Thankyou for reply ims, and Dx for your advice, i clearly need to study more, i don't know what soc means! so embarrasing. the only interest figures i can find on the date when i cancelled this loan are, = special purchase interest of varying between £3.45--£5.93 there is another interest called Special rate=0.562% it was a credit card, i have found the template letter, as for a covering letter, can i start with this? To Bank! Dear Sir, Firstly I would say that I am disgusted that your once honourable institution, took the decision to make profits from customers, by way of imposing an invalid agreement for PPI, to the Self Employed! Which appears to not be means tested, In the way the original applied for loan supposedly is. It has been discovered that This PPI is mis-sold, as PPI would not be paid out to Self Employed! While it would appear to be your requirement to ensure customers are able to meet re-payments of only the loan agreement, It may be obvious that to impose extra costs for what in effect would be useless for any S/E customer, and would obviously prove to be disastrous to any small business, Therefore this would appear to be a trap, to ensure that the result will inevitably be a shortfall in available income to the customer, thereby allowing extra charges to be made on the inevitable, late payments charges, interest payments. etc.etc. In my own situation, because of the dishonest way the banks have behaved, I now find myself punished by a poor credit rating that I will have for the rest of my life! Along with many other hard working honest people who put their trust in the banks. This has caused me and my family great Hardship. Surely this can not be seen as treating customers fairly as required by BCOB!any advice welcome, thankyou Ro

Hello ims, in hope you are well, i'm afraid i am back! in the hope of continuing this rather small claim, apparently i am deemed to be as good as i'll get! i would like your help if you are able? i need to re-learn a few things, i would mention the details of my claim above, this is a very small claim, but the way i would like to learn is by doing this one first, i also have others with Cap one,for much larger amounts! i have some questions if i may, has the interest amount changed from what i have above in doc1 pdf, i lost a lot of info because pc crashed in the months past, but i have all the statements for this particular account now, i think i read somewhere that it may not be neccesary, to send a SAR in future to other banks re PPI, or is this wishfull thinking on my part? Thankyou for the Templates, Template one is for me as was S/E. should i send late payment fees and interest payments seperately on a seperate cis sheet, from the PPI claim, once i get this one done i am sure i will be able to move on with the others by re-ferring back to this thread! Hello Honeybee, Thankyou for your reply,The paperwork is the problem, a big problem in fact, sometimes i just sit and look at it,i am surrounded by it now,, however as you say there is a tremendous amount of help here, ims has helped enormously, and others, i feel once i have done one claim, i will get in the swing of things, and soon be able to cope with the rest, One thing i hate is injustice, and i am writing what will i hope be the 'start' letter, to go to all banks etc, the fact is had i not been mis sold PPI and with the knock on effect which is the cause of so many problems, i would not be in the position i am in, i feel i need to say so. i am owed a lot of money, yet i have sat on this for too long while i had my treatment, however i feel now is the time, i know are template letters on here, i can use, but i believe more needs to be said,! if the banks were cowboy builders, they would all be taken to court, yet they get away with letters going back anf forth, but are not really in my opinion bought to book! they will still try and keep the money they have stolen prior to six years if they can! it is wrong. i feel strongly that it should be law, they automatically pay everyone back the money they have effectively stolen from customers, they should not be above the law! They have done so much damage to people, honest hard working people who now have a poor credit rating, through no fault of thier own.because of greedy banks, sorry getting carried away now, thankyou HB and Best Wishes Ro

Hello Lilly, So sorry i missed your post! i hope you have recovered and your month off has beem benificial to you, i have finnished all my sessions, though i had to have extra appointments, But i certainly feel it was good for me, i had a most abnormal childhood,being born in a war zone, moved to a safer place, then the safer place being bombed as well, all before 1 year old, being snached, kidnapped, attacked, abused, suffered arrested developement! used as a defence by my mother against the man who i thought was my father but was not!etc etc, to being attacked by the Tax man! etc. However i have realised that i cannot change the past, and i feel that as much as i can, i have put so many things where they belong, in the past. i do feel i have more improvements to come, as i accept the past! i believe it is in me to view myself from the outside, to watch me progress and not allow the past to drag my back from a brighter future.i do get a bit woolly headed sometimes,i am a pretty good manual worker, it's the paperwork i have avouided for so long now that causes me difficulties. But with help of CAG i hope to gradually get on top of things, even though i am totally out of my comfort zone,Very Best wishes to you Lilly, Ro

