  1. Hello and Welcome First of all don’t panic - you will soon have your money back in your hands where it belongs!! Yes…you can claim back your charges, even if you were late paying, even if you went over your limit and even if your DD Bounced!!! It could be a lot of banks and CC companies do this part offer!! However personally and for formal records I would send them this letter (amend for your own info) Thank you for your letter dated 24th October received by myself today, 30th October 2006. I accept your offer of £1100, as partial settlement of my claim, on the understanding that I will pursue the remainder through the court. I am confident that should this matter proceed to a hearing I will win, unconditionally. I will consider the claim to be settled in full, £1460 and will inform the courts accordingly when I receive payment of the full amount on the claim including costs, £230 and interest £524.60, and the removal of the default. At today’s date this is £2215.60 and is continuing to attract interest at a daily rate of £0.00022. You can play around with it a bit more but its a good starting basis for you. Remember the banks have acted unlawful you haven’t!!! Before you start anything make sure you read the FAQs and as many threads as possible as there is a wealth of information on here!! Before you begin, make sure you start your own thread in the bank forum you are claiming against. Here you will have other “experts” who know how that particular bank reacts. As you have already posted this one, I assume you already know how to do that! First of all, if you haven’t already, you need to get hold on your statements. You do this by sending them SAR letter. Also look for another newbie claiming against the same bank as you, that way you can do your claim together and support each other as the post drops through the door!! Sometimes the banks act awfully and you can get very stressed out by it all. But stick to your guns - you are in the right - they are not. Don’t let them put you off, that’s what they want to do!   3. Ok DG I may need to speak to you about this - as im confused as to what bit you now need help with? I have time, resources and somewhat bitty bit brains at your disposal - but what exactly do you want me to do? It appears that you have replied to both the courts demands for extra info and vodofons defence statement, so apart from waiting for a court date, what do you need? Court bundle? Sorry - for asking the same thing but Im getting confused as to what you need now hon - esp as other posters keep popping up bits and bobs which may be relevant to you or intersting but not required for this part of your claim?   4. eg - I paid my cheque into my hsbc account - however i hadnt used my Natwest account for over three years. Technically though - they would be within their rights to demand that your cheques goes into you accoutn to clear the overdraft off as od are repayable on demand and they could use this a s an opportunity to do so. Im not saying they will but they might - however look at it as becoming debt free!!
  5. Hiya dellar Here we go agin honey!!! Im really surprise at the way this has turned out for you as Ive completed a few claims aginst Cr*p1 and they all followed the same suit. 1. Have you checked you statements - as they usaully just stick the refund directly onto the card whether you except it or not? 2. They usally refund all the charges down to the £12 Oft limited after Prelim - does that fugure equate to your offer? 3. Usually get snotty leter refunded the remainder after LBA. 4. Did you send your letter recorded? Im not one for giving any bank or CC extra time but my thinking is, its not like them to not repsond so maybe your letter has a - gone astray or b - been held up in xmas post. Itmaybe worth phoning them just to find out if they have received your LBA - I would hate for you to start a claim if they have not received your LBA. However if all of above checks out - then let the games begin!!!!!! The POC that are outlined in thelibraries are perfectally fine Ive just had a quick look at them and cant see why you would have to amend them - its just says account and not bank account, so its all the same thing.   8. Dg I could find you POC in the attachment you sent me any chance you could forward it again. Becaus eithinkyou ar right this basically should be a straightforward breach of that act. And its a case of who presents their case the strongest in court - though I dont know how VF can evidence a non breach - have you had privy to the defence yet (im geting a bit lost on this thread now). Apologise in adavnce for any repetition - im just trying to get this back on track, for my own sanity!!

  15. i Know what you mean HSBC offered me a mortgage all I had to do was suplpy payslips and have a valuation done - at the same I was claimignmy charges back from them - guess what happened....... Had phone call from them last week saying the offere had been with drawn due to internal credit scoring!!! Which is funny as I had passed both internal and external credit scoring around 6 weeks ago!!!!! Nothing to do with charges then eh!!

  17. Hi Muggins just to add on your thread - dont panic!!!! and for all you other who dont know -Im playing sweet revenge on Cobblers. AS you may or may not be aware they are due in court on 21st Dec, but as they have settled Ineed to submitt my notice of discontinuation. But do you know what My babies are poorly I wont be able to get it too the court until the day before - poor old cobblers have writen to me - I think they are panicing now what do you think!!! This ones for us all guys!!!!

Wooly wanted me to inform the court - so I sentthe wooly a photo copy of teh discountination notice (carrot and stick) with a note on the copy saying the orignal will be sent to court on transfer of funds - even ift hey send that off to the court, the court will contact me anyway as they did my other case!! hee Hee Gawd so close eh abi?
