    • Update: I wrote again to WODC and again they have failed to reply. I also wrote to my 2 local councillors and the Leader of the council.....   Only one of them responded, my local councillor who also happens to be "Executive Member for Finance" , and he said that he had asked the relevant officer to look into it and report back, then he would come back to me with the response. I haven't heard back and it's now a week. I'm seriously beginning to think that someone there has been alerted to the fact that they have fuffed up, and they are dragging their feet until they can cover their arse! Do you think it is worth sending a reminder email to the councillor that responded, or should I give them a little longer ?  I have stopped receiving SMS's from B&S so maybe they have been asked to lay off, but I have no sure way of knowing ! I also have the email address of the CEO of the council, maybe I should send him a copy of the above, stating that I am still waiting for a response and that I am completely in the dark about B&S.
    • There's no need to borrow words from another thread here; we don't have a template. Do this in your own words or it won't sound sincere and may not even apply to your particular case. If I were in the investigations department, I wouldn't be impressed by someone who copied and pasted rather than write their own letter. And please don't use AI for this, people can spot the style a mile off. Para 1 - tell them why you did it, no excuses other than trying to save money. Para 4 - tell them you're using the PAYG card. They won't tell your employer but you probably should if you're convicted. Covering up a conviction is worse than having one in the first place. ETA: Check if there's anything in your employment contract. As I said, you don't send anything until you hear from them because they won't be able to find your case without their own reference number. HB

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone

 

I have just been on the phone to my local court to check on my progress with Barclaycard. The claim was served on the 5TH October 07 and they had until the 19th October 07 to reply. They have not replies as of yet; I was told I can issue a judgement against them, should I wait a few more days or should I just issue it now, and what is the best type of judgement to issue? My claim is for £2005

Hi Alison, yes, if they have failed to answer in the prescribed time the file for judgement, i am going to ask that is moved to the Barclaycard forum.

Sorry I missed a bit, the only type of judgment available to you is that you win by default as they havnt answered in the timescales. Also you want payment immediately.

Hi Alison, I was advised (Camdenite Vs Providian/Monument) to hold fire on requesting judgement until the 28 days have passed after they we're due to submit their acknowledgement of service. The reason being that b/card fight dirty and will get away with filing a late defence if you try and request judgement at this stage.

 

It's painful how the courts will let them get away with it, but you may be best waiting another month (sorry:( ) until the time has elapsed and they can't file a defence in time.

 

I'm in exactly the same scenario and have had to be patient with them.

I hope you dont mind me sticking my oar in, but i think you need to be very patient with Bcard.

Of all the people i am claiming from, I think 9 at the last count, Bcard are playing the hardest nut to crack.

Allthough, technically you have won your case, i woudnt rush into requesting judgement just yet.

 

Of course you can go ahead with your request, and i wish you well if you do, but i would wait a week or so and then check on Bcs response with the court.

 

As Slick says, if you go for judgement now, allthough its late, i guarantee they will rush a defence through, and it will be accepted.

A real Pee off i know, but thats whats happening im afraid.

 

If you wait just a while longer, the court wont look to favourably on them if its that late.

 

I have been dealing with Bc since April i think, and they are still being a pain, allways coming up with something right at the last minute.

 

An example if you dont mind.

I have 4 sets of the same statements ( all incomplete ) All just within the 40 days. ish

I have a 600+ plus page full Data Protection Act Disclosure ( waste of paper )and still they wont give me the information i want.

THEY PLAY GAMES WITH THE SYSTEM.

At our expense

 

Obviously only you can decide, but can you wait another week or so.

No gaurantees, but i dont think you will regret it.

Hi Alison,

 

Camden has taken quotes from his own thread (posted by TonyC) which may serve as a warning. If you file for judgement too quick, Bank has better chance of slipping in late defence which as Court (ridiculously) accept.
