    • I am heading over to hers tomorrow so I will find out.  Will there be something written in the agreement or does it depend on the agreement its self ? Just so I know what to look for, so I can provide as much information as possible on here. 
    • The answer to this is going to depend on what the agreement your friend signed says. Or contact the housing provider and ask them.  
    • Thank you all for the responses, to answers a few questions  - she has had the car since Jan 23 on a 5 year term.  - She is unsure what the agreement is called, but at the end she has the option to make a payment to "buy" the car - she recieves benefits for her young children alongside the ssp (normally she would be on NLW for a 16 hr a week job)  - Yes she would like to keep the car  She has not responded to the last email from them asking her to call and it'll be followed up in an email. I told her to hold off until atleast Wednesday so I can read a few posts on here and get some more information.  I will ensure she follows up with a letter, that has not been signed but instead her name written.   Thank you

    • Hello, *posting on behalf of my friend, I'll provide as much info as possible*  During a pretty low point my friend moved into a social housing property, it was in a area with no family/friend connections so she started to look for a mutual exchange. She found one, signed the paper work and thought everything was okay.  She has now decided she does not want to go through with the mutual exchange. Is she legally allowed to pull out after signing the paperwork or does she have to commit to the move? Thank you,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

Sent LBA recorded delivery 10th July to Bank of Scotland requesting refund of first lot of charges. Received reply 12th July from a Gavin Daschofsky informing that the OFT decision relates to consumers and not business accounts like mine. Therefore no refund will be made. Blah blah blah.

 

Should I wait unitl the 14 day offer to refund expires before submitting claim papers to sheriff or get them in asap?

 

Any help greatly appreciated.

Is this your 2nd letter to them?

 

You've got to give them 2 letters, each giving 14 days notice for the system to work!

 

If this was your 2nd letter, then I'd still be inclinded to wait the full 14 days, as this adds weight to your arguement that you have acted reasonably should it reach Court.

Thanks for the reply. I sent in an initial letter approx 3 weeks ago to them requesting statements enclosing the £ 10 payment for Data Protection thingy. No word back yet regarding this.

 

Since then I have located the past 2 1/2 years statements and the 2nd letter to them requested a refund of the charges incurred in this period. This was sent 10th July. Reply received 12th July.

 

I do have the other statements but will have to look them out and I may be missing some, hence the initial request for list of charges and/or copy statements.

 

What would you advise next?

How does the law and the claiming of these unfair bank charges stand in relation to a small buisness customer and a "consumer" customer? Is it true that small business customers are not copvered by the OFT decision? Can someone please reply to this message and posting by Lukester147.

Different laws apply to businesses, as a lot of the law referred to is consumer law. Don't worry you can still claim your charges back but you need to read through the FAQs looking at details for making a claim if you are a business, and also browse round the forum to see what else you can find.

Received letter from HBOS with my account number and sort could in the frst line of their letter. This was provided in my initial Data Protection letter.

Letter asked if I could supply HBOS with my sort code and account number, type of account, roll number and whether the account was active!!! Are they taking the ****? Simply returned their letter with colourful arrows to the `missing info` and await the info.

Having instigated a claim for myself against BOS I am now undertaking the same for my partner`s account with BOS. A quick call to the customer services I found out that they shall provide all copy statements for a one off fee of £ 5-00. They shall be delivered within 10 days. This does away with the DPA letter and the need for the possible 40 day wait.

Yes I know that but the banks have given up on this line of defence according to some other threads. Why wait forty days when you can get the ball rolling quicker. The five pound is neither here nor there.

40 Days is a long time to wait - I just hope it doesn't come back to bite you in the a$$! There are a few short cuts but it's sloppy and the bank may well pick up on this. Where abouts in Scotland are you?

Me too. If it does I can always start again. I`ll still stick to the 14 days between letters.

 

In my own case the bank sent me a letter stating that they are not obliged to record manual intervention under the Data Protection Act and therefore do not have to supply me with this. Therefore I see no reason to wait 40 days only to be told the same thing.

I didn't even get that! Just a big wad of statements in a thick brown envelope. No covering letter and no information re: manual intervention. They delivered on the 6th day though, well within the 40 day limit. I'm in Aberdeen claiming £1,990 + interest Vs RBOS Current Account at the moment. I'll be doing RBOS CC, EGG CC, Lloyds CC and Capital One CC next!

Say I want a copy of a cheque which has been cashed agains my account, BOS will charge me to supply said copy. Does anyone know if I can I request a copy of all cheques cashed against my account and only pay £ 10 fee as per SAR request.
