    • I drove a friends a car for a few days and I used cuvva car insurance to insure myself for the time period. Here's the problem: I made a mistake with the dates on the insurance, I ended up driving uninsured for one day and I got a speeding ticket. My friend named me as the driver on the Notice of Intended Prosecution as she should and I will take the blame of course. Will met police ask for proof that I was in fact driving? I mean, any more other than me replying to the NIP that I will soon receive from them? Cause I assume that my insurance for the day will be the proof that they need... Secondly,  if caught driving uninsured, what will happen please? I read it's £300 and 6 points. Is that all or is it worse? I'm only asking for information from knowledgable people. If you intent to just mock, you're certainly not helping. Thanks

    • This is the first item that I've ever claimed for - I don't really send too many parcels, probably 5 in the last 5 years, and only two with P2G / EVRi. I've attached two emails from P2G regarding their requiring the documents. They don't specify in the emails what documents I should be sending, although when opening the claim they were requesting that I needed photographic proof of sending - picture of the parcel with their label attached, in the EVRi ParcelShop. The second email is their closing the enquiry due to my failure to produce said document(s). I haven't yet drafted my claim letter, I wanted to be sure of this document situation first before I began action. But therein lies another problem. Not having a P2G account, I cannot be sure of the item value that I declared. The retail value at the time was £600, which is less than the £650 I paid several months earlier, so I would likely have used that, but cannot be sure. And without having an account I can't check either. But, I know that I did properly declare the item and a value that reflected its then retail price - I was concerned this declaration may have been used to single the item for theft. But now that the retail price has reduced substantially, even though the nature of compensation is to return the claimant back to their original position, without my purchase receipt, I was concerned that I may have to claim for less. And yes, I've been through your huge document store of information, in addition to MoneySavingExpert, Which, Citizens Advice, Gov.uk "make a court claim", my own law books (annoyingly I specialised in consumer law when I studied for my law degree, but I graduated 17 years ago), and so now feel that its time to either act, or drop it.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The agreement you've shown isn't a barclaycard agreement, it is a welcome finance agreement.

 

Did you have an account with welcome finance?

The cover letter I got this morning states "Your Account Barclaycard"

 

Thats why im confused, as it what the debt is over.

 

As for welcome I sent them a letter in 2005 I have a copy of it on my PC, Saying you have the wrong person and address.

 

And that was it I never heard of them again, until about 2 weeks ago from a company called HFO

 

And thats where im at now,

 

I have asked HFO to take this to court as the only way I think this will get sorted and my name cleared is for a judge to say hang on lets look at this in a bit more detail.

 

But so far no court date just more and more charges being added to the account. :-(

what i am basically asking is, is the name on the credit agreement yours, is the address yours, did you sign it? Was this you loan?

 

It seems welcome believe this is your account. It certainly doesn't seem to be a barclaycard account.

 

Is it possible you have same name and dob as another person OR that it could be fraud?

Sorry mate in not a smart person.

 

The name is mine yes and the sig looks like mine, the address was my partners old address, But I know for sure I have never signed it ever, when Welcome phoned in 2005 as a courier I told them they had the wrong person, and we talked for around 30 mins and that was it, letter sent confirming what was said and I never heard out again. until 2 weeks ago

 

As for name and DOB I have no doupt thats possible, (every one want to be like me im sure :) )

 

What I do know is im now worried more so than ever as I do not want to end up paying a loan/debt for some one else

Have got to say this looks very iffy to me.

 

I think you need to go back to basics. If they do issue a claim through the courts, are you absolutely sure you did not take out a loan with Welcome Finance? Is it your signature and if so, where did they get it from. Were you ever desperate enough to sign a loan agreement with 47% interest?

 

If this is definately not yours I would not even think about paying it just to get them off your back. This is exactly what they want.

 

I would insist on seeing the original along with a true copy of the deed of assignment from Welcome Finance. You need to send an SAR to Welcome if you have not already done so and CCA request. If in the meantime you get a county court claim you can request extra time to prepare your defence. There is a fab letter which you can serve on them giving them 10 days to provide all the documentation for the Court. Remember in law, he alleges must prove.

 

Just out of interest, are you a home owner? If not I doubt very much if they will instigate court action.

Just thought of something else.

