      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Last 10 minutes of it - anyone know if it gets repeated - oooh what we gonna do now - only leaves Morrisons and i gotta be on me minutes before I go in there!!!! AWW well gets on internet to find out if there are any farms going cheap so can be self sufficient - the good life here we come lol

well i received a confirmation letter today and faxed it signed over at 1pm so will need to wait and see when the money is put in, how did they have your email address, did you give it to them, i dont remember ever giving it to them.

HAPPY SPENDING, IF I GET MY MONEY TONIGHT I WILL TREAT THE KIDS TO A SHOPPING TRIP TOMORROW AFTER SCHOOL.

And maybe a meal out

They got my email address from the original email I sent to Krysta - keep us informed hun - i reckon it will be in this afternoon - my balance is rapidly going down LOL - payin me bills upfront so don't have to worry about them for a year i.e. council tax etc. Saddo I am LOL

Actually maybe your the sensible one and we are the stupid ones. Oh well lets hope i get my money today or tomorrow, the waiting now is terrible, this seems to be the worse time, i am also becoming desperate just to see the money in my account to know it is all over

Hi Caz - yes I will treat myself just wanted to get them out of the way. Hubby has taken early retirement on an old pension so waiting on that coming through which should be in very soon - thats when I start partying LOL!!!! Next week I hope.

Half of mine went on holiday, half went on bills.

 

I emailed my settlement letter so thats how they got my email address

 

It took them 3 hours to get the money in my account, so keep checking about 4pm

Stage 2

Sent off to court my application for costs this morning

As my court had 2 block sessions for cases it may want to make the bank pay for wasting their time.

Ok Paul, I still have no money, sent a reminder email last night, asking if there was any reason why! I may phone soon if it is not in.So you have lost me now, what costs surley you got your court costs back when you settled!Caz

Hi Caz,

I would gve it till about lunch then send her a polite email asking if she can let you know when you can expect the money to be transfered so you can inform the court.

 

As to costs:

Time for preparing documents

Reading there responses

producing court documents

costs for paper, ink, stamps etc

A few people are starting get costs now as the courts are getting more and more fed up of the banks,

 

Theres a thread about quoteing a Judge stating that he will start to award costss and compensation.

Hi,

Barclays sent me a letter with an offer I answer that i did not accept it. No answer yet. What shall I do now? Still wait or contact money claim?

Ok I emailed Kate to see if they knew about this and if they arwe attending and this is the reply

 

Thank you for your email, we were not aware that we had a hearing so I have contacted the court to get them to send us over a copy of the order as we have not received it. We will be sending a barrister to defend this hearing on behalf of the court.
