Hi all,

 

Having sent off my SAR and lodging my complaint about being missold PPI they have responded saying they will come back to me by 16th March but have also included a complaints questionnaire to help them investigate my case. I haven't read anyone else having received this, is it common practice and am i ok to complete ie. It won't detrement my case in anyway by filling it in? I know it sounds silly but just wanted to check.

Hi all,

 

Having sent off my Subject Access Request and lodging my complaint about being missold PPI they have responded saying they will come back to me by 16th March but have also included a complaints questionnaire to help them investigate my case. Be wary of this as a lot of banks etc have sent questionnairs to delay the claim and to get information from the claimant, that they have either lost or mis-placed. You could be helping them if you fill in the questionnaire so beware and put the ball back in their court. Namely you have a filing system with archives so use it;)I haven't read anyone else having received this, is it common practice and am i ok to complete ie. It won't detrement my case in anyway by filling it in? I know it sounds silly but just wanted to check.

That's my view make them do the work. You are claiming against them, they can ask you for information to assist them with the SAR but a lot of the time the questionnaire is a delaying tactic and used to fill in for information they no longer have despite the rules on retention of documents.

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

I think that they have 8 weeks to comply to the original request that I complained on is this correct and therefore is it just a case of waiting?

I didn't send back the questionnaire but have today received another letter stating that they remain committed to resolving my complaint as quickly as they can and will contact me again by the 15th April, this is a further month on from the 16th March. I think that they have 8 weeks to comply to the original request that I complained on is this correct and therefore is it just a case of waiting?

It is a while since I started my claim against RBS. They took months to respond but if you have made a claim for mis-sold PPI they do have 8 weeks to respond or not respond. In my case I got a response on one claim saying go to the FOS, so I did and got a success on the other one I had no response so again went to the FOS and got a success also got a complaint upheld against them with the ICO. Took a long time but got some sort of success in a way please see my very long thread and if you can use any information or pointers or letters to your advantage, please help yourself to copy and amend etc;)

Ok next bit of help please, received reply from First plus having previously asked for one extension they have now written saying the following.

"We are not yet in a position to provide you with a full response to your complaint but we are investigating the issues you raised. We will contcat you again no later than May 13th. a full response has taken a little longer than expected and at this stage you do have the option to ask the Financial Ombudsman Service to review your complaint, if you do wish. I very hope to resolve your complaintg without the need to do this. Blah blah blah, contact us if you wish on this number etc"

 

So what do I do, take it to the FOS or give them the extra month they are asking for, any advice?

I would not give them any more time give the FOS a call and start a complaint they will do the startup of the complaint form then send it to you for completion. You fill in the blanks and send it back with copies of all correspondence also bang in a complaint to the Information Commissioners Office for their failure to comply with the Data Protection Act 1998.

ok quick update - had another holding letter from FP so feel 3 months is now taking the mick. Had called the FOS and received all the paperwork, completed it and sent it off today so will keep you all posted if any news but having read other threads sounds like I may be in for a long wait........
