      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

As the title suggests. how many DCA's have to had to deal with since you first discovered this fourm?

 

For me it's as follows....

 

Intrum Justica - 2 accounts, no cca, sent packing

LDC - No CCA closed file

NDR - No CCA they gave up in the end

Eversheds - No CCA, gone quiet for 4 months

Frederickson International - No CCA Sent packing

Moorcroft 5 accounts - 2 closed, 3 still being chased for.

Mercers - Sent application form, sent packing

Barclaycard - Sent application form, sent packing

Hunter Forrest - Invalid CCA, sent account to Eversheds

Blair Oliver & Scott - Invalid agreement sent account to Moorcroft

Capquest - Asked to prove I owe thedebt. (still waiting)

CK Erupt & Co - No CCA, gave up in the end.

One Bill - added £500 disconnection charge (complaird to OFT & won)

Talk Talk - added £500 disconnection charge (complained to OFT & won)

Halifax Card Services - Invalid CCA, gone quiet for 3 months

Argos - No CCA sent account to Moorcroft

Robinson Way & Co - No CCA, sent packing (OFT complaint made)

Direct Line - Illegible CCA sent, account now with Moorcroft

Power To Contact - Ignored till Capquest got in on the action

Westcot - No CCA, went quiet a year ago

Buchanan Clark & Wells - No CCA, sent packing

Northern Rock - Sent to Eversheds & Hunter Forrest at the same time. All quiet for last 3 months.

Apex Credit Management - Went quiet after telling them account was in dispute with Abbey

Vodafone - refunded in full after I proved I had cancelled contract in writing.

Telogram - Ignored till Capquest contacted me

Paypal- Sent £1 payment, stopped paying them. Nothing from them for 3 months.

Debt Management Recovery Services - went quiet after telling them account was in dispute.

HFC - Sent packing after failing to provide CCA

Central Debt Collection Services - No CCA, went quiet afterwards

Alliance one - Went away after being told account was in dispute

EOS Solutions - No CCA, comlained to Trading Standards

Creditlink - Told account in dispute due to unlawful charges

Golds Solicitors - Eventually went away when I threatened them with the OFT

HL Legal Solicitors - Vanished after I told them account was in dispute.

 

Phew. That's all I think.

 

I only have Moorcroft chasing me for 3 accounts they have failed to provide a CCA for. Sent in my Formal Complaint letter, so in 8 weeks I can get them nailed by the OFT for attempting to collect on 3 accounts while in dispute and failing to provide a CCA for any of them from January '08

I think my list is so big, is because I've been helping workmates and friends with their DCA probs. I have quite a reputation for it now. :D

 

Planning to screw Moorcroft with the new Unfair practices 2008 laws if I can. Sending 3 new CCA requests on Monday. I know they'll fail to provide themwithin the time limit. Then off to the OFT I go with all the evidence of them attempting to collect on 3 accounts that have had 2 CCA's sent for each one, calling me after I sent the Harassment by Telephone on all 3 accounts.

I'm just gonna ask them if they want a (EDIT) when they call - longest one to put the phone down gets a CCA request and a £1 postal order ...

 

I'm going to start my own DCA now. I won't hang up on you. ;-)

For me personally £19,000 on 7 allegded debts. For family, friends, and people asking for help another £45,000. All sent packing (so far). Apart from 3 of mine that Moorcroft think they still have a chance on collecting payment on totalling around £3,000

 

Most of mine have been bounced around up to 3 DCA's so far.

Apart from Halifax and Moorcroft. They take a lot longer. But because of their arrogance, it gives me more ammo when it comes to complaints to the OFT. I'm sure the OFT won't ignore from Halifax 6 breaches of OFT guidelines and one DPA breach. As for Moorcroft, a single complaint about 3 different accounts all saying, "Continued to attempt collection on 3 accounts in dispute dispite 2 CCA requests on each one, and continuing to phone me." Even though I sent the Harassment by telephone on all 3. Not to mention I have sent the No personal calls on all 3, but on one of the letters they sent afterwards, they state, "Despite attempted visits from our local representative to your home, we still cannot contact you...." type of letter.

 

Moorcroft. I hope you're reading this. :p

I gave you enough rope to hang yourself. Now it's time to pull in the rope and hang some monkeys.

 

I will do everything I can legally, to make sure you get your licence removed and your company shut down for good. Then the people who haven't discovered CAG yet will have one less parasite to make their already hard lives a misery.

I gave up on printer cartridges ages ago lol. Now I use those external ink tanks that sit at the side of the printer and the printer is fitted with modified cartridges with auto resetting ink level chips. Then fine tubes connect the cartridges to the ink tanks.

 

Whole lot costs about £40 and includes equivalent to 30 cartridges worth of ink. Bottles of ink to refill the tanks are about £6 each.

Works out far cheaper if you do a lot of printing.

 

When it comes to keeping up with all the letters, I have one big MS Word document file that I copied and pasted from here and various other sites. It contains almost everything I need. I just copy and paste the bits I need for a letter. Even a complex complaint letter to say Moorcroft and runs to two A4 pages takes me about 5 mins to get written, printed, and in the envelope.

Does Moorcroft often go looking in the woods for little bears to hassle then? ;)

 

I remember the phrase "do bears S*#T in the woods?" Yes they do when they have Moorcroft threat-o-grams to wipe their bums on afterwards.

 

Reminds me. Next letter to Moorcroft (feel free to use if you want).....

Oops, seems I already did that to one of my creditors/DCAs. In fact, phone never stopped ringing minutes after I posted here the other day ... what a coincidence. :D

 

And now am wondering whether the laws of harassment from a DCA/creditor extend to internet forums. ;_)

 

You never know. If you accidentally put something on here that can identify you. Ie location exact amounts of debt, etc.

 

Some DCA staff do frequent the forums looking for inside info onto what we're going to be trying next. Always best not to reveal anymore than you have to on here. But still enough to get help and give help to others.