Sorry to bother you with this, I am now apparently as well as I will ever be, following months of treatment, but admit to being easily confused, It may be that I have missed a thread about the best way to proceed in view of PPI’CCLs With regard to the expected Bank letters, do you guys see this as a good thing? this has rather thrown me, As when I thought I would be well enough to cope with sending SARs, etc. to banks who mis sold PPI to me when S/E. There now appears to be another option, of waiting for the letters from banks, and expect/hope they include redress back as far as 2001? Could I ask what your advice would be please, (I do appreciate it may be too early to decide!) i need to know wether to start claiming,as used to be the case. or wait for several bank letters. regards Ro
  12. News today, Apparently the banks have been ordered (as i understand it) to write to anyone who has been mis-sold PPI. However they are not sure how these letters will be worded, personally i would expect them to include such sentances as follows= = Any money refunded for mis sold PPI must go to pay off any debts to them first! or similar. They, the banks have caused so much damage to people who sought advice from them, For instance, someone running a small business would apply to thier respected institution for a loan, that they have budgeted for! then they are forced to take out another one, which will not pay out anything if you are S/E. the knock on effect is unbelievably damaging to small businesses, and becomes a dept which multiplies, as time goes by, then on top of this, because of the inevitable overspend you are penalised further by interest charges! this is a bit like being sold something you don't need by a cowbow tradesman. It must be a good thing that the Banks are writing to customers, It is unfortunate they have to be ordered to do so, (it will be interesting to see the wording) But after all they should have been made to pay back all they have gained from this [problem] automatically, they know who they have effectively stolen from! It should not be up to thier victims to jump through hoops, or be forced to apply to get back what was taken from them, and what they are owed! Regards Ro
  13. Bailiff Regulations Brought In To Cut Bad Practices The way in which bailiffs are regulated will be overhauled in a bid to clamp down on threatening behavior and privacy issues. Justice Minister Jonathan Djanogly said the move would help protect vulnerable people and ensure that bailiffs carry out their work professionally.Under the proposals, the Government could ban the use of force against people and set out exactly when and how force may be used to enter premises.New national standards to ensure bailiffs are fit to operate could also be brought in."Too many people have experienced intrusive, expensive and stressful bailiff action and more often than not the public do not hold bailiffs in high regard, despite the fact most bailiffs carry out their work professionally," Mr Djanogly said."Last month we announced the first stage of reforms with new national standards and we are now unveiling plans for legally-binding changes that will clamp down on bad practices."We want to restore balance to the system, improve clarity for both debtors and creditors, strengthen protection for vulnerable people and ensure that individuals, business and Government are able to collect the debts they are owed - but in a way that is fair and regulated by law."The updated standards will include minimum levels of behaviour, including that bailiffs must not behave in a threatening manner or use unlawful force to gain access to a home or business, that they should avoid discussing the debt with anyone except the person owing money, and that they must withdraw when only a child is present.The new legally-binding regulatory regime, which includes new rules around the modes and times of entry, which goods are exempt, and what fees bailiffs can charge for the range of debts they collect for local government, courts and businesses also form part of the government's consultation.Encouraging! ro
  14. Sorry to persue this point, but i feel very strongly that banks lenders, etc, involved in the mis-selling PPI [problem], continue to get away with it! I personally am starting to recover from the worst of a mental illness caused by the damage done by being a victim of mis-sold PPI. Being S/E for 35 years, you have to trust what the banks etc. tell you, I was told more than once that I had to have PPI! Only recently to find out I should not have been forced to have it! Having been mis-led I was then in a situation of the Banks etc. bleeding off money from my various accounts. Effectively, Under false pretences. Or fraudulently! Or by Theft! Am I allowed to tell them that??? That is what it would be called if I did it!! On top of this theft, I was charged interest, and penalties, which led to more of my money going to them, I then ended up having to get another loan, and again Mis-sold PPI, this goes back to before 2001! Had I stolen money from anyone I would of course be in trouble with the law! How is it these once respected institutions can get away with trying to keep any money, effectively stolen from my accounts and yours? and even if it goes to court they try to get away with all money they have stolen before a 6 year date, in my case I am left short of money and in arrears at 69, is this Fair or un-fair treatment? I feel this is un-fair, is there a template letter to get me started? to refer to COBS, I have four of them to deal with! Any views much appreciated,Thank you Ro

