Wow - i had no idea that it would cause so many problems - i'm really sorry but i had no idea which place was the best to post to get a response - i didn't realise i was "geeing" anyone up - i just want some help and advice and i'm not sure how this forum works. I really meant no offence and didn't know all of the different forums were linked. If you could let me know which is the best place to have this i will post it there and remove the others - i just want to get some help with this extremely stressful situation. Apologies agian

Hello, I'm really struggling to get some advice about my situation and hoping someone here can help. 1st Credit Finance limited have registered a default on my call credit, credit file for "bank" for just over 2,000. This is impacted my application for a mortgage. The issue i have is that while at university I opened 3 student bank accounts and run each of them very badly. Exceeding the agreed overdrafts and then continuing to spend on them by using my cheque books and garentee cards. This was 6 years ago and should have come off my file, which i'm assuming happened with the others. 1st credit have registered the default as march 2006, which is definately way after i originally defaulted on all of the accounts. To date i have ignored all corresondance from 1st credit but now i need to sort this out as I have completely turned my financial situation around and i want to be able to buy my house. If i pay off this debt it will show on the credit file for another 6 years, whereas if i can sort out the default date then it should be removed from my file. What i really need to know is: 1. Are overdrafts (unauthorised expenditure) covered by CCA's? 2. They have not stated which bank this is in relation to, so will I have to send a SAR request to all 3 to find out when the account defaulted. 3. How does defaulted accounts work with overdrafts? Is it when i last made a payment into the account, 6 months after that, or when the bank passed it on to the debt agency. 4. Do i need to start corresponding with 1st Credit finance I am sure that this was definitely more than 6 years ago and i need to get them to admit this and remove it from my credit file. Any help you can provide me with would be greatly appriciated. Thanks in advance

  5. Thanks for your reply. I've drafted a complaint letter in relation to the debt that is not in my name and is over 6 years old. The biggest problem I have is the biggest debt that apparently defaulted in March 2006. I have a mortgage application pending which is waiting for me to sort this out. Long story, but they initially approved me but then somehow got wind of this shared data and have now put it on hold until i sort this out. If i contact the credit agency who is holding this debt to make an offer of payment and clear the debt, this will be on my report for another 6 years, where as if i keep my head down for another year then that will be totally removed from my file. If i make contact with the agency then that will put a stop to any statute barred time that i have already accrued.... I have no idea what's the best thing for me to do is. I'm just really confused about this shared data thing as there is nothing showing on my experian report. Any more advice you have would be gratefully received.. Thanks

It is completely clear apart from a section on "share data" they define this as data that can be viewed only by companies tat sign up to their share data group. The problem i have is that i have a defaulted bank account for 2,651 which i thought defaulted over 6 years ago, however it states on here it defaulted in March 2006. There is also another account which defaulted in august 2005 ( so over 6 years old) and is associated to me even though the name is not mine, but very similar. No idea what this is in relation to. I really need some advice on whether i need to try and make an arrangement to pay the first one (make an offer? if so how much?) and what do i do about the other one? Thanks in advance

I recently had my Mortgage application approved and we were finalising the last bits with the solicitors when the bank contacted me to say that they had done "further checks on me" and found information on a call credit report for 2 addresses I lived at. One from 9 years ago and one from 6 and a half years ago. I have a clear experian report. I did default on A LOT of credit, most of which i wouldn't be able to tell you who i owed, however this was all over 6 years ago - and although i've not made any payments at all in relation to them, my understanding is that these should be wiped off my credit files now. Also these addresses shouldn't appear on any check now either. I've tried to obtain my call credit file but it has not been posible using their online options and i have had to post off for it. I have had no response to my emails to them either. My questions really are: 1. Can this happen, can a lender take this information into account even when they have acknowledged it shouldn't be on my file? 2. What's the best way for me to tackle call credit? 3. Any other help/advice you can offer me!!!! Thanks in advance
  9. Thanks dx, that's what i thought. Just so confused - not even sure the report is coming as call credit site was rubbish and couldn't verify my details and i had to send off the postal request. So why is the bank listening to this additional info? Surely they should know that this debt is over 6 years old and shouldn't apply to my application - especailly as they originally approved me. I've sent the bank my experian report which is totally clear so i'm hoping that will help. It's all so frustrating. I can't understand why they have "come across" this information after they had approved me. They said that the information came from their london office - but why? what was the trigger - do you think there is a potential dpa issue here?

HSBC definitley use call credit as I've just been refused a mortgage with HSBC (although initially approved) because of something on a call credit report, when there is nothing on my experian report. I also have banked with HSBC for over 6 years!!! I'm struggling to get the report from call credit so i'm at a total loss!!
  11. I've beeen told today that they hold adverse credit information on me dating back over 9 years - but noting appears on the experian report i had done. I tried to obtain their report and have not been able to get anything online despite making the £2 payment several times and signing up for the £12 deal!! I have sent a complaint but i still need to see what they hold on me. I was also told they could not verify my information - i'm at a total loss as to what to do now!
  12. Hello, I'm new to this and will try to keep this as short as possible. I got into A LOT of debt whilst at uni. I had 3 studant bank accounts and ran up overdrafts on all 3 and went over what the agreed level by quite alot by using cheques. I had no choice if i wanted to stay at Uni and had quite a difficult time financially also running up credit card and other debts. This was back in 2003/4. I buried my head in the sand for a couple of years and then got a job. I wanted to clear the debt and contacted the banks and they all informed me i had no debt with them (I'm assuming that this is because they had sold the debt on!?) I tried a couple of debt collection agencies but no one knew who i was so i stuidly left it. I have since sorted out my finances and have a good job and a new bank account. I even braved doing an experian report which showed Nothing - i then applied for a mortgage. This was accepted and then i have been contacted to say that they have withdrawn it due to information they had just recievd from "call credit" i've never heard of them. i've asked for a credit report from them. All the bank would tell me was that the information was "really bad" and against an address i've not lived at for 9 years and one other one that i've not lived at for 6 years. My questions are these: 1. I have not acknowledged the banking overdraft debts or any others for over 6 years - are these all statute barred 2. Why are they still holding adverse information against me for debt registered over 6 years ago 3. Why experian shows a clear report but this call credit does not 4.Who are call credit 5.If i do have to pay the debt - will i be able to find out who i owe it to from the report as the banks don't know anything about it 6.what's the best thing for me to do now So stressed!!!!!! Any help will be really appriciated
