Hi all

 

I am just starting the fight for my charges which I estimate at around £4000. But my question is:

 

A few years ago when the clever working tax credit people screwed up my claim and stopped all my payments I hit V hard times. My overdraft ended up quite large and the bank advised me the best course would be to take out a large loan to pay it off ie; get myself clear - I have since discovered that part of the loan was to pay off my old loan (fair enough) but the rest was to pay off a whopping £1700 in bank charges!!! I am now in 5 yrs of debt - paying loadsa interest etc

 

Where do I even begin with that - what can I do about it? :confused:

Well obviously the £1700 can be reclaimed and I'm sure that that bring into doubt the validity of the loan amount. better check with some whose good at this sort of thinking. sorry couldnt be of more help. try a pm to a mod or helper

that's really interesting as I too have has to take out a loan to pay off my overdraft which has been increasingly raised to cover bank charges.

RBOS: Fob off letter recieved 28th June.

LBA for £2,690 & LBA for £3,240 sent 1st July. Replt to LBA'S recieved 14/7/06......fob off again!!! watch this space

This situation of loans being taken out to cover overdrafts etc made up of charges is something that is coming up quite a lot at the moment and the mods are aware of it and are looking at the implications and possibilities.

Please note that I am not a legal expert and all advice given is without prejudice and is purely my opinion only.

Lloyds TSB - MCOL issued 09/03/07 - £2953 + costs - ON HOLD....

you are not alone !!

 

I have been persuaded by the RBS for years to 'consolidate' my overdraft into a loan, which comprises of charges, resulting in me having a £20k loan which i was struggling to repay hence remortaged our home last year to cover it

 

Am really interested in what the outcome will be on this as I have just had a call from the RBS to say that they have been taking £38.00 out of my account for years for no good reason, and are going to investigate it and get back to me, but if these £38.00 's contributed to my overdraft which then contributed to my huge loan, how on earth is someone supposed to unravel that lot ?

 

I've known about it for years and have always queried it but they always seemed to have a plausable reason for the charge, seems they have changed their mind now !

 

Don't want to hi-jack your thread so have opened on myself further up

 

Does anyone know when someone will be able to advise us on this?

Hi there, i too got into a bit of difficulty with a £1000. overdraft (personal account) and a small £250.00o/d on a (business account). total of about £1900.00. lot of nice little charges. attempted to get some help from rbos in the January 2002ish to be told they coulnd't help! 5 weeks later when struggling they offered me a loan to clear off the 2 overdrafts......what a cheek offereing me the term of 3 years...still paying. will need some guidance becuse there are charges from the charges.....ahhhhhhhhhh. Bring it on RBOS!:razz:

:grin: Hi all

 

Cant believe its been so long since all this started and havent been able to get online much at all till now, but......

 

I WON!!!! RBS settled my loan mis-selling comlaint - after a helluva lot of fighting. I basically put my entire loan in dispute, they kept trying to take payments, I canx the direct debit 3 times as they said I couldn't do that haha. they then just took money frm my account to cover payments out of the blue. I threatened them with court and they finally stopped taking money. Fought some more - being told things like "my borrowing is my own responsobility" etc.

 

Finally received a letter saying they are wiping my loan (outstanding approx 3K just now) if I agree to a reduced amount of £750 to pay back over a term of my choice INTEREST FREE. (fair enough, that amount wasn't charges) and they refunded £1100!

 

I am waiting to hear about my basic charges claim for my main account but just for all those folk who were in the same boat back in august -we can win! If you were advised to take a loan to pay a debt of charges, go for it, you can win!

 

If I can help anyone please just leme know as Ive had loads of help from the good folks on this site and will be donating asap - this site is just what this country needs
