  4. you are not alone !! I have been persuaded by the RBS for years to 'consolidate' my overdraft into a loan, which comprises of charges, resulting in me having a £20k loan which i was struggling to repay hence remortaged our home last year to cover it Am really interested in what the outcome will be on this as I have just had a call from the RBS to say that they have been taking £38.00 out of my account for years for no good reason, and are going to investigate it and get back to me, but if these £38.00 's contributed to my overdraft which then contributed to my huge loan, how on earth is someone supposed to unravel that lot ? I've known about it for years and have always queried it but they always seemed to have a plausable reason for the charge, seems they have changed their mind now ! Don't want to hi-jack your thread so have opened on myself further up Does anyone know when someone will be able to advise us on this? cheers Amanda Onwards and upwards !!

Good Afternoon Folks The strangest thing has just happened to me, I have just had a call from the RBS to say that they have made a 'mistake', when looking at my account is seems that they have been applying a charge of £38.00 per month for what seems to be forever for no good reason whatsoever, and are now investigating it to see how far back this goes, before they refund me !!!! The thing is you see is that I have been telling them for years that this has been happening and asking them to justify this amount and they have always put it down to 'administration' or 'exceeding my overdraft (?)'. It now seems that this isn't the case. I explained that I had got to the end of my tether with this and am ready to persue them through the courts for the dosh, and the lady I spoke to said to hang on until next week, as they will get back to me within 5 days with the details. It is the most bizarre thing, I have also asked them to look into any implicated charges, say for when this charge has been applied and it takes me over my approved overdraft limit - what then ? Does anyone know if I can ask them for the 8% interest as well, considering they have had all this money for this length of time ? I'm still going to claim for the 'unlawfull' charges , but this has made the situation more complicated because what how do I go about proving the implicated charges of this £38.00 charge, because you can bet your bottom dollar that they arn't going to be particularly forthcoming with that kind of dosh, and if I have taken a loan to consolidate my overdraft which this charge could be attributed to what then ? Can anyone please advise me how to make sure that I get every penny back associated with this £38.00 charge ? I've just gone through the entire process as advised on this site and was literally going to take the papers to the court in the next few days to recover what I had calculated to be £4500 quid (ex interest) It's been an odd kind of day !! cheers Amanda Onwards and Upwards

Hi all Would appreciate a little advice here please, I have been trying to claim back my penalty charges with RBS since March of this year, I have been passed from pillar to post, and have had no success, I issued my final letter requesting a refund to Joyce Tudor about a month ago, and was met with a reply stating that I should contact Stuart Highley about a refund of my charges. So far I have done everything as advised on this site, even giving the bank the benefit of the doubt and allowing them longer to reply to my letters. Now I'm getting fed up, my final letter issued a month ago stated that I would like a refund within 40 days etc etc, giving the amount etc etc, and said that if the bank failed then I would issue court proceedings. I suppose what I am getting at is, do I now send copies of everything I have to Stuart Highley in the vain hope that he may do something about it, or do I now issues Court Proceedings ? Has anyone had any successfull dealings with this chap, am I likely to receive anything if I contact him or will it be another waste of time? in which case I'll be better off to go through the courts, we are talking a lot of money here, it was about £4500 when i added it all up, so with interest etc it will be over £6000 to settle at court. Would appreciate any advice here from those who are going through it at the moment
  8. hi With regard to your CH benefit, it is illegal for the bank to recover charges from a state benefit, it means that the bank are in effect profiting from the government. If they are using your child benefit to cover your bank charges (which it seems is what you are saying) it may be worth reminding them that they are in fact breaking the law, you are paid this money to provide for your child not so they can increase their profits and line their pockets even more. Hi Exactly the same thing has happened to me, I got the standard letter back from RBoS asking for a tenner to provide the information, then lo and behold the statements have come through today without me having to pay up. The problem I have is that although they have provided the statements, this isn't exactly what I have asked for, I used some of the templates etc and asked for a breakdown of all charges, and any information thay may have with regard to 'manual intervention' - this of course hasn't arrived, I now intend to push them for the money and will be sending my letter off tomorrow, but does anybody know if I can do this whilst still persuing them for the manual intervention stuff, I know that they have posted a default notice on me and more than anything want this removing because of the adverse effect this is having on my credit rating. Would really appreciate any help on this one, also I live in England but have registered my grievance with head office in Edinburgh as my local branch just ignored the initial DPA request does this matter ? cheers PS my total charges for the past 6 years have been £4750.85 !!!!!
  11. thanks good samaritan, I take what you say and even if I have got confused with RBS and BoS, I'm still not sure that BoS staff should have access to Halifax customer account information, they are run as 2 different entities so therefore the data should be kept separate surely ?? They just happen to be owned by the same people. This means that their data must be hosted together for the staff to be able to work on 2 separate banks' systems at the same time, so therefore I guess that there must be a security breach or DPA breach of some kind My partner is a Halifax customer and has in no way given permission for BoS staff to have access to his account info (he's not happy !) My account is with the RBS and not the Halifax, if the team is delaing with queries from all RBS Organisations (Halifax/Nat West et al) then surely there is a breach of the data protection act, I've never authorised Halifax staff to have access to my bank details....... It seems a little odd that's all
  13. Apologies for the first thread, things seem to have got a bit jumbled What I am trying to say is that the Halifax and the RBS are using the same teams to deal with queries from both banks ? is this right ? can they do this ?? thanks

Hi all I know there are other threads along the same vein, but I have an interesting piece of information here, I have jt the Halifax are issuing outust been reading through the RBS threads below and am interested to find that the number listed of 01422 333465, to respond to when you have been made a partial offer , is exactly the same number that the Halifax are sending out on their letters. I presume then that the Halifax and the RBS are using the same team in Leeds to administer all our queries - is this right ? can they do that ? My account is with the RBS but my partners' is with the Halifax I know that they are the same global organisation , but they trade as 2 distinct banks, is it right that potentailly Halifax staff can be dealing with my RBS account and vice versa ? Any help would be appreciated, is this a breach of the DPA on their side ? cheers

Can someone clear this up please, I have an RBS account in England , sent DPA letter etc, and heard nothing, when I called the branch I was referred to the head office in Scotland, is this ok? my branch did nothing with the letter and I seem to be getting somewhere with Head Office, Can someone please tell me what the liabilities are if my claim is being delt with over the border ? When I submit Court Proceedings, I will be doing so in England because that is where my account is based and I live. Is there any difference please ? DPA letter sent : RBS 04/03/06
