Hi!

 

I need some advice, I think. I went to China for ~13 months, from summer 2006. Before I left, I asked Lloyds TSB to put a note on my basic account about my absence (which they did) and cancelled all my direct debits.

 

When I got back, I was welcomed with £210 of bank charges for unpaid direct debits. I went into the branch to ask for these to be refunded, which they said they'd do - in the end it took 5 months of prods and reminders (and my card being eaten!) to get the charges back, but now that I have, I've got no problems using the account.

 

However, looking at my credit record with Experian, they've recorded a big red "6" for every month up until February just gone (when they corrected the account). I want this removed! It's not my fault, and the bank agrees with me on that point.

 

What's the best way to go about it?

I would start by putting what you have written here in a letter to Lloyds, asking for the information the CRA's have to be amended and make sure you state this is a formal complaint and you are invoking their complaints procedure.

I went into the Exeter branch to ask for these to be refunded, which was instantly agreed (there will be a note on the account circa 25th September 2007 reflecting this) - in the end it took 5 months of prods and reminders (and my card being eaten!) to get the erroneous charges refunded, but now that I have, I am quite content with the account.

 

However, looking at my credit record with Experian, you have recorded a big red "6" for every month up until February 2008 (when you completed the correction of the account). This indicates that I have had a significant amount of unpaid debt with this account. I want Lloyds TSB to contact this credit reference agency immediately (as well as any others where inaccurate information regarding my account has been lodged) and remove the fraudulent descriptions of my account status since June 2006. Your agreement to refund these charges signifies that they were erroneous, and that my resulting negative account balance was in fact a mistake on Lloyds TSB’s behalf. Please be informed that I am invoking your formal complaints procedure over this matter, and 28 calendar days is a reasonable amount of time for your reply.

I would remove the word "fraudulent" and substitute with "incorrect".
