  1. Rundles have just paid me another visit. I provided proof of repossession to the council nearly two weeks ago and was waiting to hear back from them. Now I've had Rundles at the door demanding £3k from me. I am unemployed and do not have this money. There was a smaller debt for the same council which I am paying at £50 a month for six months to clear it but cannot clear £3k in six months. What options do I have? I feel overwhelmed with one thing or another right now and just don't know which way to turn. The bailiff said he would be back. I also noticed that the letter the bailiff left says he will return to complete his action whether we are present or not. Are they allowed to enter the house while we are out or if we refuse to open the door? My daughter is really worried and so am I.
  2. Hi again. I wasn't sure whether to make a new thread or continue with this one. We are now 10 months into the new year with this problem. I had a couple of conversations with the council and email exchanges. The flat sold in April and a payment was made to me by the lenders. Stupidly I assumed they had paid any liabilities associated with the property but I'm now finding out they do not do that. The council tax debt is still there as is a small (£600) water bill - for standing charges as flat was unoccupied. I will query that as it seems a lot. The council tax bill is around £3k and i think that is over three years or part years. I notified the council that the flat was repossessed in September 2015 and sold in April 2016. They have asked me for the original court papers to prove that. I can't find any such papers anywhere. I have probably had them I guess but have no idea where they are now. Because I haven't yet provided these, they have asked Rundles to chase me for £200+ of the debt. I called the council and expressed by shock at this action etc but they said I have had long enough to sort this so (basically) go away! I called Rundles and arranged to pay the debt over six months at £50/month incl their £75 fee. When I went online to make the first payment commencing a week later as agreed, I noticed that Rundles also have all the other c/tax debt for this flat. So they will come after me at some point for the remainder and I will not be able to make any offer of payment. I have been unemployed since April but before that was only getting £400/month sick pay. So effectively I've had no proper or sufficient income since December. I used the equity to pay rent and bills and paid for a little holiday for my grandkids. That's it. There is nothing left. I am going to be receiving benefits as of next month. I am 60 now and have struggled to get work - can't even get an interview. Can't even get a job stacking shelves because on CV I am overqualified and employers won't even offer me an interview. The council still haven't budged on the 150% c/tax bill. Their attitude is disgusting to be honest. I have been meaning to raise a complaint but haven't had a chance. I have been looking after two toddlers an most of the time feel like pulling my hair out. I have a whole list of things to deal with - court papers for credit card debt, court papers for a parking ticket, finding the court papers for this flat, sorting out debts - dozens of small ones that need to be dealt with. I know this all sounds pathetic but it seems I can't cope with all the stress and so don't deal with anything. And I'm getting very forgetful about what I have dealt with and haven't. What can I do to prevent getting into a worse situation with Rundles? I'm hoping if I manage to find the legal papers the council will make an arrangement with me but I don't remember them being that agreeable before unless they made a mistake!!!
  3. Hi. The mediation 'failed' because I was ill when they called. Next thing I got a letter in the post saying the case has been referred to the court for judgement. I haven't got a date yet. I read somewhere that if debt is sold on then legally there has to be some sort of written agreement or something??? I haven't seen ANY paperwork from Hoist or their solicitors. It's like they've just disregarded my request. Can they do that? Are we wasting our time requesting documents if they do not bother to respond in any way whatsoever? What do I do now? Do I admit to the debt and make a payment arrangement or what? I am now on benefits having used up all the equity from my house sale to live on - there's nothing left. I have not been able to get work My benefits start in a month's time. I have 10 other creditors who no doubt will want the same arrangement. I also have bailiffs to deal with (I've raised a separate post on this) who are getting £50/month against an old council tax bill, but also that same council has referred another debt to them which I won't be able to pay. This is all too much.
