      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just a quick note, has everyone subbed to this thread seen Optima's Latest witness statement Re: Para 8 in my thread.

Would your solicitor be interested in reading my thread ? as it is up for trial on the 3rd march 09.

 

I am still working on my witness statement in response to theres soon as i get it done ill post it up.

 

There response to my witness statement was to submit to the court a 3 page set of T&C's which are the latest ones and not the ones relating to my card account i will be asking why these where not submitted at the summary judgment which they have now dropped.

Underdog you can get me onboard with that solicitor and tell him mine is up for court on the 3 rd march will be very interesting to see how this pans out

 

Also tell him that the summary judgment they tried to force though they dropped ( treading on thin ice i think so)

 

Also tell him about the abuse of process that am now seeing a lot of as in my case CPR 18 sent July 18th 08 got response December 30th just before summary judgment.

my falls flat because in the default notice they sent to me it is based on clause 8 but when you look at the agreement there is no clause 8.

 

Also the agreement if you call it that there is no tick or signature for the ppi and i know i did request the ppi i can even produce statements to prove ppi was paid each month.

 

so yes you could be right.

Another ploy MBNA are coming up with (along with LLoyds) are claiming that the card mailer your credit card is attached to is the executed agreement and the document we sign is just an application form and doesn't count as an executed agreement. WTF??? I guess they need to buy a dictionary and look up the meaning of 'executed' - assuming they can read:rolleyes: That's why they refer to clause/chapter/section/whatever 8 in the DNs - it's on your card mailer folk! Can you believe it?

 

Yup and Optima Legal are using that in their witness statement in my case

I sent a CPR PART 18 request to MBNA via Optima Legal on the 16th July 2008 got a letter from Optima Legal on the 30th July headed WITHOUT PREJUDICE saying that the request has been forwarded to MBNA for them to action got the requested docs on the 30th December 2008 some two weeks before summary judgement.

 

A law unto themselves.

Hiya Underdog,

 

Nice to see you got some movement on this regarding a solicitor, seems to me that solicitors have not got the -alls to take on a big financial institution

 

I tried getting one yesterday without luck even though my case is now pretty solid regarding the fraudulent DN.

 

im gona be sending a few letters and try and find out why solicitors are not willing to enforce the cca 1974 for consumers.

 

I think its also a good idea to start a GLO on MBNA too as they are the biggest credit card provider buying up all the books from other providers and not insuring in that process that they have all relevant documents.

 

There must be many thousands of people in the uk that will now find themselves in financial difficulties and then find that they have a battle on there hands regarding lack of documentation.

 

MBNA,s fraudulent activity's are widespread i believe.

 

The fact that MBNA call sidestep all Protocols, CPR, CCA etc and railroad a claim to get a CCJ really gets me.

Well I've come a long way in the last 15 mths regarding MBNA ad its been an eye opener regarding what they are capable off.

 

My case should be coming to an end soon but as I say ill still be around to help others the best I can AND FIGHT THEM WITH A BIGGER STICK.

Re post 356 im very much up for this, but i think because of the scale of this its time for DIRECT ACTION we need to get this covered in the press as much as possible and then hope they will be investigated.

 

To that end i think we should gather as much evidence as possible so every one with suspect agreements or default notices post them up removing personal information of course them one of us print them off add a page detailing where they fail put them in a binder.

 

Then we we need to hit fleet street yup in person and get noticed. while we are there we could also give copies to the regulatory bodies.

 

Because MBNA have brought so many credit card companies they will be the biggest loser :D because a lot of what they have brought does not conform to cca 1974 and or CPR

 

I also think they will be interested in my bundle because of the fraudulent DN.

yes atwozee it sure is it needs direct action so ppl dont have to go though what i have its also an abuse of court powers putting claims though the system that have no cause being there in the first place PF
