  1. right this is what I faxed.....not very legal sounding I know but it's what I felt ! Dear Sir, You advised me on the 26th October 2006 that 2 letters had been sent to me containing a settlement offer from your Client, Lloyds Bank. I have not received these letters and I am now taking this matter up with the Royal Mail who require accurate posting dates for both letters. Kindly furnish me with these dates please. As you are not prepared to negotiate terms of settlement with me or forward my letters or faxes on to Lloyds either, I presume that the original offer is the only one that I can consider, although I still have no written confirmation of this offer. You requested the whole month of October to negotiate on behalf of your Client but so far I have been the only one to make contact with yourselves via telephone, letter and fax. You placed conditions on speaking with me over the telephone and conditions of settlement but I have to remind you that I am the claimant and I will only accept your client’s offer of settlement, unconditionally and by payment of cheque to myself. I will inform the court on the 1st.November of your unwillingness to negotiate settlement during the month of October. Yours faithfully

Tom I'm in exactly the same baot as you mate, but they've supposedly sent me two letters now confirming offer of settlement..I'm faxing them to ask for the accurate dates of posting so I can ask Royal Mail where they've gone ! The problem is, mate if we accept all their conditions they'll jusy keep doing this to everyone and bully them in to accepting what ever Lloyds say to them.........I do understand your position though as if I'd accepted straight away, I may have had the cash by now !! but then going by their recording of sending things out, it would have still been delayed...

I inherited a basic fax today..someone was up grading to a all in one thingy so...I'm installing the bloody thing now......and if all's ok..I'll be faxing like a mad woman all night.......... ooh it's like getting a new toy for my birthday..it's a little philips one and seems basic enough mind you that's me the techno phobe speaking..everything's in the right hole ( forgive the terminology ) and I'm nearly ready to go..one more cup of tea and I'll be there...lol........ You should have seen me when mobiles first came out..my daughter still laughs at me.....but God loves a trier.......... My first fax will go something like.... Dear Sechiari.. I'm persuing a edit claim by Royal Mail on the 2 letters you've sent me, so kindly advise accurate dates of posting my letters with offers of settlement... Yes I know...it's tongue in cheek ! Now don't keep me, I must get back to my office..lol....

I had a reference number from them and MFT was in it and that's Mr. Thomas so I gues the best thing would be to give them a call and ask who's dealing with your case and are they in? nothing like taking the bullet by your teeth and speaking with them there and then ! You can also phone the court for guidance re timing of court date or pending stays, they'll probably tell you more than Sechiari......... Pits re Faipack, bloody swines..God I hope you hear asap re the claim............

No. no one said when to start negotiations but I figured that as Lloyds were asking for the whole month of October to negotiate settlement then I would initiate these negotiations and contact them asap on the 1st.........I sent the first letter 29th Sept so they would get it, but don't forget their inward mail goes through their "clearing dept" so they mightn't read it for a few days ! I've been faxing lately as they get it straight away. Even though I had the verbal offer a few weeks ago via the telephone conversation..they still havn't confirmed it in writing and the 2 letters they've supposedly sent me are still "on their way !" I'd phone and fax if I was you..... Is your contact Mr. Thomas? if so just keep trying he's always "out" 01273 205381 good luck Moos, any offers re Fairpack..any help what so ever ?

You'll find that when you get to the stage when you're trying to negotiate settlement with Lloyds, that Sechiari then act on their behalf and they do not have an email ( well not one they'll disclose) and all your communication will then have to be by mail, telephone and fax... and do bear in mind that most of us who are writing and patiently awaiting replies from Sechiari are having to cope with their "clearing dept" so even when you send or try to receive a letter counting the time after it was sent doesn't match up with the time they read it or in fact send it ! Sorry to sound pesimistic but it's from current personal experience !

I wish I'd had the cash spare when the kids were off last week, I'd have willingly taken myself and the girls into their offices and let the girls tell them what it was like each week when Mum cried through having no money , or last Christmas when we were skint on Christmas Eve...you know the "real life" stuff that they don't take in to account when they're behaving like -ricks..... A week in Brighton would have done us the world of good and satisfied my need to land one on Sechiari too.
  9. jazz, it's a tough one.. I personally couldn't sit on my hands or bite my tongue however hard I tried, if you read my thread..I have had some patience but it runs out and I can't tolerate their games so I had to phone and fax them....... If you decide to phone them, be prepared for the run around and who ever you want not being in.........now and then you'll be lucky and get to talk to someone but don't sweat on it good luck

We jump on to this rollercoaster and you know the first few ups and downs are going to be drawn out but consistent and then you have that long upward climb to the last one and on the way up your stomache is turning in anticipation for the unknown and it's such a steep hill to climb, it's seems like you're climbing for ever and then when you reach the top.....you close your eyes and seem to be there for eternity and then ...whoosh..you come down with such an adrenalin rush that you wonder what happened...just thinking it's all over and then Sechiari take you on another upward climb .....with you not knowing what's round the corner and it's then you think to yourself, " what possesed me to get on this rollercoaster in the first place?".and there's this rowdy crowd from CAG down below shouting......."don't give in...don't accept conditions ".......and then you realise why you've just subjected yourself to the bumpiest 6th month ride of your life...................you're claiming back what's rightfully yours and when the carriage comes to a halt, you can climb out, hold your head up, wipe the sweat away, steady your knocking knees and take your money and run.............. join the club and good luck mate Freebird x

