Hi,

I got an interesting letter the other week there from DCA 'Buchanan Clark and Wells' regarding an outstanding balance from Provident and Greenwoods

(who I think are the same company??).

 

Long story cut short...

.my sister was struggling financially and was living at mine for a short while..

..i agreed to take out a provident and greenwood loan for her

....she was paying...

.told me she paid them off...

..i moved...

.and voila at present day.

 

My sister lied to me and did not pay them off so

there are 2 outstanding balances totalling to £337.00.

 

Ive now written to Buchanan Clark and Wells 4 times now responding to every one of their letters

but they just keep sending me the same one saying blah blach stop ignoring us.

..impending court action...

.contact us now...

.with no reply whatsoever to any of my points raised.

 

1. namely why is the balance so high now beacuse is was only an £80 loan off the top of my head and

2. ive been made redudant can you consider writing off the debt?

 

THis morning I got another letter from ScotCall saying they intend to visit my property within the next 7 days.

 

Where do I stand??

MBNA - £308.40 charges refunded :roll:

Halifax - £190.00 charges refunded

RBS - £2100.00 bank charges refunded :p

RBS - Pursuing PPI claim and removal of 3 defaults

Barclaycard - £290.00 charges refunded

T-Mobile - default removed :grin:

Littlewoods - no CCA - removed account

Forth Housing - CCJ to remove :mad:

Lloyds TSB - Pursuing refund of £800 charges

JD Williams - no CCA - pursuing

ok so i now got an email back from them saying that they are not in a position to wipe out the balances on the accounts and they now require me to call them asap to settle - what do i do?

hey,

 

firstly dont panic. I used to work for these folks and i can confirm they are the same company!

 

firstly, with the balance being so high is there a possiblity that your sister paid off the £80 but took out a new loan under your name! I've known of this happening actually because after someone has paid for 14 weeks they are offered a reloan for which they do not have to produce any ID!!!

 

Provident and greenwoods, do not charge for late payment etc apparently so i'm not sure where else the additional money could have come from.

 

You might be best treating this like any other debt. Write to them and use recorded delievery incase you do end up in court. From my experience they will not allow you to wipe off balences but i've known them accept payment agreements from people with massive balances but they £2 a week.

 

-My recommendation is ask for a statment! they will provide you with these!!

-find out what the extra money is!

-consider agreeing a payment with them even if it is for a few pound per month, as in the eyes of the law it doesnt matter if your sister had the loan it is in your name and its your responsiblity.

 

(sorry about the rabbling but conisder contracting the finical obustman as they will force provi and greenwoods into letter you pay off a small amount or none at all for a while until you back in work!)

 

also i dont want to make matters worse but companys like provident are now regulated and are shown on your credit file (they didnt used to be but the government recently made changes!) so please dont think it will just go away!

 

On your point about them visting your property... there are some good advice pages regarding balifis etc

Thanks very much, I will write back and ask for statements of the two accounts and see what they come up with. In the meantime I will try to agree a small affordable amount as you suggest.

Stand your guns and dont let them try kid you into paying anything more than you want to. they'll generally are big softies as long as you pay them a little something (even if its only a pound!).

 

Ps. threaten to take them to debt management if they get funny. they'll do anything to avoid it! (although i wouldnt recommend going to debt management and runing your credit rating! been there done that!)

hahaha im already too late for that option then....im currently in a DMP with Payplan....im just now realising there is light at the end of the tunnel as I only have around £5k oustanding now. Im plunging what money I have available into it.
