    • Visiting scotland I came across a car park at The Falls of Shin operated by Civil Enforcement Limited. The car park requires visitors to pay using the awful Phone and Pay app or over the phone using an eqully terrible automated service. Their signs state a time limit of 10 minutes after arriving to pay, and both methods require needlessly lengthy registration process only for payment to be rejected when attempting to pay by both. The Cafe were able to offer us some assistance and register our vehicle so hopefully we sould avoid a fine but this seems like entrapment and would still stop us returning again. How is this legal without giving visitors the option to pay on site?

    • There are two things to immediately clarify. Firstly, why did court papers go to the wrong address?  In 99% of backdoor CCJ cases here the person moves and doesn't update the vehicle log book address.  Or they move and they don't inform the parties who they are in legal dispute with of the new address.  Does either of these apply to you? Secondly, given this has been going on for over three years without presumably any ill effects on you, how important is it for you to have a clean credit file?  I ask as, if you do absolutely nothing, the CCJ will disappear in April 2027.
    • Sorry to ask, but I know I had SB template on PC, but can't find it. Also any search for template\SB letter takes me back here.  Any help to get to SB letter would be appreciated. I know I used it on a car HP co that wouldn't honor my FCS refund and after 6 years came threatening ( or rather their DCA). Worked a treat. Thanks in advance

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My neighbour has just popped round, 4 letters this morning with my name and address on have been delivered by accident to her address by the postman,

very strange as i cant ever recall that happening before , and i received mail myself this morning (maybe someone has got it in for me):-?

Anyway fortunately my neighbour is a lovely lady, shes only just got in from work so only just dropped em off, thankfully all still sealed,

 

Anyway, one is my cca request to the halifax over an unsecured loan, i wasnt exactly sure of the date i took it out,knew it was early mid 2007 but now its confirmed its dated may 2007, wont post the exact date in case they trace this post back to me, but its towards the end of may,

Its a photocopy and not crystal clear but is readable, and the signature and date appear to be my writing, so no complaints there.

 

Now am i right in thinking any credit agreement after april 2007 doesnt come under the same regulations?do they have some of their own?

 

on the front of the form in bottom right hand corner is ref Lsplf01 dec 2005

and on the back of agreement in bottom right hand corner is a different ref number lsplbk1 dec 05

and on the top of the back page right in the middle in a black header is personal loan conditions 2005

 

I remember signing this agreement at home, went through all the details over the phone with an halifax representative and then they sent a courier with it the next day for me to sign while he waited outside , the money was then put in my bank , cant remember if it was the same day or the day after,

and this is confirmed in the agreement just a bit below my signature where it says

"you have seperately agreeed that this agreement be delivered by courier service,

you agree to pay the fee of £50 for that service which will be payable two months after the date on which the loan is made"

 

Now this is the last credit agreement ive taken out, all the others are much earlier than 2007, so this is the one i always thought was going to be watertight, funnily enough one of the other halifax debts i cca"d they sent the postal order back saying they couldnt accept it as the payee details were incorrect , funnily enough this one was sent the very same day, with exactly the same type of £1 unsigned postal order and they have had no problems supplying me with a cca and accepting the postal order on this account

 

wouldnt be playing silly sods would they:mad:

I don't know what kind of help you are looking for. The Terms and Conditions are likely to be those post 2004, which is when they changed. Without seeing the agreement it is impossible to comment but you seem satisfied that it is enforceable. As for payee details on the Postal order not being correct, you don't say what was on it. I think you should check the Postal Order and since the agreement on the other account is 2007, it's more likely to be enforceable than an older one.

i was just trying to get confirmation if agreements taken out after april 2007 had any terms and conditions of their own which i needed to double check were there or if the agreement was still correctly produced as i was under the impression that agreements after april 2007 did not have to abide by the same rules as those pre april 2007?

 

i will post the agreement up later , it wont be crystal clear as my copy is poor but readable, so not sure how it will scan.

 

the postal order relates to another cca, i posted pics of it on another thread, i was just basically comparing how the same company was happy to cash one postal order and send me the cca as its quiet a recent credit agreement ie may 2007 , and the other one which relates to a much older agreement they wouldnt accept the postal order for even though it was sent at the same time as the one they happily accepted for the 2007 cca,i just thought that was a little suspicious in itself,

2 identical postal orders, 2 cca"s requested from the same organisation,to the same address and 1 gets processed and one doesnt:?
