    • Yes, it was, but in practice we've found time after time that judges will not rule against PPCs solely on the lack of PP.  They should - but they don't.  We include illegal signage in WSs, but more as a tactic to show the PPC up as spvis rather than in the hope that the judge will act on that one point alone. But sue them for what?  They haven't really done much apart from sending you stupid letters. Breach of GDPR?  It could be argued they knew you had Supremacy of Contact but it's a a long shot. Trespass to your vehicle?  I know someone on the Parking Prankster blog did that but it's one case out of thousands. Surely best to defy them and put the onus on them to sue you.  Make them carry the risk.  And if they finally do - smash them. If you want, I suppose you could have a laugh at the MA's expense.  Tell them about the criminality they have endorsed and give them 24 hours to have your tickets cancelled and have the signs removed - otherwise you will contact the council to start enforcement for breach of planning permission.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Claiming back charges on two MBNA cards. Is the rate still 8% or can I charge more (bearing in mind that credit card rates are higher)? Can anyone advise the best way of calculating the interest. I had filled out a spreadsheet with the charge, number of days since charge and the 8% rate calculated. Don't want to miss out on screwing every penny out of them. Funny how when I was late with payments they've phoned me in Athens, Budapest, Milan and Antalya despite me telling them I'm away and on a mobile but now I'm asking for money off them - not a peep!

right then surreymanc ! I fee like an adopted manc when i go to see oasis in concert !

 

Anyway, You can't really use the rate that mbna do as you will come out with a completely different figure than them. They will obviously add interest month on month from when the charge was added but it won't tally up with what you have.

 

By all means give it a go and possibly argue the point if their figure is less than yours, all i am saying is that i tried that and my figure was a lot less then theirs

The 8% is what you add on when you make a court claim - don't get it mixed up with the interest charged on your fines!!!

The interest rate is the rate you were charged on the account - that is if they charge you 1.5% per month (18%pa) then that is what you claim. So a charge of £20 put on your account 100 days ago would be £20 x 0.0493% (daily rate) x 100 days. You need to do this for each charge - excel spread sheet will work it for you quickly.

 

The 8% comes later if it goes to court and you get a judgement.

Mark, i see how your calculation works which is fine, but the only thing i would say is that your calculation adds the charge at 0.0493% based on £20 from the date of the charge. However, after month one (when they recalculate the interest again) you would lose out ever so slightly on the interest. I mean based on £20 we are literally talking a couple of pence but over time and with some charges being in the thousands we are talking a fair few quid.

 

Although well done for passing on the formula anyway, no way could i have come up with that !

I wrote a spread sheet designed to calculated all this automaticly. It is reasonabley user friendly if you understand the basics of spread sheets. It works by calculating the number of days from the dtae of the charge to the current date. Then it applies the interest rate which you get from your statements (because they change from time to time) and manually insert them. It does not charge interest on interest but I was happy with the result I got and not prepared to go deeper into the calculation. PM your email address and I will send a copy to you.

Unfortunately I haven't got my statements - they sent me a list of charges instead so I've got no way of referrng to them. Plus the fact that amazingly they have become silent - there is no way I'm ringing them with their ability to twist everything round. I rang them months ago to take out a loan - had too as I had two cards of theirs and no-one else would give me a loan. They gave me a loan then changed the interest rate to suit them from what they told me on the phone when they initially agreed it as they knew I was desperate. They then reduced the credit limit on both cards to £500, even though I told them to close one (I only wanted one card with a reasonable credit limit). When I rang to complain they told me that they followed my instructions to the letter and that the transcript of the conversation was on the computer in front of them. Absolute B@**o%ks!!

Roydosan - you've lost me? Charge them interest on the charges plus 8% on top of that? Surely I claim back the charges but instead of claiming back at 8%pa (as I did with the Halifax) I claim back at approx 1.8% per month (21.6% pa)? HELP!!

 

Well, despite me emailing Gareth Tunnicliffe giving them the option of settling this out of court they have 24 hours left before I get onto Moneyclaim.