  16. Could I ask, if the fact that I and many others have been mis-sold, PPI, with that alone causing serious financial problems! Let alone Charges, interest etc, and the fact this was done many years ago, does this constitute grounds for taking action via BCOBS as surely the above amounts to fraud!   18. Excellent Thread, I don’t believe we are designed to cope with all this stress! I don’t answer the phone! All the threatening letters terrify me, and has made me ill, and fearful of losing my home, this is all consuming. In my case having the nerve to run my own business, with the resultant attack by Inland Revenue, which did dreadful damage to my health in the first place, in spite of the fact, they owed me money! The damage had been done, and the resulting lack of confidence, and panic attacks, make it difficult in my present mental state, to even reach the first rung on a very long ladder to get justice. I am owed thousands! I will never understand why we the victims of fraud, miss selling, theft, etc, are put in the position of trying to fight for justice! To get what has effectively been stolen from us, returned! The onus should not be on us, the fraudsters should return all money plus interest, and this should surely be the law, Why is the law protecting them, and not their victims? Without CAG, And such helpful friends here, who give their time and knowledge, there would be no hope for the future, Kind regards Ro

Thank you so much for reply citizenB, I am using CCC.S who kindly did a I&E form, some months ago, and BC. said they would accept this, as did my other creditors, including freezing interest, so that is a relief, I don't have it in me just now to try and re-claim PPI, back from anyone, perhaps later in the year hopefully, I feel it is so wrong that it is down to the victim to reclaim what has been [Edit] from them, yes I did SAR to BC last September, my claim goes back to 2001 when they were the Woolwich I will reply again when I know the intentions of IDR Finance, and hold back on anymore SAR's for now, in the hope i dont get more transfers done, though i'm not sure what is best course,if BC move my debt on am i right in thinking i still claim PPI from BC? or have i made a mistake sending them a SAR when i was not in a state to follow it up immediately? Thankyou for reply CitizenB. bit of an update, following poor heath--Well some good news, I thought, all of my credit cards debts have been agreed with token payments and all interest stopped, I think this is as a result of the mental illness I am suffering from, on this basis, my thinking is = while I am still ill, I will not try to chase them for mis-sold PPI. overcharges etc. as they appear to be understanding of my problems, when I am able to better cope in the future, I will claim my money they fraudulently obtained back! I don’t want to rock the boat by doing so now! However Barclays wrote today to say they have agreed to transfer my dept to a company called IDR Finance UK.ltd, This has thrown me a bit, I don’t understand this. Could this mean this new company will chase me for more money now? Any advice please. Thankyou Ro

Bid to stop 'heavy-handed' bailiffs.The Government has unveiled measures to protect the public from "heavy-handed" bailiffs.Justice Minister Jonathan Djanogly outlined updated national standards to define acceptable behaviour.They are designed to tackle intimidatory and threatening conduct, and prevent bailiffs from misrepresenting their powers.Councils and other authorities will adopt the standards which will be used to set rules for any bailiffs working for them.Mr Djanogly said: "Bailiffs are an important part of the justice system so the few unscrupulous bailiffs must be stopped from putting people in harm's way or taking advantage of the vulnerable. We want to bring an end to the rogue behaviour that can make people's lives a misery."Whilst I know the majority of bailiffs are responsible, too many are not. We often hear stories, and see evidence, of people being mistreated by heavy-handed bailiffs.   23. Thanks for reply Bankfodder, I am a mug, I was told by several banking organisations I had to have PPI! Being self employed. I had to take their word for it, however their policy seems to have been, rip off anyone they can, to make as much money as possible from their customers by falsely stating they had to have PPI, or they would not advance any funds! And now we know this, however possibly still being a mug I fail to understand why the FSA, or law courts, continue to treat us all as mugs, by allowing these once respected institutions to get away with keeping their customers money, unlawfully, that they have either stolen, or fraudulently obtained. Or by stealth., How is it we the victims have to fight to get justice? And our own money returned? These institutions know they have our money, it’s in their records! Yet even if you win a case against them, they will still try and dictate how you spend it! I-e pay them first! Are these institutions guilty of criminal behaviour or not? If not criminal I don’t know what is! Should not profits criminally obtained by fraud, or stolen money obtained, be repaid? Without the onus being on the victim to try and get their money back? the result is we are all being treated as mugs! Personally this has made me ill, I cannot cope with fighting anymore as a result! I could lose my home, yet I am supposed to be in a fit state to fight for what has been stolen from me! I have not worked all these years for me, it has been for banks! That is not only a definition of a mug, but a victim of crime, why is it not Law for stolen money, plus interest,plus fines, to be returned to the victims? Regards, mug Ro