  4. Also, if mediation fails/does not take place, then it will go to court for a judgement. Isn't that worse?
  5. Mediation set up call with Hoist but didn't ask me if I had everything, only asked my availability. I missed the call anyway with Hoist as I was ill. No doubt they will attempt to set it up again (?) and if they do should I mention that Hoist haven't sent me any documents? thanks
  6. Hi. Re the Out of Time Notices, that sounds reasonable. Do I need to call the council and suggest this as a way forward for them to stop the bailiffs? Otherwise it might take him days to do this by which time that bailiff would have returned to my home. The bailiff isn't a nice one - he's arrogant and talks down to me. Said I was liable unless I proved otherwise and that he's coming back. I think he said that he was going to take inventory tomorrow (but I'm not letting him in) and he will give me max 7 days to get the offending person to contact him to arrange payment or else he's coming back for my goods. Odd thing is, the only items of value here are two laptops which I can prove belong to me. There is nothing else other than my daughter's jewellery which is clearly not mens stuff. The rest is furniture and bedding. And kids stuff.
  7. Hi Thanks both for your responses. We did not call the council but returned the letters saying he doesn't live here. Which is true. I don't know which stage letters were received because they weren't opened, just returned. I don't see how the ex's mother can help as she's as much a victim as us because of his actions, although I think he does stay mainly at her house. She can't determine where he registers vehicles to. Statutory declaration? I think we already need to do one of these for an unpaid congestion charge he's inflicted on my daughter when he used her car a while back. The guy is a liability to everybody he has contact with!!! So, don't let the bailiff in. That's ok I won't. Should anybody call him again - to say what?? Apart from statutory declaration and getting a copy of our tenancy agreement, I don't see what else I can do? Should I phone the council and if so what should i say? The bailiff didn't leave a ref number for council just a Newlyn ref. thanks
  8. Hi My daughter's ex registered a car at our address - we didn't know he did it at the time and he didn't have our permission. I remember him chasing her for a log book but don't know if he ever got it. He has since had a penalty notice from a borough council which has been referred to Newlyn bailiffs. The bailiff posted a letter through my door just now saying he will be back in 24 hours to take an inventory and I have to prove that none of the goods belong to this lowlife. I rang the bailiff (big mistake probably) and explained the situation but he doesn't want to know. I told him that my daughter has two kids with this man but doesn't have that much contact with him and isn't sure where he lives. She just knows his mum's address. The bailiff said it doesn't matter. Ours is the address he has and that is the one he will attend for taking an inventory. He said he will give me 7 days to get the lowlife to contact him and arrange payment. Lowlife will not pay because he's a lowlife. He pays nothing. I am at my wits end and don't know what to do. Please, any advice would be welcome. thanks PS there is another penalty we sent back to council (different council). Does "not at this address" mean anything anymore? Is this going to happen again? Update: I've spoken to my daughter and it turns out a similar call was made to his mum's house (must be for a different car?) and she showed them her tenancy agreement and they went away. This bailiff said he wanted proof that he didn't live here but also said I had to prove my/my daughter's goods are not his. How can I do that? I don't want the bailiff in my house at all. I feel violated enough already. Lowlife seems to think we can all just make this go away for him!!!

  10. Thanks. I will tick the mediation section and if I get to talk to Hoist I will expect docs. If they produce them then they can demand their full amount I guess even though they didn't produce them in the time specified in the letters. If they produce them I still won't be in a position to pay or negotiate a settlement anyway as i have nothing to offer them. Bit of a mess really. I will let you know if i hear anything.
