  1. I am drafting a letter to the OFT. The response from them will be a normal blah blah letter no doubt. I really appreciate your response Uncle 'B' and your comments, however, I will report the letters and send copies. There may be individuals who could end up being very confused and out of pocket. The letter will be posted Monday. I will report any responses. Thanks to you all again.
  2. Thanks gentlemen. Debt is an Opus credit card for £524 and is about 3.5 yrs old. The debt is listed as owned by Cabot. Have only just realised this after looking through correspondance dealing with other issues. I have since received letters and e-mails from Mack Hall. I will report this with copies of letters. Shall I inform Cabot? Or just report it to the OFT? Thanks again, much appreciate your time
  3. Hi everyone. Quick question. Is it normal for two DCAs to chase same debt? List of events~; 03.8.12 Cabot inform me that they will pass the account to Mack Hall 28.8.12 Cabot inform me that they will pass the account to Rob/Way 23.8.12 Receive Doorstep assement letter from Mack Hall 29.8.12 Receive Ring us letter from Rob/Way 11.09.12 Reduced settlement offer from Mack Hall This is causing me huge amounts of aggrovation. Who can I inform this is happening? Is it worth reporting? Any help much appreciated
  4. Hi Dx Many thanks for the reply. Debt does appear on CRA file as 'Queried' CC debt from HBOS. There is lots of PPI and associated interest. I am currently working on that. debt total 11k. If two CCA's are received which one counts? There are no dates to either of them. The letter received from 1st informs me that a true copy of the agreement is enclosed. Which one is true? Surely only one is correct? Are there issues with this response? I'm probably chasing my tail with this but it all seems odd. Have 1st messed up? Will repay but just checking their response.   5. Good afternoon everyone. In need of some guidance. Brief history: Requested CCA details from 1st Credit early September. After two weeks or so, received poor photo copies of statements, no CCA or other details. Sent another letter, RD, asking for CCA and other details. Received letter from 1st saying the documents were being requested. Received today, letter from 1st saying they have fulfilled their obligations enclosing CCA and other details. Here's the thing. I have actually received TWO Credit Card Agreements. On first flicking through I thought that they were copies of the same thing. The two agreements that were sent have the correct information re the parties to the agreement, however, the Key Financial information differs considerably. The APR on the two agreements are completly different. The interest rates on the table contained on Other Financial Information differ hugely. The wording in the Key financial Info section is also different. Its probably all legit, but my question is.. . How can I have two different agreements for the same account? If there was a change, surley there should be dates on the agreement as to when they changed? Any assistance much appreciated. Thanks
  6. Hi Brig. Please accept my apologies for the delay in writing, havent been too well. I'd like to cinfirm a few things, think I've confused the situation. 1. MBNA (CC) has defaulted early 2008. Cant confirm as there are absolutly no references to the account on any of the three CRAs. It appears to have completely dissapeared. This account is not live. 2. Sorry again, it was a Halifax account (CC) being chased by 1st credeit. Have asked for CCA. They have sent me copies that show amounts and a name, address, limit. They do not show the rates of interest or other such info as is normally thye case. I have written to them stating that the documenmts received are poor and are not compliant with my request (Thank you for your advice on that one) In this letter I also stated that I needed a copy of the agreement. 1st have appeared to have taken this last request as a complaint. Today I have received a two page letter telling me that I should have no real gripe with the statements and should confirm my isssues. This debt again, although defaulted around mid 2008, does not appear on any CRA. It again has disapeared. I would just like some clarification. I intend to repay this debt, albeit by very small payments, but where do the DCAs stand withregards to court if the debt does not appear anywhere? even though the default dates were some three/four years ago? Have I some huge defence shpuld court proceedings rear their head? Any help is much appreciated. Thank you 2.
  7. Hiya. Thanks for your speedy response. The two debts are: 1. Credit card with MBNA. Last payment made six weeks ago. I am in the process of requesting CCA. Am dubioius of recieving correct info back as agreement signed early 2007. 2. Credit card with B/C. Last payment September 2009. Have requested CCA from DCA who have sent me dubious phtocopies of statements but no CCA. I have sent an 'In dipute letter' explaining that the CCA wasnt with the paperwork I received. They have replied telling me that they wil 'pass my request to the relevant department'. Not sure what to do, reading the info out there is a tad confusing. Finding myself in this situation as my Progressive MS is now progressing. Got to find alternative housing as permanent wheelchair use is comming. Everything up in th air! Any help is gratefuly accepted. Thank you
  8. Morning everyone. I need some assistance please. I am being chased for two debts. Both do not appear on any of the three CRAs. The amounts do not appear or anything like them. I am aware that when debts are sold the new owner appears next to the amount. This is not the case this time. They do not appear in any form. They have gone! My question is this.....If they do not appear, where do the DCAs stand? Whats the legal standing? Do they exist? Can the DCAs persue them via court action? I have been looking through some threads but cannot see and apropriate response. Could anyone give me some direction as to where I stand? I'm a touch confused. Thanks in advance to you all.
