      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

need a few quick answers and know we are all watching the thread

the phone is ringing again third time in least than 10 mins from barry from

mbna just hung up.and again and again

first call starts hi can i speak to xxx its barry from mbna

asked if its to make a booking no can i take down the phone number and get her to ring back , no i said and put down the phone

will so far i have had 5 calls the number is witheld the last one i told him

i have sent an harassement letter and to xxx off

i am really losing it with them now can they withold the phone number ?

and who do i contact regarding this

hi

well thought it had gone quiet , sent harass letter along with cca 10days ago and somebody told me to send another one on thursday along with email, which i have done. Now i have had frank cassey on the phone again today

call went sounded like they were in a pub just asked for me by name

i said who is calling frank cassey so i hung up

rang back told him it was harrassment and wanted to know who he was speaking to so hung up.

then i have had 7 calls i let it go to answer machine all the numbers are witheld but i have checked our call planner and none were for work.

any ideas what i do next? please help

hi

its the same guy i have been getting for a couple of weeks, he tells me he does'nt have to ask me any sec quest since i am confirming who i am,

i sent standard letter along with cca and an email last week [email protected]

i can't remember who the letter went to i think it was a brian ? i got the details from a member here.

I am not going to let this drop now and want to know who i make another complaint to and to ofcom etc.

As i said its the same guy and he is a nasty bit of work, he knows all the tricks last week threatened to contact my boss.

Please help with all the info so i can make a complaint since i am not sure where to start

If he phones again, tell him right at the start you're recording this conversation and if he hasnt asked security questions ask him why he's not asking for any data protection security questions... see if he changes tact then.

i did this when he rang last week and his reply was since i had confirmed

i was xxx (by first name) he did'nt need to do any other checks

morning just an update still not had cca and today i got a statement

which shows late default sum £12

overlimit default sum £12

so do i assume the account is now in default my letter was sent yesterday stating account in default because of not sending cca

Almond notice how they have added two late fees to your account for one late payment this practice has to be unfair have u reported this to the rec bodies

well still no cca overdue by 3 weeks now had usual letters and have now got this email via works account (they have been told not to use it)

We have previously communicated with you and advised you of the implications of not resolving the issue on your account. You now have a limited amount of time to contact us to agree a mutually satisfactory arrangement. Failure to do so will result in a Default being registered on your credit file, and one of the many recovery actions that we have referred to.

 

Contact us immediately on 01244 677454, we will be available Monday to Thursday 8am to 9pm, Friday 8am to 5pm and Saturday 8am to 12pm.
