    • I drove a friends a car for a few days and I used cuvva car insurance to insure myself for the time period. Here's the problem: I made a mistake with the dates on the insurance, I ended up driving uninsured for one day and I got a speeding ticket. My friend named me as the driver on the Notice of Intended Prosecution as she should and I will take the blame of course. Will met police ask for proof that I was in fact driving? I mean, any more other than me replying to the NIP that I will soon receive from them? Cause I assume that my insurance for the day will be the proof that they need... Secondly,  if caught driving uninsured, what will happen please? I read it's £300 and 6 points. Is that all or is it worse? I'm only asking for information from knowledgable people. If you intent to just mock, you're certainly not helping. Thanks

    • This is the first item that I've ever claimed for - I don't really send too many parcels, probably 5 in the last 5 years, and only two with P2G / EVRi. I've attached two emails from P2G regarding their requiring the documents. They don't specify in the emails what documents I should be sending, although when opening the claim they were requesting that I needed photographic proof of sending - picture of the parcel with their label attached, in the EVRi ParcelShop. The second email is their closing the enquiry due to my failure to produce said document(s). I haven't yet drafted my claim letter, I wanted to be sure of this document situation first before I began action. But therein lies another problem. Not having a P2G account, I cannot be sure of the item value that I declared. The retail value at the time was £600, which is less than the £650 I paid several months earlier, so I would likely have used that, but cannot be sure. And without having an account I can't check either. But, I know that I did properly declare the item and a value that reflected its then retail price - I was concerned this declaration may have been used to single the item for theft. But now that the retail price has reduced substantially, even though the nature of compensation is to return the claimant back to their original position, without my purchase receipt, I was concerned that I may have to claim for less. And yes, I've been through your huge document store of information, in addition to MoneySavingExpert, Which, Citizens Advice, Gov.uk "make a court claim", my own law books (annoyingly I specialised in consumer law when I studied for my law degree, but I graduated 17 years ago), and so now feel that its time to either act, or drop it.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well here goes again someone new while mum was on phone tonight she recieved a mess say phone moorhouse agencys regarding your ltsb c/c before 9 i told her if they phone back say account in dispute dont phone again have i given her the right advice

That was exactly the right thing to say. Wait now until they write. You can then write to tell them the account is in dispute.

REGARDING MUMS STUDIO GIFT AND CARDS ACCOUNT

after sending the letter in post239 to moorcroft regard mums account they must have pasted back to studio and studio have sent a letter saying they have removed all charges and interest of the account since statement 8 and will know accept a pound a month until the balance of £188.85 is cleared, so thats ok i think i will get my son to scan the letter on tomorrow cos i still have not got hang of doing it

Well done Lisa :grin: I bet that's a relief for you and your mom. Why could they have just not accepted the £1 in the 1st place? They're greed has caused all this hassle, so good on ya for fighting them.

 

Keep hold of that letter just in case they try anything at a later date.

Hi all

 

mum got call on wednesday from mha collectors regarding her lloyd tsb, she just said if you look back you will see that the account is in dispute so dont call again they said will check that will put calls on hold so so far no one has called but its only friday

I don't have any advice to give but I have just read your thread straight through beginning to end and I just wanted to thank you. I have been feeling pretty bad about my own ongoing saga with a different company. It is bad enough going through it all for yourself, but I think it takes someone pretty special to take all this on for someone else while looking after their own family too.

 

You are an inspiration and I'm ready to go on fighting. You and everyone on this board are true stars :grin:

Thanks for the message is words like this that makes you carry it on. Glad to hear you going to carry on fighting it worth it i ahve fought 4 alraedy for mum 4 more to go and 2 for dad. Im so grateful for all the help I have had on this web site there are people out there who care. So dont give in I would of done if it wornt for everyone on here.

Hi there all tsb have know passed the debt to someone called mha collections but if you read the bottom of the letter Im about to post it say that they are a trading name for lloyds tsb so it sound like its just them under a different name.

The still have not sent a cca so any advice on what to know would be grateful please

Hi Lisa. I can't remember where you are up to with this. Did you send a SAR for the Lloyds account? Has your mom started to make £1 payments?

 

As GM has said, just tell the DCA who seem to be in house collectors the debt is in dispute.
