      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes, i had a nice call from them the other night 8.50pm, very abrupt person on the other end of the line. I think i upset her, as she said my £1 Token payment was not anough and could i up the payment.

I said i could and offered her £1.01. With that she put the phone down, and would phone back.

Hope your well, Its looks like you must of really upset MBNA for them to send you nasty letter asking for Money Tut Tut what are they playing at.

You want to think yourself lucky you received mail from them, I've not even received my monthly statement of them :mad:. So i can't pay my £1 token payment :D. So Sunflower don't worry about the threats or the letters that come through just keep paying your Token payment.

Yes, i was going to increase my payments this month to £1.01.

But i think they where one step in front of me, and never sent my statements through i'm very angry at this :mad::mad::mad:.

But i'm getting better as Frank Spencer once said ( In every way and every day, i'm getting better and better).

Yes, don't get stressed i used to get stressed over these but not anymore. Yes for MBNA/Abbey not sending me my statements for September is not good :mad:. If there running out of funds, as most banks are at the moment. I'll supply the paper for them, so i can get my statements:D. Don't get upset on the RMA, they can't do anything at the end of the day. Because if your account has gone to the RMA, your account would of allready been defaulted. So weather you pay a £1, £2, £10 or even £50 off the account each month. Your default is still going to be on your records for 6 Years. So tell them to go away and just pay them what you can afford. Then if your finances change then your pay them a little more. Just like i did i was paying them a £1, my finances changed i now can afford £1.01 :D. Thats when i can get my statements though from them.

So keep your chin up.

See Sunflower99 there not treating you bad:(.

They told me to cut up my card and return it to them :confused:.

That was just for missing one payment, i can't see where i went wrong:confused:.

I mean i pay them there token payments, what else do they want from me:mad:. As i haven't received my last months statements, i will have to send them a IOU, i hope they don't get shirty over that.

I tried cutting mine up, but the scissors i used where blunt:eek:.

So i ended up sticking mine in the microwave, it looked pretty impresive when it came out:eek:. So i've got no cards now:eek: No Statements:eek:.

I'm in a right state :confused:;).

Well you i think very lucky in receiving anything from Capital 1.

Just to let you know exterminated me today, sorry meant terminated me:eek:. Did arf hert as well:eek::eek:.

I've heard before on hear that capital 1 are like that, with there paperwork:mad:.

I would send them a letter, as i've been told on here and say that are they going to use that paperwork in Court when they go. If so you will be isueing section 31.14 for inspection.

That's what i've been told, the road to go down, but there's more brainier people than me who can tell you how to go about this which will be along here.

Ok, i own up i have a lloyds one as well:D. But i've got nothing on that one. I only had a letter from Lloyds the other day, saying as i was not using there card they would be downsizing my limit to £1000.

Know this is no good to me as i can't rack up big totals on this card:eek:.

Don't worry about Capital 1 they can be sorted, funny i been getting phone calls from Capital 1 on my mobile. There using an 0800 number so look out for them. I don't know if this is a record but i had a phone call last night at 11.50 pm, never answered it but found out it was AOL phoning. Don't these people ever sleep:mad:.

Well, after they exterminated me yesterday, i received two letters today.

One telling me i've been very naughty:eek: slap on wrist.

Now i ask you me being naughty never:eek::eek:.

The other letter was that the have passed my Dept over to Debites i think.

I've put them up on my thread.

Well, i think i'm upto 4 Defaults at the moment so i'm ahead of you:D.

Don't worry to much about this, now on your default have they included and charges to the default. As i've been told if they have then its not valid:eek:.

Ok, Just received my mail from MBNA.

Another threatagram i'm affraid :eek:.

They told me that they tried to contact me by phone, well i could of told them that as i've blocked there number :D:D.

They also told me i have failed in responding to there corispondance, lies, lies, lies :eek:.

They've also have stated that the MAY take me to Court. :eek:

If they every do take you to Court and i stress IF...............

Ask them if they will be supplying transport to the Court, as you have quite a few Members of the MBNA club that want to come along to the hearing :D:D.

Yes, come to mention it there's no over the limit or late charges on mine either. Unless its in the printing that i can't read for being to small :D.

Pleased you've got some extra work before christmas. Weekend not been too bad, Still trying to shake of this virus i've got at the moment other than that i'm fine.
