      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

think i have some good news

had a claim in with abbey since june last year for 6000 worth of charges

also FOS involved as claim was a hardship one

got know where and was told it will remain on hold until after testcase

ithought i was agenuine hardship case mortgage arrears,council tax arrears,unsrecured debts etc

anyway rung abbey again last week and mentioned the recent hardship clarification and was told someone was looking again at my claim and would contact me shortly (yea yea heard it all before)

then on friday a call from nice lady at abbey who listened sympatheticly and told me to return the income/expenditure form she would send and any evidence i had of my hardship

forms on doormat next day thursday

returned with evidence friday

calltoday 4.00pm same lady said she had been though forms agrees im in genuine hardship needs to speak to her manager but told me she was almost certain would be reembursed enough to cover all arrears including unsercured debt

my heads in a spin is this to good to be true sitting by my phone now as i type this fingers crossed

I have just put in a hardship claim to the abbey. My mortgage company have applied for an eviction warrant so it is pretty urgent now and the claim is over £8000. I sent in a letter and copies of solicitiors letters but have been unable to find a direct contact number. Who did you speak to? Would you mind passing on the number? The one I have for Triton square just has a no one available message!!!

I will keep my fingers crossd for you too!

Thanks for coming back to me. Unbelievable that they rang you!! Spent all morning on the phone to the complaints department who have finally said that someone from legal will have to call me back. You mentioned the FOS. Would you mind telling me how you got them involved. Did you write or fax and is there a specific department or address?

FOS involved since last june

but in end got fobbed of they said all abbey had to do was try and help my situation not refund me

but i rung them again after i rung abbey and it seems they had already started looking at my case again after the hardship clarification

lady from abbey also said she had spoken to FOS about my claim

postman due at 11.30 but i think i will get a call first

Hi,

Finally got hold of someone in Abbey legal department. No record of the correspondence I had sent in!! Faxed it all over to him. He rang me back to confirm receipt and said would come back to me as soon as he had a decision, hopefully before the end of the week!

I hope you get yours through soon as it made me think there may be hope after all. When they tried to fob me off with a small refund 18 months ago they just put it straight into my account and I didn't get a letter until a couple of days later. You may be presently surprised if you keep an eye on your account.

He asked for it to be explained that all non court claims are classed as complaints and should be sent to the above address. He can not help, as all he is doing is redirecting the emails, so it won't make your claim happen any faster. All his department deals with is claims going through the courts.

I received a call on Friday from Abbey's legal dept regarding my hardship, they are putting 65% of my claim into my account next week.

Please may I ask roughly the grounds of your hardship case? I am just trying to get a handle on what they take seriously. My repossession warrant doesn't seem to push them into action quickly! How long did they take to deal with yours?

The FOS told me this morning that the Abbey have 8 weeks to respond to the hardship claim and it doesn't matter that it was an existing matter before that. The FOS will write to them but that will probably get filed under 'when we get round to it' also!!!

How long did they take to deal with yours? Suspended possession order, husband had two emergency eye ops last year culminating in lost pay causing us to have serious mortgage arrears. I supplied court evidences and mortage statements etc. My claim took just under 4 weeks.

When did you send you claim in, did you send it with all the documentation ie Income and Expenditure, Updated spreadie of your charges and interest, evidences supporting your harship and of course a letter laying out why you feel you are a hardship case. It is also importnat that you document everything really well, I numbered the pages to match with the para numbers in the letter to make it easy for them. I also put my court claim number as case had been stayed and my Abbey account number.

Ronan told me that once they have all the documentation together they send it to a special department which has recently been set up to deal with the 1000's of claims for a decision to be made. Mine must have been packaged well as Ronan was true to his word he said he would call me on Friday and he did with the offer and to say that Abbey had recognised that I was a genuine hardship case.Others I know who sent theirs off the same time as mine and packaged the same way have not yet heard but are expecting to hear any day.

If you have sent everything and covered all aspects which I have recomended and you have not heard I would in your circumstances contact the CEO of Abbey and ask them to chase it for you as time is of the essence. I know someone who did this because of a pending repssession through First Direct and they chased it for him and paid pretty quickly to help his situation.

I like the CEO idea. Will be ringing Toby (abbey Legal) again later this afternoon. If still stalling I think I will try that idea. Thanks for telling me your situation it is encouraging as it is actually very similar to ours, although in our case the mortgages companies patience has run out with regard to what we have been able to pay against the suspended order.

I am never normally lucky, but pleased that I was lucky on this occassion, it was a life saver for us. The whole amount would have been better but hey 65% is better than nout.

 

I am keeping my fingers crossed for you that all will come good. Sounds like you are on the right track. I am helping anyone in this situation that has a hardship case because I have done it and it worked for me.

Firstly congratulations, I am really delighted for you.

 

I did ask Ronan from Abbey Legal Dept when he phoned me last Friday but he said that was the max and it was not going to prejudice the rest of my claim after the OFT Test case if it goes our way. There were no strings attached either so I felt I should take it as the money would be very usefull to ensure that our property is not repossessed.

Hi. My claim was stayed too. How do I start to make a vlaim to get the stay lifted due to financial hardship. What eveedence to I need to support this and where or whom to I write. is it the court I should I go direct to abbey.

1.Income and expenditure sheet.

 

2.Documentary evidences ie court summon's, statement from your rent/mortgage company showing that you are in arrears, council tax, electricty and gas arrears etc....as much evidences as you can to substatiate your claim.

 

3.Include in your letter why you believe you should be considered a hardship case ie in my case my hubby had a couple of emergency operations and we fell into serious arrears leading to a suspended possession order and behind with paying household bills. You have to spell out exactly why you feel that you have good grounds under the present FSA waiver rules on hardship.

 

4.An up to date spreadie of charges and interest.
