  3. Poor you, no wonder you are struggling. Well following on is a link to one of your questions about long standing debts. You just have to deal with things one by one so CCA all the cc accounts. Probably the first thing that will happen is that they'll start ringing you up both at home and as was the case when I had my own business at work. You then send out the harassment letters and never speak to them on the telephone. You will not get bailiffs arriving without any kind of court action and without the necessary paperwork. Same applies to the personal loans. Once you get these sorted, you won't feel so much pressure even tho like most of us here you could be responsible for the demise of a rain forest with the amount of paperwork. Default doesn't have to be sent recorded, its 14 days plus 2 for postage so looks like its ok on that point but they have only asked for the arrears? so if they have terminated, did you get a letter stating that? even if they could come up with an ok agreement, the arrears would be all they were entitled to and looks like it has been unlawfully rescinded.

  10. Your experience shows how important it is to have a paper trail. Never speak to them on the 'phone and if they keep 'phoning you send them the harassment letter. Did you have notices of assignment and did you get a default notice?
  11. Yes, they can use statements but it won't do them any good without an agreement. How long is it since you paid anything on it and have you SAR'd the original creditor yet, if not, do this enclosing a £10 postal order and not signing the letter.
  12. Firstly George how old is the Cap One agreement? Think it would be useful if the folks on here gave you an opinion on the validity of the agreement so you could use one of the free photo imaging sites to post it up so peeps can look at it. So as far as you know you have never had a notice of assignment? Any default notice? You could also SAR Capone enclosing £10 and not signing the letter, this could turn up some interesting information. They will probably try to put you off by asking for various forms of ID, never send originals!

Consumer Credit (Enforcement, Default and Termination Notices) Regulations 1983.pdf You might need to look at the 2004 amendment as well Valdez, and also its section 88 of the CCA that refers to default notices, got the latter from VJ's brilliant thread on his battle with HFO - going to have lie down in darkened room now:D

  16. You don't strictly need the envelope, its 14 days and as far as the DN from Mercers is concerned, it should be in the original creditor's name.
