09 Since Then I Never Heard From The Local Branch Since,

 

Now In June 2010 I Have Just Recieved A Letter From The Lewis Group Demanding Full Payment?????? I Have Recieved No Letters Or Anything From Welcome And Now This??

 

Can Anyone Help Please, And Who Are The Lewis Group??

Car has gone as it was a complete piece of junk, welcome refused to collect the car after loads of requests.

 

The car was rotten away in the drive, my phoned them so many times to collect and my local branch had closed down

As far as I can see they gave you a personal loan agreement instead of a hp agreement which, in my book, totally works in your favour! They have absolutely no legal right to the car whatsoever because your "alleged" personal loan was not secured on the car. Therefore the car should theoretically be deemed a gift and as you didn't receive any money in the way of a personal loan theoretically you shouldn't have to pay back anything! That's just my take on the whole thing tho ;)

The Whole Situation Is A Complete Mess, The Second Agreement Cancel's Out The First And Did Not Have Any Hp On It Nor Did I Recieve Any Money As A Loan.

 

I Believe The Stress And Deception They Have Put Me Through Is Unlawful And They Should Not Get A Penny. However I Would Like Someone On Here Who Knows The Legals A Bit Better Than Me And Finish Once And For All,

Well to be fair, if it was me I wouldn't pay them another penny after this!! What they have done is outrageous! In my opinion legally they aren't entitled to any money from you as you can't have a personal loan agreement that is meant to be a hp agreement!!

 

Have you had any joy from the fos??

 

They were never going to collect the car from you because they knew they had no rights to it whatsoever!!

 

You do have options here tho, if you want to ignore them they will prob go away, or you can write a letter to TLG explaining the situation and informing them you won't be paying and invite them to take legal action against you OR you can take the legal action route against them yourself.

The floor is yours, you are in a really good position! :)

I Did Have A Response With Fos However I Think They Misunderstood The Whole Scenario And Took Sides With Welcome, I Believe That Welcome Fed Them A Load Of Nonsense.

 

Fos Could Not See How I Would Suffer Any Financial Loss Down The Line If I Did Not Know About The Second Agreement. They Say It Could Only Be Classed As Probable????

 

Anyhow I'm No Lawyer But Surely What They Have Done Is Not Legitimate?? And Yes The Car Was Not Repossed Which Makes Me Believe That They Know They Have Made A Serious Mistake, They Even Admitted This Is Their Final Response Letter But Brushed It Off As If It Was Ok??????

 

Could You Help Me Compile The Letter As I'm Not Really Good With Putting Things Across, Also Where Is Postggj He Was Really Helpful Before
