  2. Hi, A friend of mine has recently some trouble with her knee, which has resulted in her being in quitea bit of pain and not being able to walk properly. This was over a year ago - She visited a Doctor who referred her to a so-called knee specialist. (All charges were covered by the BUPA scheme) The specialist, who was seen in Feb 06, diagnosed that an operation would be necessary, the operation was carried out and she was off work for 3 weeks. Over the last year she has often been in considerable pain and culminated in a massive lump forming on her knee a couple of weeks ago. As she was in so much pain and obviously concerned at the lump on her knee, she visited her GP again, who then referred her to a different specialist. This specialist has told her in no uncertain terms that the first specialist mis-diagnosed her condition and an operation should not have been required. The diagnosis this time was to visit a physiotherapist once every week and perform several exercises, daily.... I would be interested in hearing an opinnion from the CAG forum on the best course of action to take over the first specialist. My friend is obviously angry about the mis-diagnosis and would like to let BUPA and any relevant party know of the anguish she has been in over the last year and a half. ....she would like any advice on possible legal action to take gainst the first specialist....?     Egg

    Hi, I need some help. Not sure if I should post this here on the EGG section. I have an Egg card, which I am going to; 1. claim back the unlawful charges on, and 2. reclaim the mis-sold PPI on. I requested my CCA from them, which I received fairly prompt. All they have sent me through is the standard agreement from the on line form. i.e. About me, About Egg PLC, and about the Egg Card. All they list is the interest due to be charged. They then have sent me a copy of the agreement signed by me and someone called Az Alibhai. There is no mention of PPI. No mention of credit limit, and I was under the impression that the CCA should include the terms and conditions? Also, Egg have continously raised my credit limit without my prior consent. Is this fair? Can they do that? I intend to SAR them shortly, but I am currently tackling Barclays, Barclaycard, Capital One, Littlewoods, Halifax, MBNA, and Smile....... I'd appreciate some advice, but in the mean time I will continue to look around at a few of the other battles going on. Thanks.

  5. I am going to return to one of my original points and say that no one person should ever incur a fine because an adult should know not to litter. Doesn't matter whether it's a fag butt or a big plastic bag. litter is litter. The fine is so high to deter people from ruining their respective city. I do however agree that there should be a degree of common sense involved with the enforcing officer, but it's the law, and it's up to them how they individually enforce it.
  6. Nope. I was struggling financially an dwent to them in order to get a loan so that I could consolidate. I did however not realise about the PPI that had been added, and was taken aback somewhat by the APR. Looking back, the guy looked extremely uncomfortable and shifty when I questioned the APR and he then left me in the room on my own to go over the 'Contract' I was young, naieve.....
  7. Hello, I've just been through a similar thing. Not restructuring, but outright redudundancy. I assume it is just the 3 office staff being consulted? The fact that only your boss was at the meeting doesn't really matter. We had consultations that were supposed to be held between us, the MD, Operations Director, and the HR manager. Never happened that way! The witness that you should have been allowed to take with you should have been either an employee of the company, or a union rep. Not a spouse or significant other.... You should stop concentrating on the Why's and the where for's. Concentrate on what you wish to achieve. It sounds like they are cutting costs by firing an employee. To do this they should have to prove that the job and work load no longer exists. You or one of your colleagues may have a possible case for unfair selection. If the work's still there and they make one member of staff redundant, over another, that's unfair selection. Depends if you are all doing the same sort of work. I would just accept it. Your employer wish to make someone redundant, and they will carry it out at the end of the day. Even if they pay redundancy or get taken to a tribunal - it's happening. Pray it won't be you. If it is you, you need to work out whether you want to take them to a tribunal or accept their terms and try to negotiate a suitable redundancy package. *****Disclaimer***** Should any one disagree with my personal experience and / or opinnions, please do not verbally attack and insult me *******************************************************

  9. oh my god. that response was one I fully expected from people who frequent an internet forum. so, my opinnion is tosh? ok, sorry. yes, you are of course completely right. my mistake...... I was talking about this case individually. not about your crusade. If this person has been caught littering, and there is a fine for littering (unless I am mistaken), then pay it. To use the street name, or date, or any other technicality as an excuse would be immoral. To be honest, an ADULT should have more common sense to dispose of ANY litter properly.
  10. Hi, I had a loan through Welcome Finance, about 2 years ago. Looking back through the old documents, it seems that I paid over £300 in PPI. My questions would be, can I claim that back? How succesful is any claim likely to be? and how do I go about claiming it back, (if I can)? Do I send them a SAR? I definitely do not remember being told about any PPI. Obviuosly, 2 years ago I was not wise to financial matters and feel completely ripped off! + the APR was 45%!!
  11. pay the fine. To opt out on a technicality would be wrong, and littering is a crime. It's easy to flick the end of a cigarette once you've finished, to extinguish it and then walk it to the nearest bin, or keep it in your pocket. simple as.

