      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No - I can't manage that. Registered office is in London (well one of them). Shame the cost has gone up to £100, and last time the baliffs went in for me the 1st I knew of it was when they had got my money for me. Then of course it's a case of waiting for the cheque to arrive at court, clear and then the court to send it on to me. Less then 2 months then................... but at least I finally got round to it. Throw it at other debts, donation here and put £100 aside towards spending some days in London in summer holidays where we will be staying at a YHA which is really good accommodation in other parts of the country - good grub at affordable prices in unusual locations. We are thinking of staying at Holland House near Notting Hill. Assuming of course the judge allows my wasted court order - I asked for just over £200 in time and letters.

 

Got an extended weekend off so I'm off to the pictures later. Saw Avatar on Wednesday - mindblowing in 3D - so am considering the Vigo Mortenson film 'The Road' today. The Book of Eli was good last week. I certainly make use of my unlimited cineworld card.

Just one silly little blip - when I filled in warrant request I carried on adding the compound interest - YOU CAN'T DO THIS. I should have entered the figure as laid down by the judge when I won by default. Apparently I am not the 1st person to make that mistake. Got the paperwork back to the baliffs last Friday so something should happen within the next 3 weeks.

GE Capital Bank (trading as GE Money), 6 Agar Street, London, WC2N 4HR is where the baliffs will be going.

 

Will this be good publicity for the site then and shall I get some more useful information - like when they will be turning up. If you can milk it I am a single parent with one dependant child and 2 non-dependants on jsa - one will be a fully qualified joiner by the summer and the other is going onto university this autumn. Throw being a local government officer without a pay rise this year (can't you just see strike action in the offing) and just raising baliffs £100 fee was a bit difficult.

Got home to a letter from the balliffs - GE Money are going to have to give up some of their possessions in lieu of their debt to me - interim return. Why not just pay me and keep their computers etc?

 

I also have a wasted costs application meeting here in Birmingham in April - only 20 minutes. I am thinking I should take copies of my letters and theirs for the judge to see but leaving the 'without prejudice' ones at home.

 

Isn't it lovely when it all comes together in the end

Silly me - I do feel embarrassed. Shouldn't have filed for wasted costs - can only do this when defence has been submitted. I won by default so wasted costs not applicable and they even sent a solicitor along to make sure I didn't get anything.

 

Definately going to get court book from this site when I get paid. Still heard nothing from the baliffs and am wondering what is going on. Will check with my court to see if they can advise as I phoned london court and just got automated system. Very Frustrating.....................

Well, it was my fault. Seems because I filed a wasted costs order the warrant was recalled and the whole of the claim was then dismissed - in error. I am going back tomorrow to submit a request for the warrant to be reissued and court employee informed me last week that it won't cost me anything as I am not asking the baliffs to go to a different address.

 

I do feel a ..... silly billy. Still it will be userul for the summer.
