  1. Hi JMS, I'm back - now your panics over:D - don't you worry you're far too intelligent for Crapquest, thanks to Postggj for putting your mind at rest. On a more personal note have been dealing with the threat of an SD for daughter from afore-mentioned, gracefully accepted Crap One's unlawful recission of contract, Crapquest have returned to "sender" quicker than the speed of light and Crapone now "looking into her complaint"! Keep in touch JMS, I take it Barry Davis is still off on his extended vacation:)
  2. Right time for a CCA request, £1. postal order and don't sign the letter,print your name or use the digital signature link. Keep quiet on not being issued with a DN at the moment and Subject Access Request MBNA, £10 postal order and don't sign, this should provide all the information on your account including charges. They cannot get any of the threats they're making without a court order, have a look at the legal successes forum and you should feel more confident. If/when you get the alleged agreement post it up using the free photo imaging site such as photobucket and ask for peoples' opinion as to the enforceability.

Hi, No don't wait for CCA response, check on this but I think you only have 18 days to get to court to swear in your affadavit for set aside,don't forget to do extra copies (3) because noone told me about this when I went to court with daughter and first nightmare DJ tore us off a strip because she didn't have a copy of the sworn affadavit on her file - grrr!! Don't be fooled either by Crapquest telling you it will be nullified or they aren't going ahead, its a ploy these DCA's use because they don't want to have to pay your court winnings. I know its difficult to do all this what with your job but its pay back time for them giving you all this hassle. Oh by the way that template is on the first link I gave you (I think its Anna's) post 95 by Postggj, adapt to suit. Well done with the spreadsheet, excellent idea which will further prove your costs.
  4. Well done JMS, thats fine but think you have to call crapquest a couple more times if you can. You have 18 days I believe from receipt of the SD to set aside. Do the CCA now as well. I know that Postggj did a template for an SD set aside, I'll have a look around and see if I can find it. All going to plan so far eh?

OK, you know from that link what Postggj says to do, i.e. telephone and ask to speak to him (withholding your number) don't agree to "him" phoning you back say you want to speak specifically to him, if they do put you thro, say that you will be getting the SD set aside. Repeat the procedure (sounds like a recipe doesn't it?) and then when this person is uncontactable you can use this as a further reason on the forms.

  12. Hey wobytide, you were entitled to lose your cool. Now they are ringing you at home, just say "in writing only" and put the phone down. If they keep ringing send them the harassment letter from the debt collectors library. Don't be ashamed, many people have been in your position and certainly CAG members will know where you're coming from but even peeps like Mr Arrogant himself (Simon Cowell) have had debt probs and look where he is now!!! Do the things I advised first, you can worry about the data protection issues later and you can at any time make a formal complaint to the OFT. Keep your chin up and for a laugh have a look at the cheekiness to DCA's thread.

  14. Well done for doing so well in the prelim. Below is a link to CCA 1974. Section 61 relates to the signing of the agreement. Section 60 is form and content of agreements and of course the very important Section 127 (3). http://www.passprotect.studio400.me.uk/Consumer_Credit_Act_1974.PDF Angry cat has come up with some good info and I'll return shortly with another link to a quote from Susan Edwards of the OFT which I hope will be of further assistance.
  15. Don't know whether these companies are reputable or not but you don't need them with CAG on your side. Hope you haven't signed any paperwork with them. Do you know whether they have requested a true copy of your executed agreement with MBNA. If not you can do this by sending the template letter in the debt collectors library enclosing a £1 postal order and not signing the letter. When and if you get an agreement you can, using a free imaging site such as photobucket post it up removing identifying details first for peeps to give their opinion as to its enforceability in court. You can also Subject Access Request for £10, this goes to the original creditor, the CCA request goes to the DCA, same thing don't sign and postal order. It can be a long and frustrating process but there are many success stories on CAG, just have a look at the legal successes forum on CAG, you like others on here can do this for yourself, you don't need an outside company to do this for you.
  16. Firstly, well done for dealing so well with this nasty bunch out of the blue. They should not be contacting you at work anyhow as this is against OFT Debt Collection Guidelines. Ask your employer should they telephone work again to advise them that employees are not allowed private telephone calls and this includes them! Secondly using the templates in the Debt Collectors Library fire off a CCA request to them. Enclose £1. postal order and do not sign the letter. When and if you get a reply (time limit 12 + 2 days) use one of the free photo imaging sites like Photoucket to post any agreement on here removing identifying details first to get peeps opinion on its enforceability. Also send off a Subject Access request which is in the same library with £10 postal order and again no signature. This should give you more detailed information associated with the account. Is this the first contact you have had from them, no letters? If they have bought the alleged debt there should be a letter of assignment and a default notice should have been issued by the original creditor. Have a look using the drop down search button for threads on HFO, you will soon gain knowledge on the antics of this company and its dodgy dealings.
