    • This is my slightly amended WS taking on board your previous comments, any suggestions for amendments would be most appreciated.  Thank you for you time.   1.        I am the Defendant in this matter. 2.        The facts in this statement come from my personal knowledge. 3.        I became aware of original Judgement following a routine credit check on or around 14th September 2020. 4.        The alleged Letter of Claim dated 7 January 2020 was served to a previous address which I moved out of in 2018, no effort was made to ascertain my correct address. 5.        The Judgement debt was not familiar to me so I began investigations to ascertain what the debt related to and how such a figure had been equated in any event. 6.        I made immediate contact with the Court, the Claimant Solicitors and the Claimants thereafter, asking them to provide me with a copy of the original loan agreement but this was not provided to me.  7.        I sent a Data Subject access Request to Barclays but no agreement was provided – See appendix 1 which details the timeline of communication between myself and Barclaycard as well as copies of correspondence between us. 8.        I do not admit to entering an agreement with Barclaycard in 2000. 9.       The claimant has failed to comply with the additional directions ordered by District Judge Davis and therefore this claim should be automatically struck out.  10.    The claimants have failed to disclose a true executed copy of the original agreement they refer to within the particulars of this claim. They are not entitled to enforce the agreement pursuant to section 78.6 (a) of the Credit Consumer Act 1974 12.   The reconstituted standard Barclaycard agreement that the claimant has included in the court bundle does not satisfy any CCA request and so the claimant is and remains in default of my CCA request and therefore unable to enforce the alleged agreement. 13.  The claimants have failed to provide proof the assignment, such as a deed of assignment. 14.  The claimant has failed to provide a statement of account setting out how the alleged debt accrued under that agreement 15.   Despite numerous requests to the claimant, I have still not seen any evidence, such as an original agreement or deed of assignment, that substantiates the claimant’s assertion that I owe the debt to the claimant, nor evidence of how the debt was accrued. 16.   As per CPR 1.4(2)(a) the court encourages parties to cooperate with each other in the conduct of proceedings in order to try and save time and costs for the parties and to also save the time and resources of the court however, despite vast attempts at mediation the claimants have been most unreasonable and have remained unwilling to mediate. I believe that the facts stated in this Witness Statement are true.  I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.
    • A set aside application costs £275 which is more than the judgement so not worth it. Not that they would grant a set aside anyway.  Set asides are granted, for example, to people who moved and didn't get the court papers, so have a genuine reason for not defending.  Forgetting doesn't count. Your only choices are to pay up within 30 days, or defy the court and not pay.  If the latter, we've never seen a PPC enforce judgement for a single ticket, ever, you would get away without paying - but you would have a CCJ and a knackered credit file for six years.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thank you LIP.. I'm ready for the long haul. I thought I was just dumb for constantly getting into trouble with my bank, having ended up every month without enough money left in to cover DD's and stay within overdraft limit as a result of the charges from the previous month. Been stuck in a viscious circle for so long that I just could't see any way out of it.

On a brighter note, I've just been given the 'all clear' to return to work, so it's a visit to the job centre on Monday morning for me wey hey! And to top it off the children and I have a new home to look forward to moving into as soon as it's ready. Finally I'll be able to breath again, and stop avoiding the post man! LOL... Not that I'd be avoiding him now with my Abbey claim now on the go! If anything I'm watching and waiting for him every morning :D

There are so many different stories on here of the effects that the over charges have had in different areas of peoples lives, people have lost their homes, businesses etc.. My message to them all "keep at it, don't let the buggers grind you down" there's always a little light at the end of the tunnel, you just need to read other threads (and mine:oops: ) to see that for yourselves.

Hi Suz, I am forty days into my claim against these Sharks. Have so far recieved the expected delaying tactics that we read about on this site. A good parachute would be the Barclays basic. You can pay in through work or cheques but only withdraw cash. I also had a problem opening a normal current account and these accepted me. It does mean that all D/Ds have to either be paid via some body elses account or the old fashioned way, over the counter. It is annoying but at least it means that I still have cash rolling into the house if Abbey plays fun and games with my overdraft.