  11. Hi My daughter parked in Valley Park Retail Park a while back. It was 7.30 pm and shops were shutting and loads of spaces empty. She parked in a disabled bay. Was only there for a few mins and got a ticket. I know she shouldn't have done it and hasn't since. We have ignored all the tickets and letters these people have sent and now Zenith have offered a reduced charge of £80. We haven't accepted the offer yet. I'm confused in that her car is still registered at our old address but post is coming to current address. There is currently a case against her that PACE is taking through the courts. Would they have got current info from that? Does anybody think we should pay the £80? My daughter is on a very low income and if PACE win at court she will only be able to offer them a tiny amount each week as payment. I've got questions also about two other parking issues both with bailiffs and wondered whether I should do a separate post for those - each or together? I feel I am using a lot of CAG's time at the moment. So many parking problems and debt problems. thanks
  12. Hi I sent off the letters to Hoist and to their solicitor asking for the documents as per the advice above. That was at the beginning of July and I haven't received anything from them at all. I have a N180 which has to be mailed back to the court today as it has to be there by 25 Aug. I was about to fill it in when it mentioned mediation etc. So i got confused and wasn't sure what to write. Shall I complete it as though I don't want to mediate etc? What is the position if Hoist and their solicitors have not provided me with the CCA docs etc? thanks
  13. Hi I missed the 2 July deadline. I also don't know what my defence is anyway?? Also I didn't get the CCA and CPR requests out quick enough - certain issues going on at home which have interfered with what I needed to do. Any advice on what I should do next. Shall I lodge something with the court anyway on Monday 4th and if so what should I say? I can say I am unemployed now and have other creditors all wanting payment but I just don't know. thanks for the advice previously which wasn't disregarded as I did what was suggested but just not quick enough.

I need to send my defence in by 4pm 1st July and also go on MCOL now and register my defence. the stuff I need to send by 1st July, what is that? is it what I'm asking for on the CCA and CPR or whatever? I can't see what defence I could have other than I didn't realise Hoist existed and hadn't entered into any agreement with them. My contractual agreement with B/Card was breached a long time ago when they accepted payments through Step Change. I will read the threads and get these requested immediately. does it have to be by recorded letter? I will do this anyway straight away. Thanks

I was not aware but I don't always open my post due to depression, but usually open statements in order to keep track of the amounts owed Did you receive a Default Notice from the original creditor? I don't know for sure but probably, I think these are enclosed with statements Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? I don't know for sure Why did you cease payments? Unemployment - it was around November 2014. I wrote to all creditors on 22/2/15 explaining my job loss and unemployment status but I couldn't make another arrangement with them because I had no income and there are lots of them all wanting their money. What was the date of your last payment? I don't know. I was paying via Step Change but lost my job Was there a dispute with the original creditor that remains unresolved? No. Barclaycard were the worst for adding on interest when all the others ceased charging this, and they've done it again now with this claim. The debt was £5.3k and now it's £6.7k. Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt managementicon plan? Yes, I wrote to them on 22/2/15 explaining I had lost my job. I wrote the same letter by hand to all my creditors. I couldn't make any offer of payment at that time but i did ask ALL OF THEM what the minimum was that they would be prepared to accept each month but none of them came back with a figure. Thanks for any help and advice. My total debts at end 2009 were £69k and I reduced them to around £24.5k but then suffered a series of unemployments/redundancies.   17. Sorry if I sound like a disaster movie as I seem to be on here a lot. I have had a court summons through for a credit card debt - Barclaycard £5.5k and now £6k with added charges. I have at least 10 or 11 other creditors the same but for mostly smaller amounts of around £3k. I owe about £24k altogether - it was £69k when my finances first went belly up but I've been paying off etc. I am now unemployed and will be 60 later this month so little chance of getting a job. I also have not been able to pay gas and electric and bills have mounted up to £2k. They said they would fit key meters. But I need to call them. Same with water company and don't know how they deal with debt. Feel like I'm drowning. Shall I call Barclaycard or their agents and see if I can negotiate a payment plan? I haven't even signed on yet as I was on long-term sick and then got sacked so received a month's pay in lieu. I have nothing coming in now. My daughter who I live with is on income support as she has two small toddlers and cannot afford childcare. I will write to my creditors this weekend but I'm worried that most of them will not accept a £1 a week or whatever. But if I have so many of them to pay off I can't really afford much more. In fact, I will probably struggle with that much across all of them. Do the courts allow you to offer small amounts like £1 a week? Any advice will be very much appreciated. Thanks, again! ps: I wanted to add that there is now another debt to add to my £24k and that is approx £350 for the last two unpaid monthly amounts for Pounds to Pocket. I have paid all previous 10 months and the loan would have been finished but can't give them what I haven't got and the bank has barred any payments to them. I also want to reclaim £150+ in late payment charges to NewDay for my House of Fraser scorecard. I only use it once a year for a birthday pressie for around £50 or so but I was unable to make a couple of the payments and their charges are horrendous. So when my last salary went into the bank they took £186 which included £30 in monthly payments and the rest in fees. Any ideas on how I should approach them. Sorry this is so lengthy.