  9. Hello everyone. I have gained vast amounts of informed opinion on this site with regards to debt and associated issues. I'm now chancing my arm if any CAG 'er can help me with a more pressing issue. Please allow me to put you in the picture. I was diagnosed withMS 20.12.11. At that time I could walk in a straight line although I lost my balance slightly when I got up out of a chair. As I chat now, I cannot walk without crutches and any distance greater than 20 or so steps I now use a wheelchair or motorised scooter. I have bladder issues and am losing strength in both of my arms and legs. My motor skills on my left side are diminishing and I have speech issues. My memory is only marginally better then that of an octaganarian goldfish! I was moved to ask for help as my Neurologist and MS nurse, on a visit on Tuesday, told me that I must now look five years plus into the future. They both said that single floor living was now an imperative, at present I now live in a house. I have thought that this will be the case as my condition has moved on considerably in the past nine months. However, this is where the problems for my family and I escalate hugely. I will not bore you all any further as I will now cut to the chase. If we sell our house, we may have 18 months or so rent available if we are lucky for a suitable home to live. My brother has a home that is big enough for us all but is designed in such a way that for all intents and purposes can be used as a one bedroom bungalow for when the time comes that I am confined to a wheelchair. There is enough room in the home to turn a downstairs room into a wet room for when my mobility is poorer than it is at present. It will be very Important that my brother receives rent for this property for many years to come. I have not worked for some 11months and my wife spends many hours caring for me. If my health professionals are correct, these hours will increase four fold in he moving few years. Q1. If I was to move my family and I into my brothers home and pay a years rent to him and spend the residue on adapting various aspects of the home to accommodate my various forthcoming needs, will I be able to apply for housing benefit to enable my family and I to have somewhere to live. I have heard that there are concerns that renting a family members home is a no no as I understand that local authorities are very suspicious that there may be collusion between the parties. A train of thought I totally appreciate. Q2. Is it worthwhile contacting the heads of my local authority and those surrounding us and asking hem for their views? Q3. We have looked at various properties in and around the local area and have tried to find one. However, my increasing disability and the consequential increase in the level of care my wife has to provide, we have learnt in no uncertain terms that we are not prime new mortgage customers! I have sounded out various persons but no one can point me in any real direction. We have been peppered with various things over the last few months, however, his is the one that is concerning us the most. Please accept my apologies for the long winded introduction, I thought it apt to provide some background. Thanks in advance for any help me pointers. Regards

It rang some bells as my logic would be that if you had the correct documents, one would hope that thy would send them so as to get the recovery ball rolling. And as you mentioned I'm wondering how many departments these people have! Ta Brig, will let you know how it goes.
  11. Hi Brig. Thanks for the reply. I'm back for more unfortunately! Brief history so far: Halifax cc debt passed to 1st cred. Recieved aggressive letters from 1st and letter offering 5per cent discount. Requested CCA with library letter. Recieved some iffy photocopies of what appeared cobbled together info. No interest or other info on statements. There was no CCA enclosed, just a memo type thing telling me to contact them immediately. I didn't. I sent another request stating that the CCA was not Recieved and updated them on the dates for their obligation. Today, I received a letter thanking me for my recent correspondence. Ad surprisingly they have passed my request to the appropriate department? Not sure what department it has been passed to. I'm now considering sending the letter saying the account is in dispute and they have failed to meet their obligations. Is that correct? Today was the last day that they had to supply the info. Checked CRA again and the debt does not exist in my report. Just wondering what your thoughts are with regards to the response from 1st and my idea of sending the letter? All previous correondance to them have said quite clearly the account is in dispute. If you could have a look at my waffle Brig, I would be very obliged. Thanks again Brig.   12. Told you it wouldn't be long! Just a quickie. If the debt does not appear on the CRAs can it legally be enforced? I have asked 1st Credit for my CCA. All that was returned( admittedly within time ) were some photocopies of statements. They did not send anything else. The attached memo type thing instructed me to ring them ASAP. I have not. They have until this Thursday to supply all the required info. If that does not appear I will send them the next letter. I am not evading this debt. The amount that I will repay on a monthly basis will be very small due to the advent of progressive MS. I am aiming to be prepared with as much info as poss. This DCA was very aggressive in their approach. It is my intention to ensure that they jump through as many hoops as is legally required before any admission/offer is made. this debt also has plenty of PPi and charges associated with it. I hope this all sounds understandable. Thanks in advance.

