Self   Date of issue – top right hand corner of the claim form – this in order to establish the time line you need to adhere to./   14/02/2020   ^^^^^ NOTE : WHEN CALCULATING THE TIMELINE - PLEASE REMEMBER THAT THE DATE ON THE CLAIMFORM IS ONE IN THE COUNT [example: Issue date 01.03.2014 + 19 days (5 days for service + 14 days to acknowledge) = 19.03.2014 + 14 days to submit defence = 02.04.2014] = 33 days in total Not relevant as his claim was set aside, and has now been brought to the court again by the claimant       Particulars of Claim   What is the claim for – the reason they have issued the claim? Please see bundle of documents in previous thread   What is the total value of the claim? £10,734.1    Have you received prior notice of a claim being issued pursuant to paragraph 3 of the PAPDC (Pre Action Protocol) ? I don't remember - but again a copy of a letter has been provided (see bundle on previous thread)   Have you been receiving statutory notices headed “Notice of Sums in Arrears”  or " Notice of Arrears "– at least once a year ?  No    Why did you cease payments?  2015   What was the date of your last payment? December 2015   Was there a dispute with the original creditor that remains unresolved?  I wrote to Barclaycard back in 2015 to ask them to send proof of the original agreement but they just sent me a reconstituted document which had no personal deals on relating to me   Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? yes - step change took control and set up payments of £1 pm
    • I have had no such luck getting the tickets cancelled. So more help would be greatly appreciated. I have debt recovery letters now. I guess I ignore these and only respond when there is court proceedings?
    • On MCOL there are 2 times the case stay is lifted. Once between filing the defence and them submitting a DQ, and then again between them submitting the DQ and the court issuing one to the defendant.   Is that normal or is there anything I should be aware of?   Thanks as always
    • It's difficult to advise what to do because there are so many ifs and buts. In the majority of cases where a PPC start a court claim they go all the way to the final hearing. However, in a minority of cases, and by no means a tiny minority, they have no real intention of going all the way to a final hearing. They know their case is rubbish and they know it will cost them a hefty wad to send a solicitor to court (remember solicitors' costs are capped at £50 at small claims).  They pretend they are going all the way to court to intimidate the motorist into giving in.  Yes, the pretence often includes paying the hearing fee.  Yes, UKPC often do this.  And no, they haven't produced a WS (so far). I suppose it depends on how much you have spent on flights (and accommodation?) and if this is refundable v the approx £250 at stake if you lose the case.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have applied for my statements from NatWest Bank Plc. They have banked the £10 cheque but are now 11 days over the 40 day limit and i still have no statements despite various chasing letters/faxes.

i have now prepared an Application to the court for pre-action disclosure however i am unsure if this is possible or enforceable as i was under the impression that some kind of protocol had to be in place before an Application could be issued.

without any statements i cannot guess how much my claim is worth. i would be grateful for any help you can offer.

I am about to start a claim against Natwest.

Where did you get the address to request of charges details?

the information commissioner did nothing for me. i eventually issued an application for pre-action disclosure at the court and natwest took that very seriously. i am not allowed to divulge the result to 3rd parties but my claim is over and i'm buying a new car. ;)

i didnt issue for non-compliance. i filled a N244 (Application Notice).

if you want the wording that i used, then i can e-mail or fax a copy of it to you along with a template of my statement and the relevant order i requested.

it was prepared by one of the solicitors i work with and worked a treat! think it took 2 days for statements to arrive.

the thing is you should give two weeks' notice before issuing against them so write a letter today and then you'll have two weeks to prepare the paperwork. it's not that difficult.

I think you might have misunderstood my post. I was saying that I got the address to send the SAR from the link on the SAR letter template page, which is a link to the information commission website. It gives you the address which is registered for data storage by your bank. Would seem to be the most correct address to use.

Still no sign of my statements so sending an lba today. Melanie, I note you say 14 days when the information on here suggests 7 days. Is that because you used a different court procedure with the N244?

hi melanie

sorry i misunderstood.. obviously you feel the application for pre action disclosure is a better way than the n1 form for non compliance.. thing is i dont really understand the legalities of this.. sorry to be so dumb.. id be very grateful for your help.. could i pm you my email address and you could send me the relevent info.. although i have sent them a letter before action regarding their non compliace giving them a further 7 days to come up with the goods.. needless to say they havent!! can i now proceed the way you did..(given the fact that ive already threatened them with court action and not carried it through!) think perhaps you should have your own template section!!

thanks karen

Questions such as these are much better asked in the relevant forum for your bank as they can be answered by people who have already experienced the situations.

This forum is designed mainly for people to introduce themselves and get started on the very first steps and as such experienced users rarely venture into here.

BEFORE starting your claim read through the FAQ's and if there's something you aren't sure of then ask.