  18. Thank you guys. I will keep an eye open for any paperwork. I just hope they accept our late defence. If not, the worse is £226 but if they do I will stay on the ball and fight it as best I can. Fines are a mixture of my car (my name) her car (her name). I don't understand how she manages it. We hopefully won't get any for ages now but every now and then she gets lots all at once. She even has a£300 fine looming from TFL for congestion charge - her BF borrowed car and didn't tell us he went into London and we didn't find out until charge had reached £300. They are no longer a couple so it makes it hard to get the money from him. She's told him about it but he just blanks her. I worry every day about all this and just want to shake her by the throat sometimes (metaphorically speaking of course). I usually do ok with sorting these out but I'm fragile at the moment and not coping. I am going to have to make sure she tries to deal with some of them, esp as they are hers anyway.
  19. Hi, I have made the adjustments in the defence document you attached and I've attached that to an email. I received an auto reply from the court which stated that all such claims, defences etc should be sent to the following email address, so I forwarded it on. But for info it is: [email protected] I remember the POC just had details of the charges, and date of original alleged offence. Nothing else, no address of where daughter parked or anything. Anyway, I will keep my fingers crossed. I hate these money grabbing firms with a vengeance, and the legal firms that encourage their greed. I lost the original court papers so have included a sentence in the email about finances and stating that can only pay a few pounds a month. I will let you know what happens. If they rule against my daughter, this means she will get a CCJ. That will stop her getting a mortgage in the future won't it?? This is serious stuff over an alleged parking violation. thanks

  21. Hi, sorry for not checking in lately but I ended up in hospital with my illness. Just to give you the bigger picture: PACE (this thread) I have a horrible suspicion that I might not have done something in time and that I will lose the judgement. I did the AOS on 26 April (a Tuesday) and got that in on time but been ill since. I went to check online today to see what's next but cannot find the paperwork anywhere and laptop doesn't like my password. I am so disheartened by this. I have spoken to daughter again and all she can say is it was near Canary Wharf overlooking the Dutch barges and it was near a hotel. Totally not helpful. I am so angry with her. The BF is useless and I'm not sure it was his uncle so think I'm not getting the info I need, and she's chucked the original letters/tickets out. Why would PACE change their mind? I can't see them doing that. I think it might be worth putting in a chancer of a challenge and ask them to prove this and that…??? If I haven't ran out of time. I can't ask for another password because the system says I will need to answer other questions and I'm now very confused. So that's potentially £226. Other tickets I am trying to sort out: Merton council sent bailiff so £30 parking ticket now £420 or whatever. No option but to pay £5 a week. I made a £5/week arrangement on the phone with them but for some reason was waiting to get something in the post and didn't, so lost sight of it a bit. Valley Park Croydon retail park - can't find the ticket at all. I will try and find out who issues the tickets there. Wandsworth - I appealed asking them to issue ticket again as I didn't get chance to pay at reduced rate, so not a valid appeal really, just a request but there was no other way of doing this. Staff didn't seem interested at all. That was weeks ago now and haven't heard back from them. St Helier hospital car park - ticket issued by Empark - has anybody heard of them? Again, I'm really angry as she parked in staff car park after I said just drop me and go….!!!! Croydon council - went out drinking and left car overnight so another ticket. Sutton council - she's lost ticket she got for being in a loading bay for a minute when she was picking somebody up with their shopping. I am so stressed with all these and she's no help. She cannot cope with this sort of stuff and assumes I can but this is defeating me. We haven't had any tickets for ages then all these around the same time. All this is going to cost about a grand. thanks for your help so far.