  14. Back again! Just checked EQUI/EXP. The MBNA debt registered as settled is 9k lower than the one that is being paid! I can appreciate that the debt appears as settled if it has been defaulted and moved on, the same amount appears as a default under a different owner. This one, along with another which is being chased does not appear (ie the amount and alledged owner) at all. Whats the stand point on debts that are being chased but do not appear in any form on my credit report? I'd be intrigued as to the position the DCA is in. Thanks to you Brig and all the other guys. This site has opened my eyes and has armed me with the correct info to move on. Thanks Caggers!
  15. Morning everyone. Just wondered if there are any thoughts with regards to my last posts. Have drafted a letter saying I have no CCA. And that they have untill 27.09.12 to supply. I have also stated that the account is still in dispute and any legal action will be viewed as unlawful. Is it the right thing to do? Thanks in advance

  17. Hi dx, hope you are well. I wont bore you so I will be as salient as poss. Halifax CC debt. Purchased by 1st(31.07.12 as per their letter threatening bankruptcy). Debt 11k Last payment on account 25.11.09 as per statement from 1st, no payments since. I have progressive MS and my family and I have had our lives/future changed. Sent letters to Halifax around 7/8.09 explaining situation was not good. That has been my only contact with the OC. Just been through statements and there is definately no signed agreement/t and C's. I have just drafted a letter to ask for the C/A and sai that the account was still in dispute. Is it worth sending? Thanks in advance again dx. Much appreciated
  18. Appologies, a point I forgot to mention. I have checked all three CRA's. The debt does not appear on Equifax or Experian at all. It does show on Noddle however. Does this help my case? It does seem very odd. Thanks again to anyone who can help.
  19. Good morning everyone. I have just received a large envelope from 1st. It contained a large bundle of photocopied statements which, apart from having no OC markings on it appear ok. However, there is no corresponding credit aggreement (signed, recon or not), no terms and conditions and no details with regards to interest rates. There are, inevitably, PPI charges and corresponding interest charges (charges I have not yet reclaimed). Do I send a letter asking for the T & C's and aggreement? Is this a sudfficient reply from the DCA? I do not wish to evade the debt, my main aim is to be armed with enough knowledge so as to have my very small payment accepted and that the DCA does not progress the litigation issue (bankruptcy etc). I would be extemely grateful for any help and guidance. Thanks in advance
  20. often not up to date and many lenders do not report to them! The Settled entry was when the debt was sold on. Yes check Experian. Thanks Brig'. I've now checked all three. The only debt with MBNA is settled. There are no other debts with them, even with other DCAs. There are no other amounts even similar to the CMC amount I have been paying off. I Have had a card, but that was some time ago. There are no amounts similar to the amount being chased. Think I've been taken for a ride. Shall I stop paying ? Sorry if the reply appears odd, haven't quite got to with things yet! Thanks in advance Brigadier.
  21. Cheers dpick. Nothing seemed to add up. The letter was full of when and ifs. Nothing about all this adds up. I've checked Noddle and Equifax, the debt appears with Noddle but nothing on Equifax. Re the 12 days, is there another letter that should be sent after then? I'm not certain.   22. Morning all. I'm after some advice....again! A request to 1st Credit for CCA and statements was recieved by them on 10.09.12. Today I have recieved a letter telling me that they ' will advise client/OC of my request...these documents will be sent to me asap'. Strangely, the next sentence reads ' The information will be sent once it is recieved...' and my account will be placed on hold. 1st credit then, as the letter states,' will expect me to contact them immediately ' What does this letter mean, it all seems up in the air?   23. Good morning everyone. Need some guidance please. I have been paying CMC a monthly amount for around 14 months re a c/c debt with MBNA. I have looked at Noddle ( no debt with MBNA appears) and with Equifax ( MBNA appears but shows as satisfied 10/08). No other information regarding a debt with MBNA is showing. Can anybody help me to make sense of this? I'm a touch confused. Should I check with Experian? Any help much appreciated.