  14. thanks CAro, a mixture of pain, shock and pride, even though she's a goalie she's a girlie-girl and just started wearing lip gloss and styling her hair..you know what I mean........so she's terrified of looking like a "boxer" bless her..... lots of TLC and Mum/Daughter bonding tonight...she's been on here chatting to her pals..and talking about her trauma is therapy for her too.. I'll get back to the bank biz next week and kick some Ass again.......
  15. I'll tell you why I ask..Mr. Thomas said it's not Lloyds policy to settle unconditionally and they wouldn't........so I just want to prove him wrong with a list........my next fax I think !!!!
  16. as crazy as it seems saga, I've even priced the fax machines so I can get one here at home !!!!!!! and the cheapest I've seen so far is Comet or Currys for £39......................... It's just so impersoanl using a Store's fax and then waiting on a reply...I don't know anyone personally who has one either so I'm going to try and get one ! I've been otherwise occupied in Hospital all day today ( see my thread) so SCM have been very far from my mind.........
  17. well I thought that today was going to be a "chill" day, driving over to Wales for some peace and quiet.......... Went to watch the 2nd half of my 13 yr old Daughter's match ( goalie in inder 14's Ladies team ) and her Dad had already watched the 1st half, but within seconds there was a major collision between my daughter and one of the other team players, they went for a ball and head butted each other by accident. both fell to the ground and my daughter blacked out,, her nose started to bleed and swell and when we went over to check if she was ok we quickly realised that her nose was not only wsollen but out of shape.....we whizzed her straight to Alder Hey where we were for most of the day. The doctor suspects it's broken but said we have to wait for two or three weeks for the swelling to go down and then go back to ENT, if it is disfigured after the swelling goes down they will operate. Bless her , she's in agony and has two big black eyes on their way t oo..........I'm keeping my eye on her all night and our little'un has gone to stay at Dad's tonight........she's having ibrbrufen and paracetomol............. I begged her in the hospital to take up Drama again and quit the footie but she loves it so much that I think I'm on to a loser....... Talk about the "trauma household" it never stops here ! catch up with you again soon, ni night.........
  18. breadline what a mess eh...I tooam at the end of my tether with SCM and Lloyds.......well that is if I could ever speak to Lloyds.......I'm sick of all this chasing around and being ever so polite to them..they deserve a big kick up their arses... if you have a look at my thread I've taken to faxing them lately as well as letters....... I'm faxing various dept. in Lloyds too this weekend....... as I doubt they even know I've written back with MY TERMS of settlement !
  19. as ever your letter is brilliant, you have such a great choice of words and expression..... I've been respectful and polite to them and Mr. Thomas but lately I feel like telling them to go [edit] themselves..to coin a phrase........ of course I won't......... they get me so wound up with all this stalling and uncertainty of dates of posting etc................. Your letter might just work as it's a new angle for them and they'll be caught short ! good luck x
  20. someone at Lloyds told me that he was one of the partners, so I guess he pleases himself eh......... I don't envy him one bit though, I couldn't do his job.....not that I'd want to, I just have too much of a concience to mess people around like him and his company does....... I have my own outlook on defence lawyers..............they're trying to get the bad guys off and they'd sell their own GrandMother to do it.........you've gotta be pretty thick skinned to be able to stand up in court and deprive a claimant or in other awful cases, sometimes the victim, of true justice........... So I wouldn't do his job even with all his days off and possible lavish lifestyle, give me honest working class any day !
  21. yeh that heavy grey textured stuff......that's why they drag their cases out so long.the extra dosh keeps them in fine stationary lol....and oh yeh..loads of days out of the office ....

I asked the same question of a somewhat " irritable " Mr. Thomas who just kept talking over me yesterday ! he wouldn't let me speak and when I tried to talk he said stop shouting at me..I wasn't, I was just trying to get a word in edge ways........When I sent the faxes I asked Staples if they would keep any replies for me and phone me if one came through, but they haven't....... SCM won't disclose their email addy and I've google searched to no avail......... I even told him I'd send him the money to send it by courier and he then went on again about not taking instructions from me !!!!!! He wasn't budging and just said I'd have to wait............. When I first chased up the 1st. letter he just said ok then...you trace it with Royal Mail......but if you remember they weren't even accurate with the posting date, first it was the Thursday, then the Friday then they addmitted it wasn't sent until the Monday ! This recent one is supposed to have been sent out Tuesday gone...but he also said that it went to their infamous "clearing dept" first !!!!

Laura, try not to worry, although it's a possibility that we might "have" to go to court, you can bet a pound to a penny if anyone had to actually go to court..there's be oh so much support for you and if it was a hearing tween yourself and the bank.......you wouldnt't be left on your own, everyone on here would do their damdest to help you out !

I agree Pete, I 've thought a lot about it and to be honest it was wrong of them trying to hush me up and frighten me in to thinking that if I came on here to discuss it and look for some support it would bugger up my claim..for Christ's sake, why am I frightened of them, what can they do ? see me in court......... I would hope that they would still keep to their word and offer me the settlement but take my terms in to consideration which are with no conditions attached and payment by cheque..........it's not like I'm arguing the amount, I gave in with the subsequent charges and any further interest that the court would perhaps add on.so what's the big deal...... Yes I know it's another stalling tactic................ I just thought it was right to share it with everyone so they could see what games are being played.......
