I have just finished my claim with this bank, but I decided to stick around to see if I help others like you who are just starting out with their claim to see if I can share anything to make your journey through this claim a bit better!!! Remember the banks have acted unlawful you haven’t!!! Well done for reading the FAQs and continue to read as many threads as possible as there is a wealth of information on here!! Before you begin, make sure you start your own thread in the bank forum you are claiming against. As you have already posted this one, I assume you already know how to do that! First of all, if you haven’t already, you need to get hold on your statements. You do this by sending them S.A.R - (Subject Access Request) letter. Remember you can claim back for the past six years, including closed accounts, mortgage, credit cards, car finance, loan accounts and even accounts that are with Debt Collection Agencies and Bailiffs!!!! http://www.consumeractiongroup.c o.uk/forum/bank-templates-library/516-1-data-protection-act.html If you already have your statements then you can start by sending them the Prelim letter. http://www.consumeractiongroup.c o.uk/forum/bank-templates-library/671-2-letter-preliminary-approach.html Remember its important to open a parachute account, especially if the charges are spiralling out of control and you have little or no money left, at the end of each month. Sometimes the banks act awfully and you can get very stressed out by it all. But stick to your guns - you are in the right - they are not. Don’t let them put you off, that’s what they want to do! Yes…you can claim back your charges, even if you were late paying, even if you went over your limit and even if your DD Bounced!!! Remember the banks have acted unlawful you haven’t!!! Ive just finsihed my claim with the Woolwich but Im sticking around to see if I can help others just starting their claim like you!! Heres the prelim letter you need to send them.   13. Right Spoke to my nice Women in Wooly solicitors - and surprise surpirse they write about to get back me!! Anyway after argueing about the interst again!!! Grrrrr - youknow they are demant you have to include the interst in your totals. Anyway new offer will be emailed today and money should go into my account by friday well well see they want me to send notice of discontinuation though today Hmmmmmmmmm What do you think guys!!
  14. In responce to your last query which you must have typed at the same time as me!!! It depends my account was £320 od (purely on charges) and Ihadnt used the account for 3 yeasr - in teh end it went through Crap quest and berkenwell and berk etc etc to try and get the cash back (even before cag - I felt that these charges and subsequent debt collection chasers were out of order). Anyway I digress, I got settled 2 weeks ago via cheque - and even though they put my old Natwest AC number on the cheque as long as it had my name on it as well I was able to pay it into my HSBC account. Im now going to write tothem to ask them how they would like their money back via payment into a branch or send them a cheque!!!!! I think if you use the accoutn on a daily/weekly basis its fair to say they will pay the cash into your account and you will be expected to clear any overdraft you have with them!!! Hope that helps
  15. Hiya debijay!! Its an intersting point you make here regarding the offer, one which I have faced myself throughout my claim. My feeling is though Im sure somebody will correct me otherwise. That I am aware that you have responded to their offer by formof rejection, I wonder what give cobberts the right to dictate deadlines? Afterall it is you who by way of being the claimant set the timescales and claim progression track - along with those laid out by the courts. As a defendant Cobberts have no right to dictate any ting to you. Now I peopl wioll say it does not lok favourably to a court of law if you donot respond to cobberts deadline but in my case alone I received the (paltry) offer the DAY BEFORE their deadline. What we must remember is the courts are run by law, and I think it would be foolish of us to start speculating as to whether a judge will strike out claim purley becase we did not repsond with in the defendants deadline to repsond to an offer. I dont know what on earth is happening with Cobberts atthe moment they seem to be scrabbling around tyhe dirt track to fin d ways of getting claism sturuck out and they are seriously running out of time and ideas. Keep your letters and keep to your or the courts deadline - at the moment they are the only one you are required by law to adhere to!!
