Can Abbey and Paypal really do this to me?

Hi there,

 

My problem is with Abbey Bank.

I was made redundant a few months ago and racked up around £1000 in bank charges in the space of 3 months.

As a result of the CAG I'm now at the letter before action stage with Abbey to get my money back. As a resut of this I set up another

bank account with Natwest to avoid any more charges, and told Abbey I wanted to close my account. a few weeks later they finally bothered to contact me and told me they would be closing my account and sent the paperwork to confirm that I had destroyed my cheque book and cards. I returned this to them. However 2 days ago I got a statement from Abbey, on which Paypal had tried to take £200 out of my account on two sperate occasions, and Abbey were charging me £70 for this.

 

How can they charge me for a closed account? Also why are Paypal trying to take money out of the closed account when I'm already paying a DCA for the same Paypal debt?

Can they legally do this? If not, what should I send in the way of a letter to make them stop.

Hi Fuzzybobble,

 

When you say paypal tried to take the money i assume you mean Direct Debit? If so i would immediately cancel it, and any others you may have set up with creditors / DCA;s and replace them with Standing orders, it gives you more control of payments and avoids any penalty charges in the future.

 

With regard the £70 charges from abbey add them on to your current claim, luckily you havent yet filed at court

Yes, Paypal tried to take the money by direct debit.

The account is closed and I have it in writing from Abbey,

so why they allowed adirect debit on a closed accountis a bit of a mystery.

 

The £70 has already been added to my spreadsheet and will be

sending in the N1 forms to the court in 2 weeks time. :D

 

Isn't it a good feeling to load up the spreadsheet every month

and see the amount rise because of the interest charges?

So far they owe me £1300

I would be more concerned why you are due paypal this money whilst they are collection the debt?

 

I would check your ebay and paypal acccount to make sure it hasnt be hijacked!

Hi,

 

The Paypal debt is due to my bank taking £300 in charges out of my account and then bouncing all my direct debits/cheques for that month.

As a result Paypal account it now with a DCA that I have already arranged a repayment plan with.

What I'd like to know is, can Paypal legally try to take money from a closed account while they also have a DCA collecting the same debt?

Also can Abbey charge me for returning 2 direct debits on an account that was closed 2 months ago? Surely when you close an account

they also cancel diect debits etc?