 

The agreement has to properly exercise and executed.

 

Who the hell is A Partington? No address...............very iffy

He has the same handwriting as the person who inserted your date and the same as the person who completed the agreement...........very iffy

 

I would not underestimate the depths to which HFO will sink. They must have a whole department just devoted to copy/paste and scan!

HFO are getting a very bad name - the postman who delivered their fake 'courier' card says he wishes he could NOT deliver them but because it is properly franked he has to deliver... I'm slowly gathering other evidence against their bad practices.

 

Luckily I haven't had to deal with them personally - other than to tell them where to stick their job offer - but have dealt with other DCA muppets. The favourite was one who "didn't deal with third parties". My reply was "Neither do I, provide copy of last bill and you will be paid - otherwise court". Needless to say I got a letter back stating it had gone back to OC with no further action to be taken.

Yes their reputation is certainly growing.

 

There is so much I would like to say but cannot at this time as it may prejudice my case but rest assured very soon I will post everything which will hopefully help everyone else who have had the misfortune of having to deal with these muppets!

I have never sign a loan with welcome, in fact I have never had a loan

 

Yes i do own my own home with my partner

 

I have not send SAR or CCA to Welcome just CCA to HFO

 

A Partington no idea who he is

Not sure if this means anything but just been to

 

Credit Reports: Get your Credit Report from Experian UK

 

And had a look at my credit rating (not as bad as I thought)

 

and there is nothing there from welcome at all. Not 1 small ounce.

 

This is making me feel so much better as I know they have the wrong

 

Person, Im making my defence now :-) for my final demand from HFo to

 

take this to court :-)

Good on you.

 

They dont care if you genuinely dont owe the money. They rely on people just paying due to the intimidation and harrassment.

 

The court does not like to have its time wasted with idiots like this. Let them file, it costs them money.

Thank you for your email received on 17 December 2007, regarding the problems you have been experiencing with the above trader.

We are always interested to receive complaints such as yours as they are a vital source of information in helping us to investigate the behaviour of traders that hold consumer credit licences. The trader you have complained about does hold a consumer credit licence.

If a business wishes to be involved in activities relating to consumer credit or hire, including debt collection, they must have a consumer credit licence. The Office of Fair Trading (OFT) has a duty to monitor the fitness of all traders that hold a consumer credit licence. In considering fitness, we take into account whether a business has engaged in unfair business practices. This includes any evidence that traders have not complied with any guidance issued by the OFT. The OFT has, for example, issued guidance to consumer credit licence holders engaged in the debt collection industry. The guidance sets out minimum standards that we expect of debt collection traders, consistent with fitness to hold a consumer credit licence. The guidance is intended to ensure that debt collectors treat debtors fairly. Non-compliance with this guidance will call into question the fitness of licence holders and applicants.

We investigate all complaints received about consumer credit licence holders and, where we have the necessary evidence, we do take appropriate action. In our initial investigation of all complaints we consider how many complaints we have received overall and how strong the evidence is to support any action. It is unlikely that a licence would be revoked on the strength of one complaint. Where we have strong evidence that unfair business practices have occurred, we may take steps to revoke or refuse the licence of the business in question. However, if we are to do this we need to take account of factors such as the number of complaints received how recent they are and how well evidenced. In cases where evidence is less strong we may issue a warning letter to the business putting it on notice that its behaviour, if repeated, will call their fitness to hold a licence into question. Any action we do take has to be proportionate. If an approach from the OFT makes a trader change its behaviour and treat consumers fairly in future, this is preferable to putting a trader out of business.

If we do take any licensing action against this trader it is likely that we would need to disclose your identity to this trader along with details of your complaint. I should therefore be grateful if you would provide me with written authorisation to disclose these details to the trader. I have enclosed a disclosure consent form for you to sign and return to me.

We have noted the details of your complaint, to consider alongside any other complaints we have received with a view to any licensing action we may decide to take. We may therefore contact you again if we require further information. Meanwhile, given that the sanction of licence refusal or revocation is such a significant one there are constraints built into the process for taking such action. For example, because of restrictions in Part 9 of the Enterprise Act 2002 relating to disclosure of information, we cannot disclose specific details about any action we may take, nor comment on any adverse information we hold on individual licence holders.
