  3. Hi All, just a small problem, but with very damaging results! A customer bounced a cheque on me, nearly 2 years ago, not a vast amount, but the point is i was only doing the work at a low rate in the first place!to help her, She got very nasty with me, and i felt that was a real kick in the teeth! this has made me ill, which is rediculous over such a small amount, but seems to be the way i react to things now! i believe i have up to six years, but something is holding me back, i no longer have the confidence, but is it difficult to use the court? This has gone on a long time, the only way i feel i will get over the upset is to try this route! Can i add interest? if so what rate? can anyone advise the procedure please? Regards Ro

Thankyou for replies, i have had tremendous help with PPI reclaims from ims.and others. i have sent off the first one for small amount! so i do know the process now, however i had two replies from them re PPI, one saying i am too late to claim, the other said they are looking into it! i did this smaller amount one to learn how, in the meantime i have had these rather worrying contacts from Moorgate stating that the outstanding balance on my MBNA account has been purchased by Britanica Recoveries S.a.r.l acting in the name of and on behalf of(Btitanica- Mortlake.) with a different account no!) and from Arden! Who state = Arden have been instructed by Moorgate Loan Servicing to recover an amount outstanding to them, and they have assumed responsibilty for working with me to repay this amount and therefore all communication should be via them! they also mention an Arden account number! I am retired, i had originally received advice from CCCS suggesting i pay a token payment to MBNA, which i am continuing to pay. Regards Ro
  5. I have read other posts, but have difficulty following since my brain shrunk! I am just about 69.= Old! I thought it best to start my own thread. I had an arrangement with MBNA, Who accepted token payments for a few months, following help and advice from CCCS. Wife and I do have other creditors, All have ripped us off in the past with Mis-sold PPI, both S/E, Had they not done so, we would not be in the position we are now! I am trying to get into claiming these back, but it seems that before I get into that, I have to defend us against the likes of Moorcroft, and now Arden, my first question is, should I answer the phone to Arden? Am I right in thinking I do not have to make a contract with Arden? I have continued paying token payments to MBNA, They have not asked me to stop! I have had much treatment for Stress and mental heath problems caused by Banks and Debts. Any advice to start me off gratefully received. Regards Ro

So all things considered, my wife and i have been put at a huge loss over the years, by MBNA Stealing money from our accounts under the guise of PPI Now they have sold the resulting dept to moorgate, who have employed ( i gather ) Arden, who keep phoning and which we ignore! we are still paying MBNA the token payment they accepted, What advise in view of Robbo's post above would you give ? To keep paying MBNA and not enter into an agreement with Arden? We are a bit at a loss as to the best option, if we have one! We have yet to try and claim back PPI from MBNA, The damage they did by their irrisponsible behaviour has a huge knock on effect to any small business, yet this seems to be totally disregarded. Any advise please? i would have dearly liked to have seen copies of Robbo's letters, but he appears to not have been on line for sometime! regards Ro

Yes ims, 8 weeks i believe. but they said in early April= that under the limitation act 1980 i am out of time to make any claim in relation to these charges, so i assumed there was nothing i could do, i lost a bit of heart then, however i do feel i know the process thanks to your help, Also if they do pay out, they then effectively set themselves a pesident as i see it, to enable me to go after other accounts, Ro

Thanks ims, i had a surprise letter today from them, stating that they will need more time to look into the situation,and that they will do every thing they can to reply in 7 weeks. so will see what they decide. It would give me a boost to get somewhere with this one, to spur me on to do others. Thanks again Ro
  11. Thanks for reply ims, Sorry for delay in reply, had another set back, Capital one have said i have to deal with Moorgate, now moogate say they have instructed Arden! Arden keep phoning but i cannot answer! i was able to cope just paying the £1 calculated by CCCS, Arden want £6000!And this is only the first of a few! However i seem to think i read somewhere that the fact that i have no agreement with Arden or Moorgate. thay cannot do anything! Can anyone tell me if this is correct please, As things are, i am still paying Cap One! £1 as originally advised by CCCS. Any advice please? very gratefull. Ro

  15. Hi ims, just an update, i had a reply, basically stating that they do not have to repay anything, because it is prior to 6 years! What i would like to say, is that it is disgracefull that this once reputable institution try and get away with keeping [EDIT] money! irrespective of what year it was [EDIT], it is still [EDIT]! But What can i say? The fact that for me this is a small amount, just to learn how to go about the process, does not matter, However small they [EDIT] it from me, which then incurred costs for late payment fees,added interest etc. in fact the whole thing appears to be a trap! But what can i legally say? i don't care how long it takes, i will keep going after them, the fact that they were allowed to continue getting away with this behaviour is obscene! wether befotre or after 6 years it is still [EDIT] money! Thankyou for your reply Lilly,I am so sorry that you were so upset, and left the place in tears, It would have been nice had someone known you were leaving while so upset,To take you back in for a while to try and comfort you.I note what you say about not discussing anythig really. i am normally very quiet, but once i started talking i could not stop, but i did notice i was repeating many things over and over, I found that fact helped me,it was if i had given my problems a voice! i did have a captive listener, but the talking was so important to me, i would switch from one problem to another and back again, and had to be stopped several times! but it did help me enormously, i realize i am not 100% ! dont know if i ever will be, i hope to get better still, but there are so many aspecs to modern life, which appear to be problems,in one form or another, I seem to have an enemy on faceless book now! trying to cause problems, There is always something to worry about. some may say -if you let it! but sometimes these things become all consuming, and then seem out of control.and blur your mind, I have just been for a 5 mile ride on my bike in the countryside. and that helps me personally,i cannot think of anything else when out on a bike, i am trying not to fall off! but it is a hobby i enjoy, and i am doing more of, as i see this for me, as helping to treat myself! it helps so much because i am fully absorbed in it and in an all consuming but positive way! It gives my mind a breather, so that after a break away, i feel more able to cope, i wonder if you may have anything like that, which may help you?   20. Hi ims nearly there now, on the SOC cis tittle should i add the letters PPI after credit card charges, before the line= COMPOUND INTEREST CALCULATION? Do i need to add a personal letter or does the template you suggested (post 64) say it all? and can i include a cis with charges over limt, late, etc along with the PPI one, or send seperately? is there a special address i need to send to? regards Ro

Sorry ims, could you tell me what the start date i should put is,today? and when end date would be, i have put 7% for APR, do i fill in compound interest, or does the sheet do that for me,? sorry to be a pain! brain fade! so sorry about all the hassle, it seems that all this would have been easier to sort out had i started on one of the larger amount accounts, it was the lack of any interest rates at APR on this one that has caused most of the problem.   24. Sorry ims. The confusion may be that the only interest shown anywhere on any documents for this account is the Special rate which as you say equates to 7% i have looked at another account and can see the interest rates, the reason may be this was a spacial introductory rate to get me hooked! which was paid off before the interest kicked in! Which may explain the confusion right from the beginning! So i imagine i put 7% for this claim? ,Regards Ro

Hello ims, in view of the above special rate of 0.562% only, would you advise that as there is no APR interest, ( This fact is what has confused me all along! i was looking for something that was not there!) i should ignore this (for this claim anyway) and just do the PPI claim, i note the interest in the FosRunningPPI v101.xls is set at 8% simple interest. should i leave this as is?