  14. Hi, I have just received my council tax statement through the post, and there are numerous charges listed. Does anyone know if these are similar to bank charges and can be challenged? Thanks
  15. or, could I claim my charges back from Capital One, if I no longer hold an account and maybe close to 6 years old? I am pretty sure that I incurred charges through them and Barclaycard but was around 5 - 6 years ago. Just not sure what information I should provide them with in order to request my statements. Thanks.

  17. Why do some people seem to take another persons opinnion as a personal attack, rather than enter into an informed debate? I think there's pros and cons for every situation, and the smoking ban is no exception. There is no right answer.

Hi, I have recently received a court summons for unpaid council tax arrears, and immediately contacted the council to negotiate a monthly payment scheme as the amount they were asking for is too high to pay in one go. They have said that they will send out a budget planning form, fair enough. But then they went on to mention court costs. Would these be recoverable under the same principle as bank charges? Also, we live in 91a of a split house. i.e. we live in the top half, someone else lives in the bottom. Does anyone know if we should be receiving a discount because our property is split?   19. Doesn't the landlord have the right to ban smoking throughout the entire building as well? If the tenant doesn't abide by that rule, then they'll be in breach of contract?? I only say because my brothers building don't allow smoking in any of the flats.
  20. It is if 20 or more people are being made redundant, there needs to be a 30 day + consultation period. I think it's 90 days for something like 100. You should make sure they stick to what is stated in your contract, because unfortunately you aren't in a position to negotiate because there are less than 20 people being put at risk in your place of work. What you could do is ask for the business justification behind the proposed redundancies. They do have to show and deminstrate that the redundancies are legitimate prior to instigating any redundancy. Following that, you could take them to a tribunal if you feel unfairly treated and if you feel that there is a case for unfair selection. e.g. you and another member of staff performing similar roles within the organisation, and the other employee has kept their job.
  21. Sorry guys, but I completely disagree. The response I received was extremely unprofessional and abusive. Where I work, had I sent out a response like that, I would lose my job, or receive a written warning. It seems to me that customer service skills have left this country long ago, the correct response to my complaint should have been a lot less personal. If I pay for something online, it's usually for ease of use. They stated themselves that Royal Mail hold items for 1 week before sending back to the user, I had no card so would be unable to identify the parcel even if I did phone Royal Mail direct. AND....due to other commitments - I was away at the Isle of Wight festival, I was unable to contact them within the timescales laid down, which was not thought of by their MD before he laid into me. Until I sign for the parcel or receive the parcel in my hand and accept the goods, the problem does not lie with me. It was after the 1 week deadline when I contacted them, and asked them to find out where my parcel is, so I assume it is on it's way back to them, and like I say; I have not accepted the goods so it is still very much their problem to resolve.

Hello, To summarise, I ordered something, it never arrived, turns out that it was at the post office, so I asked for a refund - several times....! on top of that, I am not in possession of the little card that the post man should leave. I merely asked them to resolve my situation as Royal mail only keep items for 1 week. I would suggest that no one should ever use this joke of a company, as this was the response I got....! "Dear Mr Rowe, thank you once again for your pleasant and reasonable email. The reason you have not heard anything back is because of 2 reasons, the first being that the Royal Mail website is still showing your order as being at your local Post Office and the second being your unwillingness or inability to check to see if it still there. Had you bothered to do this we would have confirmation of where the order actually was. I regards to taking up any issues with Trading Standards, we would welcome any such action in which you would have to explain exactly where we have failed in our responsibility to you. We are sure you will find that as a customer you do have certain responsibilities when ordering goods that you know are going to need a signature for and a responsibility to contact us within the timeframe laid out in your confirmation email. As previously stated we sent the order out as soon as it was placed, you were informed by a confirmation email that it had been dispatched, you were aware that a signature would be required and to contact us within 5 working days if it had not been received. You were not in when Royal Mail tried to deliver, you failed to notify us for 2 weeks and then refused to go to your Post Office to check if it was still there. The only reason the matter has not been resolved is because of your own actions or rather lack of them. However, we have sent you a cheque for the full £34.98. We have sent it by normal post as you are unable to go to your local Post Office. We would advise that you may wish to look at hiring a butler or handyperson to do the menial jobs that are obviously beyond you"
  23. I should think that the person that initiated this post has obviously never been on a low income?? I get the same comments from people earning a lot more than me. Bottom line is, I am not a financial expert and find it extremely difficult managing my funds, something which I believe needs to be addressed at education level.
  24. Hi guys, I need some help with reference to redundancy. I have been working for a compan for 3 years now, and we have all just been infdormed that we are merging with another company, out site is being shut down and by the end of the year no one will have a job. We have now entered the 30 day consultation period. I need to know what my rights are? What questions I should be asking? And what I need to be fighting for? I'd appreciate some help. Cheers, Jase
  25. I was thinking that. They could technically charge whatever the hell they like! I have a virgin card, and it's more than likely well over the limit now. If people aren't told about the increase, they won't make the minimum payments, especially if you have a large balance. .....Anyway, ho is the minimum fee on this card £80? for a balance of 8 grand? I have 4 grand, and am paying £80 too. also, surely MBNA need to send out a new executed agreement for you to sign? Otherwise, the only copy that will be signed will reflect the existing interest rate.