Keep at them as I will and we will get OUR money back from them.

Seems everything is coming together all of a sudden, and all at once too! Not bothered how long it takes me to claw back my charges as long as I do eventually.. And as soon as it's cleared into an account I'll be using it to whisk myself and my 5 sons off somewhere nice and hot and hopefully it'll be back in my hands in time for christmas. Well a little wishful thinking never hurt anyone LOL :D

hi kia here weve just opened a parachute account with the natwest and had no problems opening it try them or the coop do another simililer account but if you dont want a debit card account there are quite a lot of ordinary accounts available.im only slightly ahead of you and they dont stop trying to fight you so keep fighting and remember theres alot of support out there for all us newies

Hi Peeps

 

Just to let you know keep up the good work I'm at the moment at the negotiating stage ( see thread "hello all")

 

Any way when I emabarked on this journey I asked about parachute accounts and some one suggested Natwest, and thats who I went with, it's called a step account and is basic. You get a card with the "solo" logo so can use it most stores. Needless to say I have had no problems, I also opened a savings account with it as well so take care of DD's and such so I transfer the money over for that each month so I know they are taken care off and I know then how much I have got for the rest of the month. But any way the step account is as I say basic but well worth investigating

hiya ive had some of the statements but not all of them so i wrote to them to demand the missing ones and got the statndard reply that everyone seems to be getting so now ive sent in an estimated first letter to ask for it back and another seven day timelimit letter will have to be sent exausting init!

Oh Dear Kia... It's not looking good at all is it? Ive still not had any of them. Ive got the last 6months and theres £720 in charges alone on those.. eager to get my hands on the rest so I can get things moving in the right direction at last... Hope you hear something soon too.

nope still nothing from the grabby ill probably proceed with the estimated one but its good to communicate with someone whos at the same stage as me because sometimes it feels like everyone else is so much further ahead and seems to know exactly what there doing unlike me whos just scrabbling in the dark trying to find my way

Well what do you know... I received two statements today for April and May 2005. Aprils was just a type out of transactions on Abbey headed paper with end of acc at bottom of page.. And Mays was a moments enquiry printed off a spool by contract staff / cashier 06?... no statements tho leading upto these two months and nothing for the earlier years either. Looks like they're going to stick to their stalling techniques and send them in dribs and drabs. And the style of statement has clearly been selected to cause as much confusion as possible in the hope that we all just drop the idea :-x. Sorry Abbey, no can do, I need it all back!!!!

Kia.. I know exactly what you mean... but having so many people that have got so much further than ourselves does help inspire us and we have so much to learn from their journey of threads too... but Lord do I wish I was as far up this track as them too LOL.. They all seem to know what they're doing now that they've dealt with the statements and worked out the amount owing on claim etc. I'm dreading having to work out all the figures and interest etc, it all sounds so confusing when you havn't had to deal with it yourself yet. But hey! I'm really looking forward to seeing the final figures owed in black and white ;)

hiya suz my statements what few came were like yours in dribs and drabs and all like a mixed up jigsaw puzzle it took me ages sorting them but they knew that when they sent them. They didnt all come at once either first ones within a few weeks the rest over next few weeks but there were missing ones that they thought i wouldnt notice.Well they were wrong i did my homework so double check anything they send dont just assume they play tricks the grabby GRRRRRR!!

I already had statements for April, May, June, July of this year... all they've sent me so far is print offs of April and May last year, they arrived yest morning :evil:... Talk about dragging their heals!.... Still, only 25 days left out of their 40 and counting!!! :lol: So they're only stalling the inevitable eh?

well ive had almost two years worth but its taken two of us to sort them out but finally got there and got letter printed and ready to send horray!!ps sorry if im bugging you its just nice to be at the same stage as someone else
