  1. I would also say that they would have to make a judgement of what they are losing. If your position was so important as to affect their business and you left them on the lurch then you could have a problem. But if you are in a lowly position and easily replaceable then what good would it do them to pursue you? Companies make judgements based on economic criteria ie what is the cheapest option.
  2. Sounds right to me. They should have confirmed your status in writing. They are trying to hoodwink you. In any case what will they do if you just go?
  3. Hi ...... WheelerG I don't disagree with your remarks but amm was showing some contrition to his admitted stupidity and that is at least a point in his favour. I think many people on here will have stories of past matters that they now regret. Many of those in debt for example could well have been tempted into actions they don't want to do or indeed are currently doing because of force of circumstance. amm I think your should write to tfl and see if the matter can be sorted out administratively to avoid court. Perhaps if you indicate that you are willing to pay resultant fees and fines you may avoid court. I would also tell them that there is very little likelihood of you returning to the UK. If they do not agree to this a summons will be issued to your last known address and in due course will be proved in your absence as stated above. Then again in due course a warrant for non payment of fine will be issued. Are you likely to return to the UK? Which country are you in?
  4. 2 schools of thought.... first, by chucking it the owner is discarding ownership of the item. second, that the owner only gives up ownership once it has been 'tipped' and intends it to be tipped. You also have to act dishonestly so if you make valiant attempts to locate who the owner is , by knocking on doors to trace and ask for permission then you are not acting dishonestly. If you can't trace the owner and take it you have the proof you wnated permission and were willing to pay. Personally I would ask whoever the skip has been delivered to and get permission. It's not worth the hassle for a couple of bits of wood.
  5. I am pretty sure non payment enforcement is done in the county court and you use the paperwork from the ET as the proof of the justification of your claims.
  6. Blackmail Section 21 Theft Act 1968 21. Blackmail. — (1) A person is guilty of blackmail if, with a view to gain for himself or another or with intent to cause loss to another, he makes any unwarranted demand with menaces; and for this purpose a demand with menaces is unwarranted unless the person making it does so in the belief— (a) that he has reasonable grounds for making the demand; and (b) that the use of the menaces is a proper means of reinforcing the demand. (2) The nature of the act or omission demanded is immaterial, and it is also immaterial whether the menaces relate to action to be taken by the person making the demand. (3) A person guilty of blackmail shall on conviction on indictment be liable to imprisonment for a term not exceeding fourteen years. This offence would be ideal but there are many problems with it to overcome before a judge would even put it to a jury.. Normally there is a CONTRACT that the victim has signed and is the basis for the demands. However if various complaints are upheld one may have an argument that the use of menaces was not a proper means of reinforcing the demand. The other problem is view a view to gain or cause loss. The contract lays out what the lawful terms and conditions are so I would have thought that one would have to rely on causing loss to you, and for you to rely on the various acts protecting you from unnecessary loss. There are probably more keen minds that would advise on this all I do know is that the Police wouldn't want to touch an allegation such as this with a barge pole!!!!!

That's very funny wheelerG....... when you think that they both use their sticks, no doubt to good effect, the fact the sticks were opposite and furtherest away from where they were makes it scary. I noticed after I became disabled that sighted people automatically see the disabled and subconsciously take avoiding action, except in stores when they are too occupied with their shopping.
  9. He was 'arrested' not by the officer but the store detective. The very fact that he was unable to freely move where he wanted to go meant that he was detained. What should have happened is that the officer should have explained, in writing if need be, that he was detained unlawfully and actually assaulted, albeit a common assault, and did he want to take any action. The officer treated the store detective as if he was a police officer who would have had a lawful power of arrest in those circumstances. An apology would have been necessary especially by the store detective and the store. He was treated appallingly in my view by both. It says more about the goodness of your friend than the actions of these two and the store.
  10. Your deaf friend really should have. How very tolerant of him. If a Police Officer makes an unlawful arrest he could be investigated for a criminal offence, if the Custody Officer then goes on to detain that person in a cell the sergeant is in bigger trouble. I was told once how much that costs in compensation something like £150 per minute, and that was years ago. How long ago did this happen?
  11. Hi... Can't answer all your questions but I am sure you will get loads of replies. Your DLA submission reminds me when I had to fill in that form for the second application after my own accident. They never wrote to me. The first I realised was that they just stopped paying me. So expect the worst response. Have you read up on Permitted work and the Employment and Support Allowance? The 18 hours mentioned by your GP is over that limit. There is also an earnings limit too.
  12. I believe that it is just contract law. It will all be in the terms of the tenancy. Not enough to rescind the contract but they should put right the problem that you have had at the beginning. I would write them a letter when it is done and ask for your expenses back. Keep receipts and ask for something on top for the hassle.
  13. I would have said that your tenabcy has started but that if you are unable to have the enjoyment of the property and you are spending money on your old place + travel expenses + the hassle then the landlord should compensate you for your losses and additional expenses.

  18. There has to be an arrestable offence been committed for a civilian (ie not a police officer) for a detention to be made. So if there was no offence but merely a mistake eg tag not removed after purchase then they have no power.
  19. I don't suppose you have a legal protection insurance policy, sometimes attached to home contents insurance, so you can ask a qualified lawyer? Perhaps, you could get one if you don't and then ask their telephone help line. I read your other posts and thought you had a good case (didn't you say that the problem had to be fixed before buying and they agreed???) but I didn't post because car problems are notoriously difficult.

  21. If you are sick and your GP gives you a fitness note, fill in the back and send it to the DWP and incapacity benefit is paid. I am sure if you search this site you will get stories about IB. Also read up on it on the direct gov site. You are employed so long as you have not been dismissed. Deflect the illness to the bullying and not the 'crime.' If they eventually dismiss you then you at least have a reason to explain to a new employer. What is you personal situation. My wife could fight as she had me for support, monetary and morally, have you any support?

  23. I agree with jackieandwayne. You should lay the foundations for the storm you unleash on them. Don't resign.... make them do the overt action.
