  2. Hi guys, I sent a letter to paypal and NCO stating my dispute over this claim. Now, this week I receive a card through the post saying some guy will be calling round on Tuesday. What does that mean? Should I be scared? I was going to send a letter on Monday, recorded delivery saying this matter is in dispute and as such they can not touch me. I just wanna get rid of them because I shouldn't have to pay due to Paypal's mismanagement of my account. Any thoughts?
  3. Hi, To summarise, I listed some items using Ebay. They withdrew these items for whatever reason after they were won by bidders that did not intend to pay. They then charged me £33 for these listings after saying that they would refund the charges applied as the listings were removed by Ebay. It has now been 3 months and all they keep saying is that they will forward the claim to the 'credit' department. What can I do? I have threatened them with legal action but as previously discovered, they're customer service is apalling.
  4. Hi guys, Hope someone may be able to help me with this. About 6 months ago I sold a phone on Ebay for around £170. Once the auction had ended the buyer transferred the money to my paypal account. I then promptly withdrew this amount as I needed it in my account and paypal happily debited my account with the money. About a day later I receive an E-mail from Paypal saying the payment had been placed in dispute and Paypal would get back to me. After a week of me E-mailing Paypal and getting nowhere they said that they were depositing the funds back to the buyer – my account was now $254 in arrears. have received several E-mails since asking me to bring my account back up to spec. I have gone back to them and asked them why they returned the funds and they have not provided me with ANY reason. I am now being chased by a debt collection agency. What can I do about this? I can’t really afford to pay back this money as I have sold the phone and Paypal refused to provide me with any reasoning over the r
  5. Hi, I am glad I came across this thread. I have had the exact same problem with a Novatech laptop I bought less than 2 years ago. I was under the impression I would not be entitled to any money. My mind is now officially changed, as mine is les than 2 years old! Could you let me know what sort of legal letters you sent PC World? I would be interested in getting hold of some templates. Mine cost £750 and is completely worthless!

  7. I agree. I went 62p over my agreed overdraft and they charged me £145. That was for a few payments they 'had' to make. It always makes me laugh when they send you one of those stupid E-mails, "Dear Mr Rowe, although there was not enough funds in your account, we have 'had' to pay them" yeah, cheers for that, here's a bucket load of cash! They also raised my overdraft limit for me, then lowered it without informing me and charged me an overlimit fee for the privelage. When I challenged it, they said they had informed me about 2 months ago. They never actually specified a date!

Could anyone please tell me if Smile usually acknowledge receipt by the internal messaging or by post? How long should this take? Also, can someone please let me know what address I should have sent it to, just to check I have the correct one? Cheers.
  9. I think I'm stuck on that point for now. I intend to open another current account any way once I claim back my unlawful bank charges. On another point, I sent the request for statements on Tuesday by recorded delivery. Do they normally acknowledge receipt of this request? and how long do they take to reply?
  10. I can't do that as I bank with Smile and have the loan with smile. Don't think I can cancel the direct debit. I still don't know what to do?? There appears to be nothing I can do to change their mind.
  11. Hi, Cheers for the reply. What would telling them to change it or change either the payment date or their statement period do for me? I mean, they could just say no, sorry 'our system' can not do that?? Is there any kind of legal talk I can use to make them change the payment date?
  12. Hi all, Question for any smile customer - Has anyone ever been charged £50 in one go for 'COMMISSION. UNPAID ITEM'?? That seems a little odd. Also, does anyone have a loan with Smile? I do and they decided to take the fee out a week before I get paid - They said their system could not handle the date change to when i get paid. Would that be truthful? That also seems quite strange.

  14. Hi guys, Hope you can help me out with this. I've been having some trouble with Virgin Wines recently. In June they sent me a promotional offer that clearly stated free £40 off a crate of wine. I read the T&C's very carefully and in fact noticed that in order for the voucher to be valid the total crate had to have a value close to around £80, which is fine - I thought - as their wine is of a good standard. Until............. 3 months later they delivered a crate of wine and charged me £58.99 for the privelage. I got straight on the phone to question the validity of this order. Their 'Customer service' operator advised me that in the Terms and Conditions there was a line that stated I had to join something called the Discovery Club and take a crate of wine every quarter, worth £58.99. I can not confirm this as I threw the voucher away, I am pretty certain this catch was in the small print somewhere on the back. They did promise to recollect and and credit me, which has not happened and this was on Monday. No one has attempted to recollect. What are my rights on this matter? as this catch was apparently in the terms and conditions on the back. This was not made clear at the point of sale though and I want to get my money back asap as I need to eat this month! Cheers, Jason.
  15. Cheers for the help. I am a little concerned though, as it has been almost 2 years do I still have a case if the laptop is not performing sufficiently? As I have accepted the goods and 2 years have passed I don't know where I stand. I would however like a laptop that you are able to have on your lap! Novatech told me you must use it on a hard surface - Surely that would be a desktop PC?? I wanted something mobile, could this be classed as misrepresentation of goods? As technically it is not as described as you can not use it for it's sole purpose.
  16. Hi guys, This is my first post since I discovered this website - Hope I can gain some helpful tips. I bought a laptop from Novatech for around £800, I think it was £50 for the 2 year warranty. This was in November / December 2004 so we are just about within the warranty. The problems I have been experiencing with my laptop consist of it overheating and shutting down periodically. I have taken it back to Novatech 3 times now, one time they failed to reconnect the keyboard so I had to returned. Do I have any right to request my money back as Novatech have agreed that there is a problem and this has not been resolved sufficiently? I have also been verbally informed the battery (PSU) is not covered in the 2 year warranty. Is that something I should check in the terms and conditions? or should the entire bundle be covered? Many thanks in advance for any help I may receive? Jase.
