      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Suppose, I'm done now really - just waiting on Lloyds then that will be it for bank charges.

 

I need to tackle my defaults now though, but it's new teritory and the knowledgable SurlyBonds seems to have disappeared! :-/

Hello, did't think I would be posting to this thread again but I sent a secure message a few days ago to smile, confirmring that the claim was withdrawn form thcourt when they refunded charges (a few weeks ago) - got a letter today saying they want me to close my accounts due to my continuous requests for refund of chargs -Ive only climed once!!

 

I think it is because I sent a few secure messages (which are above in this post) and the manager didnt like it.

 

Does this seem like retaliatory action? What do I do? I like banking with smile, hav not been charged for over a year and ahev run my account impeccably - if they close my accounts, I will be left without a deit card and cheque book becasue i have 2 defaults whichwereput on my file unlawfuly (im trying to get those removed anhywho, but thats a different story!)

 

I feel sick now i have got that letter - i really do think it's retaliatory action and they have only said it because the manager (who actually sent me the letter) didn't like me messaging her - damn it, what do i do?!!

Do they actually say they wany you to close your accounts, not that they will? and also have they put in writing that its bacause you reclaimed charges, not found other excuses, I would say to the first one, don't do it and see if they close it for you, they may be trying to avoid getting in bad books here, and secondly, if they says its coz you reclaimed charges, its definitely retalitory action and put a complaint in!!!! (take it you know their complaints procedure!!!)

 

Their 14 days after LBA is up Monday, was going to give them a little more time but i've just reread your whole thread and changed my mind!

With reference to your recent requests for continuous refunds of charges that have been applied to your account xxx xxxxx for exceeding the authorised overdraft limit.

 

In such circumstances, the Bank must take the view taht it can no longer maintain its buisness relationship with you and I should be grateful, therefore, if you would now accept this letter as formal notice to close your accounts within 30 days of the date of this letter. Please, therefore advise smile of your instructions to close/transfer your accounts befre 9th december 2006. In the absence of any instructions from you, any credit balnces held in your anme after this date ill be remitted to you by cheque and your accounts will be closed in the Bank's recoreds.

 

PLease be advised that the decision to close your accounts was not taken lightly and only after careful consideration. However, in the circumstances, I believe that it is to the benefit of all parties concerned that you now establish a relationship with an alternative bank.

No, I sent a few secure messages to an manager called Jane and it s a "customer service anager" called jane that has written this letter.

 

The thing that annoys me here is that I have not been chaged for over a year and only claimed once. When I was a thousand pound over an agreed overdraft for about 4 months because I was afraid to call them, they didn't tell me they wanted me to close my accounts (I would have accepted it that sort of circumstance.) This is complete and utter retaliatory action, but I guess the FSA and Ombudsman won't do anything about it.

 

I had some ther charges refunded a while ago, but thats because I worked a company withi their group and the comapny paid me wrong - y manager arraged for them to refund the charges due to it.....however, i am sure that annot be counted.

 

I feel physically sick over this you know - I thought we have actually had a vey good relationship and like I say, my financial situation has improved greatly.

Well I wouldn't just let it drop, whether you think they'll do anything or not its got to be worth a couple of letters to the FSA and bankiing ombudsman, you could try opening an account with the co-op for a laugh!

I do have a co-op acocount, and a co-op credit card!!!

 

It is purely retaliatory action so i will call and write to the bodies you mention above.

Hi Un1boy, Please could I ask you advice. I too have a Cooperative account and I have recieved my statements with all the charges on. But now I am stuck and scared. I am unsure of how to calculate the interest. I have looked at loads of different spread sheets and I am even more confused.

Please could you tell me if and how you calcualted interest. Then I can move forward with my claim.

hello janeylooloo, my claim is not against co-op but have gone through a claim with another bank, I would try going back to the FAQs section and look at the Step-by-Step sticky, following each step it will take you to links for the spreadsheet that best suits your circumstances. I think Vampiress has provided spreadsheets (thank you) for all scenarios. good luck.

Hiya....u just need to use the simpe or advanced spreadsheet - if you're not sure then just use the Simple one...I get confused with the advanced one, bu tif you can get your head around it you can claim A LOT more money through contractural interest (I don't know anything about this, I've read the thread on it and still confused, lol!!) so I have kept with the simple spread sheets.

 

You just enter each charge, its description and its date in the spreadsheet and then the spreadsheet does all the work for you!! :)

It's a good job you have a parachute account. It's always a safe move to do before commencing court action.

 

The bank are legally entitled to close your account if they feel the business relationship has ended. They don't want the custom of someone who wants to sue them. Would you trade with someone who sued you?

 

They gave you proper notice, so you'd best transfer your DDs SOs etc.

 

It doesn't happen to all, but unfortunately it's happened to you. I seem to remember a tv programme where A&L stated they would close accounts of anyone suing them for bank charges.

 

Oh, and don't forget to take out any balance left that's in the account before they close it!! Lol.

I know, it's the principle that annoys me though - none of my customers would sure me though, because I wouldn't act unlawfully!!

 

They's shot themselves in the foot actaully - I'm ready to get a mortgage and other investment products with them. Plus some of my friends and family whom have moved to them because I recommended them have changed bacnks. so much for being ehical, eh?

 

My biggest problem with this is that I have an overdrfat with them of 600.00 and no one else will giv me one because I have 2 unlwaful defaults which will be removed asap as soon as i get the £150 together to tke them to court over it.

 

Smile will want me this paid within 30 days, whicih I cant really do.

Not really, but until i get the 2 unlawful defaults off my file I cant get another overdraft you see......and all i need is £600.00 to cover the Smile one!!!

 

then I was going to move anyway, and send a letter top David Anderson (CEO of CFS who own CIS, Smile and Co-Op bank) to let him know they've lost LOADS of money from me just because of this...
