Hang on lads! To enable the process to work effectively you should follow the steps in the logical order. DPA 1st Request Letter B4 action (LBA) Action You do have to wait the 14 days (not working but calender) before sending the LBA. If you start going out of sequence you run the risk of losing the thread or possibly losing your case on a technicality. LOULA

Paul, They do not have to send you statements. They do however have to send you the information requested by you, ie. Manual Interventions, charges, etc. They way they send the information may be in the way of statements, or perhaps computer generated lists. Either way the information will be correct and be enough to evidence in court should it get that far. LOULA

Hi! Suggest you write direct to Empire, explain the situation and that you only have 1 TV (which was broken) and that the service was unacceptable. The courier company did not give the level of service which you nor they (empire) would expect. Make sure you tell them what you want by way of recompense. Suggest you call the claims person you dealt with again and ask for the managers name. If asked why and they say they won't give it to you when you explain, call back and say it is to write a letter commending the person who sorted out your claim so quickly. I know it is a lie, but sometimes if they know a complaint is coming in they will try and bury it away from the managers and supervisors eyes! Any probs, come back! LOULA

I am going to start lobbying people to buy direct from the companies not go through intermediaries....they seem to be getting fleeced for services which the intermediary gets paid by the insurance company to do! Anyway...enough moaning! 1. When did you get the letter saying about the £15 charge? After you had made the amendment? 2. When did you get the Key Facts and other letter from the PO? Thanks LOULA

Hi Colin, Why do they need you to pay within 24 hours? Did they specify how you are to pay? If you have no credit or debit card and work all day they cannot expect you to go to the bank and pay in money within 24 hours. As they made the mistake they should reinstate the DD and collect as usual. LOULA -
Moving this to another thread once it is started properly! But for now.... MMA Insurance (if I could show me rolling my eyes I would!) be wary. I don't like the way they operate to put it bluntly. Look at the T&C's of the policy you took out. I know the PO have a different set of rules for processing as they are not a bank and I think fall under a different category (will investigate). Come back once you (if you can) tell me what the T&C's say and I will find out which weasel at MMA to write to. LOULA

Panther You are correct. The overall responsibilty is for the owner of the vehicle to insurance it for the Road Traffic Act only. ie. TP only. If you drive some elses car and they fail to notify you that there is no such cover in place then you could rely on your 'driving other cars' extension if your policy carries one, this only covers you whilst the vehicle is in motion. If the owner drives and has an accident and is uninsured, hurts TP or TP property then his last insurer becomes liable under RTA law. Hope no-one is confused by this LOULA

Sorry only just caught up with this thread again. It is basically because the website put some of their commission against the product to reduce the costs but claw it back in other charges which we are now seeing in failed DD fees, cancellation charges etc. LOULA PS Dave, clear your inbox again please!!!! ;-)

Hi Robert! You say courier. Who is the Insurance company - Nationwide will have a panel of insurers they use? Did they put you in touch with a shop or company which deals with their claims and provides like for like replacements? I think it may not be the insurance company to complain to, but if you can give some more info, I would be grateful. LOULA

Thanks Stephen for that. I would also say, you must read the Tour Operators Terms and Conditions as these can have an effect on your claim and claim process. If in any doubt, ALWAYS, complain in the resort to a representative of the company or immediatley you return. Keep copies of all correspondence including asking the rep for copies of their notes before you depart the resort. Do not delay in sending in your grievance to the company. LOULA

Evening, Write to Matthew Wyles (have met him a couple of times and always found to be quite straight forward). He is the Group Development Officer at Portman Building Society and one of the Directors of the whole Group so covers the Mortgage Works as well. He is an ex Insurance person so knows the lie of the land. Hi Rowan600, Have you spoken to someone in authority at the mortgage works? Do you have the original fax or letter stillon your PC, names of the people you have spoken to, the dates, advise given and all written correspondence? If you have most of this, you should contact the CEO and demand the refund as it is their mistake. If you are unsure how to word such a letter, I caould help you and get the names of people in the mortgage works to write to. LOULA -

I have dealt with them as Groupama when I was underwriting this type of insurance. As I do not know the full details of the claim I would suggest that you think realistically. Have you claimed for the 'lost' part of your holiday? They would only pay out a proportion of the holiday cost as you 'enjoyed' some of it, i.e. the flights and accommodation of sorts. Then look at what your solicitor advised would be the level of compensation applicable to this type of injury and the degenerative nature. Finally think about the level of compensation you think is satisfactory for your family losing their holiday. Would another holiday of say £1500 be acceptable? Once you have done these sums that should give you an idea of whether the offer is what you were expecting and also if Groupama are playing straight. It is their 'job' to minimise the loss, but I have found them to be a reputable company and usually very straight with the claimants. One of the biggest losses was through Groupama, and they carried out their end of the litigation professionally and with curtesy to those claiming. I hope this helps.
